Headlights that flicker or go dark, a backup camera that shows a black screen, fogged or water-filled light housings, a windshield that cracks with no impact, or wipers and defrosters that quit can make it hard to see and be seen. These problems are easy to put off, but many of them affect safety. If an authorized dealer has tried to fix your lights, cameras or visibility equipment and failed, California's lemon law may give you options.
Short answer: the best lemon law attorney for a visibility defect case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Lights, Camera and Visibility Problems: Complaints from California Drivers
Since January 2021, California drivers filed 1,206 safety complaints with NHTSA about 2019 or newer vehicles with lights, camera and visibility problems.
Most named models: Subaru Outback (130), Subaru Forester (73), Honda HR-V (59), Tesla Model Y (51), Kia Telluride (44).
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
What Lights, Camera and Visibility Problems Look Like in a Lemon Law Case
This group covers a wide range of equipment. Owners report headlights or taillights that fail early or flicker, adaptive or automatic high beams that do not work, moisture inside light housings, backup and surround view cameras that freeze, go blank or show a distorted image, blind spot displays that drop out, windshields that crack, and wipers, washers or defrosters that stop working.
Many of these parts are tied to software and control modules. A dealer may replace a bulb on one visit, a camera on the next and reflash a module on the third. If the same problem keeps coming back, each of those visits can be part of one repair history.
Under the Song-Beverly Act, if a warranty defect substantially impairs use, value or safety and the manufacturer or its dealers cannot fix it after a reasonable number of attempts, the manufacturer must replace or repurchase the vehicle. You may choose a buyback instead of a replacement (Civil Code 1793.2(d)(2)).
Visibility problems often get treated as small items, so owners wait or pay to fix them elsewhere. Waiting is understandable, but repairs at an independent shop or done yourself do not count toward a lemon law claim. Bring the car to an authorized dealer each time so the manufacturer has the chance to fix it and the visit is on record.
Is a Visibility Defect a Safety Defect?
Often it is. Headlights that go out at night, a windshield you cannot see through, wipers that stop in the rain, a defroster that will not clear the glass or a backup camera that fails when you reverse can all lead to a crash. Defects like these may be argued as likely to cause death or serious injury.
When that is the case, the Tanner Act presumption can apply after two repair attempts within 18 months or 18,000 miles (Civil Code 1793.22(b)). The same section also covers four or more repairs of the same defect, or more than 30 total days out of service. If your owner's manual clearly requires you to notify the manufacturer directly, that notice is needed for the safety and four-repair routes.
Other problems, such as a cosmetic haze on a lens or a camera that is slow to start but works, are less likely to be treated as safety defects. They can still qualify under the other routes. And the presumption is only one way to prove a case: claims can succeed outside 18 months or 18,000 miles if the defect first showed up under warranty.
Driver-assist features often rely on the same cameras. A camera fault can turn off lane keeping, automatic emergency braking or adaptive cruise control, and the car may show a message that these systems are unavailable. If that happens, include it in your complaint. Losing several safety features at once makes the impact of a camera defect easier to see.
What to Tell the Service Advisor and What the Repair Order Should Say
Visibility problems are often intermittent. A camera works in the shop and fails in the sun. A light fogs only after rain. So your description, and photos or video, carry a lot of weight.
- Which part: 'driver headlight', 'rear camera', 'front windshield', 'rear defroster'.
- When it fails: at night, in rain, in heat, after a car wash, when reversing.
- What you see: black screen, flicker, condensation inside the lens, crack starting at the edge.
- Say 'This affects my ability to see and drive safely' if it does.
- Show the advisor your photos or video and ask that they be noted.
- Ask that software updates, parts replaced and 'could not duplicate' findings all be written with your complaint.
What California NHTSA Complaint Data Shows About Visibility
The figures below are owner complaints to NHTSA from California drivers about 2019 or newer models, filed from 2021 through 2026. They are not adjusted for sales, so models with more cars on the road can show more complaints. This group combines complaints about lights, cameras and other visibility equipment.
