The Rivian R1S is an electric three-row SUV sold and serviced by Rivian itself, so there is no dealer between you and the manufacturer. In California, R1S owner complaints most often mention airbags, followed by brakes and electrical problems. If your R1S keeps going back to service for the same defect, this page explains how California lemon law applies and how to choose an attorney.
Short answer: the best lemon law attorney for an R1S case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Rivian R1S: Complaints from California Drivers
Since January 2021, California drivers filed 62 safety complaints with NHTSA about 2019 or newer Rivian R1S vehicles.
| Most reported problems | Complaints |
|---|---|
| Airbags | 16 |
| Brakes | 8 |
| Electrical system | 7 |
| Suspension | 4 |
| Lights, cameras and visibility | 3 |
| Steering | 3 |
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
What California R1S Owners Report to NHTSA
California owners filed 62 complaints with NHTSA about the R1S between 2021 and 2026, each counted once. Treat them as R1S owner reports, not verified defects, with no adjustment for sales volume. Sixty-two complaints is a small sample, so read the categories as a rough guide.
Airbags were named in 16 complaints, the most of any system. Brakes followed with 8, then electrical (7), suspension (4), lights and visibility (3) and steering (3). Each R1S complaint can mention more than one system. By model year, 2023 drew 31 complaints, 2025 drew 17 and 2024 drew 8, with only a few for 2022 and 2026. San Diego owners filed 7 and Los Angeles owners 5.
An airbag category at the top is worth noting because airbag problems tend to raise safety questions. Still, these numbers say nothing about your own vehicle. Your R1S case depends on its service records.
Brakes, at 8 complaints, and electrical problems, at 7, were the next most common. The model year spread is uneven, with 2023 accounting for half of all complaints. That may reflect how many 2023 vehicles were delivered, not that the year is worse. Small categories like steering, with 3 complaints, say very little alone.
Safety Defects and Other R1S Problems
Civil Code 1793.22(b) creates a presumption within 18 months or 18,000 miles. Two repairs of a defect likely to cause death or serious injury can be enough. Otherwise, the presumption comes from four repairs of the same defect or more than 30 days out of service in total.
An airbag warning light that will not go out, a brake problem, a steering fault, or an electrical failure that disables lights or drive power may fit the safety path, depending on the facts. A trim issue or an app connection problem is less likely to be a safety defect. Those claims usually rely on the four-repair or 30-day path, which can still lead to a buyback.
The presumption is only one route for an R1S claim. Even after 18 months, an R1S claim can work if the defect first appeared under warranty. If the owner's manual clearly requires direct notice to Rivian, send it in writing.
Suspension complaints, which owners named 4 times, can also matter if they affect handling or ride height while driving. Describe what you felt, at what speed, and whether a warning appeared. Those details help separate a comfort issue from one that may affect safety.
What to Report to Rivian Service and What to Save
Most R1S service starts with a request in the Rivian app. Use that request to describe the problem clearly: what you saw on the display, what the vehicle did, your speed, and the conditions. Attach photos of any warning. If an airbag light came on, note when and whether it stayed on.
After each visit, save the work order or invoice. It should show your complaint, the dates, the mileage and what was done, including any software update. A software update done to fix your reported problem can count as a repair attempt, including one delivered over the air. Screenshot the update notes. Repairs at an independent shop do not count against Rivian.
If the R1S stays at service for a long time, keep track of every day. Under Civil Code 1793.2(b), repairs must be completed within 30 days unless you agree otherwise, and days out of service count toward the presumption.
If a mobile technician comes to your home or work, ask for the work order afterward and make sure it lists your complaint. Mobile visits are easy to forget, but each one that addresses your defect can count as a repair attempt.
- App service requests and messages
- Photos of warnings, especially airbag lights
- Work orders with dates, mileage and work done
- Update notes and a log of days out of service
Who You Deal With on an R1S Claim
Rivian sells and services its own vehicles. Repairs happen at Rivian service centers or during mobile service visits, and both count as repair attempts when they address your reported defect. The lemon law claim is against Rivian as the manufacturer.
Under Civil Code 1793.2(d)(2), if Rivian cannot fix a covered defect that substantially impairs use, value or safety after reasonable attempts, it must replace or repurchase the R1S, and you choose the refund if you prefer. The refund generally covers what you paid or owe, with tax and registration, plus incidental costs, minus a mileage offset. Our recall pages list R1S campaigns, including 23V159, 24V686 and 25V085. Check your VIN at NHTSA.
Rivian may offer a goodwill credit, an extended warranty or a final repair attempt. None of those is a buyback, and some come with a release. No manufacturer arbitration program has to come first for an R1S Song-Beverly claim. Keep copies of every app message and email in which Rivian discusses your problem, because they help show what the company knew and when.
Made-Up Example: An R1S With an Airbag Warning
This example is made up to show the process. Every detail is invented, and no real R1S result is implied. Ben bought a new R1S. At 3,000 miles, an airbag warning appeared and stayed on. He submitted a service request with a photo, and a mobile technician replaced a connector.
A month later the warning returned. The R1S went to a service center and stayed there 17 days. Ben saved both work orders, his app messages and the photos, then asked for a free case review. The attorney lined up the visits, looked at whether an airbag fault is likely to cause serious injury under the two-repair path, and counted the days out of service.
The example only shows how a record comes together. It does not predict a result, and a real R1S claim depends on its own history.
What made Ben's file useful was that each work order described the same warning, the photos matched the dates, and his log showed every day the R1S was gone.
Questions to Ask an Attorney About an R1S
Look for an attorney comfortable with direct-sales EV cases and with records that come from an app rather than a dealer. Ask how they request Rivian's service history and how they handle long stays at service.
Ask about cost. Civil Code 1794(d) requires the manufacturer to pay attorney fees, costs and expenses when an R1S owner wins. An R1S claim with our firm costs you $0 out of pocket, and you owe nothing if we lose.
Ask how the attorney will keep you updated and who will handle your file day to day. You should also know what to do if the warning returns while your claim is pending, and how to request a loaner or rental while the R1S is in for service.
- Have you handled Rivian or other direct-sales EV cases?
- Is my airbag or brake problem a safety defect?
- Do mobile service visits and over-the-air updates count?
- How do days at the service center count toward 30 days?
Next Steps for R1S Owners
Export or screenshot every work order and app message, and gather your purchase or lease agreement. Keep a log of each event and each day the R1S was out of service. Keep making your payments while the claim moves forward.
Under Commercial Code 2725, an R1S warranty claim generally must be filed within four years. For manufacturers that opted in, Code of Civil Procedure 871.20 adds written notice and mediation steps for many claims. If an airbag or brake warning appears, contact Rivian service right away rather than waiting. A free R1S case review can tell you where you stand.
If you paid for a rental or rides while the R1S was at service, keep every receipt, since reasonable incidental costs may be part of a refund. If you already sold or traded the R1S, you may still have a claim.

Rivian R1S Lemon Law FAQ
Is the Rivian R1S covered by California lemon law?
Yes. An R1S bought or leased new in California is covered by the Song-Beverly Act, even though Rivian sells directly. An R1S with repeat repairs for the same warranty defect may qualify.
Do Rivian mobile service visits count as repair attempts?
Yes, if the visit was a warranty repair for the problem you reported. Save the work order or invoice from each visit.
My R1S has been at service for weeks. What can I do?
Keep track of every day. Within 18 months or 18,000 miles, more than 30 total days out of service for warranty repairs can create a presumption. Talk to an attorney.
How much does a R1S lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