There were 1,206 complaints in that set, making this one of the larger problem groups. By model, the most were for the Subaru Outback (130), Subaru Forester (73), Honda HR-V (59), Tesla Model Y (51) and Kia Telluride (44). By make, the top five were Subaru (282), Honda (128), Tesla (112), Ford (111) and Toyota (101).
A complaint is an owner's report, not a finding that a car is defective. If your model is listed, check the NHTSA recall lookup with your VIN and file your own report. A dated NHTSA report in your own words can support the timeline in your repair orders.
Check whether a recall covers your part. A recall is a manufacturer safety repair program, while a lemon law claim is about a defect that was not fixed after reasonable attempts. Recall repairs can count as repair attempts, so if a recall fix does not solve your problem, that visit still belongs in your history.
Example: A Backup Camera That Keeps Going Black
This is a made-up example to show the process, not a real client or a result. Sofia buys a new crossover in San Jose. A few months in, the backup camera starts showing a black screen about half the times she shifts into reverse. She records a short video and takes the car to the dealer, which replaces the camera.
Two weeks later the screen goes black again. The dealer updates the software and lists the update as the repair for her complaint. On a third visit, the technician cannot make it fail, but the repair order still lists 'customer states rear camera goes black when reversing, could not duplicate'.
Sofia calls a lemon law attorney. The attorney reviews the three repair orders, her video and the owner's manual. Because a camera that fails when reversing can be argued as a safety issue, the attorney looks at whether the two-repair route applies, handles any required notice to the manufacturer, and explains the next steps while Sofia keeps using the authorized dealer.
Notice that Sofia kept her video and made sure the 'could not duplicate' visit was written up anyway. Those two habits gave her attorney a complete record of the problem, even on the day the camera worked in the shop.
How to Choose an Attorney for a Lights or Camera Case
Visibility cases can look small on paper. The right attorney takes them seriously, reads every repair order, and explains honestly whether your problem fits the safety route, the four-repair route or the 30-day route. Ask direct questions during your free case review.
On cost, a buyer who wins recovers attorney fees, costs and expenses from the manufacturer (Civil Code 1794(d)). With our firm, you pay $0 out of pocket, and if we lose, you owe nothing.
Also ask how the attorney keeps you informed. Visibility cases often involve several short visits rather than one long one, and you will want to know whether to keep going back, when to stop, and what to bring each time. Clear answers to those questions are a sign of an organized practice.
- Would you treat my problem as a safety defect, and why?
- How do you respond when the manufacturer blames road damage or weather?
- Do my software update visits count as repair attempts?
- What records should I collect before we talk again?
Next Steps if You Cannot See or Be Seen
If your headlights, wipers or defroster are not working, avoid driving in conditions where you need them, and get the car to an authorized dealer. Keep towing and rental receipts. Save photos and videos of each failure with the date.
Collect your purchase or lease contract and every repair order. Warranty claims generally must be filed within four years (Commercial Code 2725), and timing rules can be technical, so talk to an attorney early. Call 877-536-6620 or use the form on this page for a free case review.
Do not replace bulbs, cameras or glass at an outside shop to save time, and avoid aftermarket light kits or tinted lens covers. These changes can give the manufacturer a reason to blame something other than the factory part. Let the authorized dealer handle the repair and keep the paperwork.

Lights, Camera and Visibility Problems Lemon Law FAQ
Is a backup camera that keeps failing covered by lemon law?
It can be. If the camera problem is covered by your warranty and the dealer has not fixed it after a reasonable number of tries, it may qualify, and a camera that fails when reversing may be argued as a safety defect.
My headlights fill with condensation. Is that a defect?
Moisture inside a sealed light housing can be a defect, especially if it dims the light or causes bulbs or modules to fail. Report it to an authorized dealer each time and keep photos.
The dealer says my windshield crack was caused by a rock. What now?
Ask the dealer to write its finding on the repair order, and keep photos showing where the crack started. If cracks keep appearing without impact marks, an attorney can review whether it may be a covered defect.
How much does a visibility defect lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
