Driver-assist features are supposed to make driving safer. When they malfunction, they can do the opposite. Owners report cars that brake hard for no reason, collision warnings that go off on empty roads, lane keeping that steers the wrong way, adaptive cruise control that cuts out, and camera or radar errors that disable these systems. These problems are often fixed with software, which makes careful records especially important in a California lemon law claim.

Short answer: the best lemon law attorney for a driver-assist case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Most named models: Tesla Model Y (290), Tesla Model 3 (260), Polestar Polestar 2 (98), Honda Odyssey (77), Honda Pilot (50).

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.

What Driver-Assist Problems Look Like in a Lemon Law Case

Driver-assist systems use cameras, radar and software to watch the road. They power features like automatic emergency braking, forward collision warning, lane keeping, blind spot monitoring and adaptive cruise control. When a sensor or the software misreads the road, owners describe sudden hard braking with nothing ahead (often called phantom braking), alarms that sound for shadows or overpasses, a steering wheel that tugs toward the lane line, or a message that the system is unavailable.

These features are part of the vehicle and are generally covered by the new vehicle warranty. Under Civil Code 1793.2(d)(2), if the manufacturer or its dealers cannot fix a warranty defect that substantially impairs use, value or safety after a reasonable number of attempts, the manufacturer must replace or repurchase the vehicle. You do not need to understand the software to make a claim. You need to report what the car did, every time.

Many of these features are part of a package that added to the price of the vehicle, so a feature that does not work can also affect the car's value. Whether a particular problem substantially impairs use, value or safety depends on the facts, which is why a review of your records matters.

  • Phantom braking or sudden slowdowns with no hazard ahead
  • False forward collision or blind spot warnings
  • Lane keeping that steers unexpectedly or fights the driver
  • Adaptive cruise control that shuts off or will not engage
  • Camera, radar or sensor errors that disable safety features

Are Driver-Assist Problems Safety Defects?

Many are. A car that slams on its brakes on the freeway can be rear-ended, and a lane keeping system that steers toward another lane can cause a crash. Under Civil Code 1793.22(b), a defect likely to cause death or serious injury that was repaired two or more times within 18 months or 18,000 miles creates a presumption that the manufacturer had a reasonable number of tries. Phantom braking and unwanted steering are the driver-assist problems most often argued this way.

A blind spot light that flickers or a feature that is sometimes unavailable may not be treated as a safety defect. For those, the presumption can come from four repairs for the same problem or more than 30 total days out of service. The presumption is not the only path. A defect that first appeared under warranty can still support a claim after 18 months or 18,000 miles. If your owner's manual clearly requires direct notice to the manufacturer, give it.

Software Updates, Service Records and What to Report

Driver-assist problems are often addressed with software. An update meant to fix the problem you reported, whether done at the service center or over the air, can count as a repair attempt. Save the release notes or screenshots for each update, and note whether the problem changed afterward.

When you report the problem, give the date, time, speed, weather, road and which feature was on. "Car braked hard at 65 miles per hour on a clear freeway with no vehicle ahead, adaptive cruise was on" is the kind of description that belongs on a repair order. If your vehicle uses an app for service requests, take screenshots of what you wrote and the service center's reply, since those may be your only written record. Recalibration at a glass shop or independent shop is not a repair attempt by the manufacturer.

Also note the days the vehicle sits at the service center. Diagnosing camera and radar problems can take time, especially when parts are back ordered. More than 30 total days out of service within the first 18 months or 18,000 miles is another way to meet the presumption, and repairs must generally be completed within 30 days unless you agree otherwise under Civil Code 1793.2(b).

  • Dashcam or phone footage, with date and time if possible
  • Screenshots of warning messages and app service requests
  • Software version and update notes before and after each visit
  • Any windshield replacement or sensor work and who did it
  • Repair orders listing your complaint and any calibration

California NHTSA Complaint Data for Driver-Assist Problems

The counts below are owner complaints that California drivers filed with NHTSA in driver-assist and collision warning categories, for 2019 or newer models, filed from 2021 through 2026. They are not adjusted for sales, and each one is an owner's report, not a finding that a vehicle is defective. The data includes 1,878 California complaints.

Tesla had the most complaints by make with 594, followed by Honda (337), Ford (112), Polestar (100) and Hyundai (79). By model, the Tesla Model Y had 290, the Tesla Model 3 had 260, the Polestar 2 had 98, the Honda Odyssey had 77 and the Honda Pilot had 50. Almost all of Polestar's complaints in this category came from the Polestar 2. Large sales volume explains part of any brand's total, so treat these counts as background, not proof about your own car.

Driver-assist complaints also overlap with other categories. A phantom braking event may be filed by one owner as a brake problem and by another as a collision warning problem, so the totals on this page and the brakes page may include similar events. That is another reason to focus on your own vehicle's repair history.

Made-Up Example: Phantom Braking on the Freeway

This example is made up to explain the process. It does not describe a real client or result. Aisha leased a new electric crossover. Within a few weeks, the car began braking hard on the freeway when she passed under overpasses, with adaptive cruise control on. Once, the driver behind her had to swerve.

Aisha submitted service requests through the app and took screenshots of each one. The service center said a software update would address it. The braking returned after the update, and a second visit included a camera recalibration. After a third event, recorded on her dashcam, she gathered her lease, the app records, the update notes and the video. A lemon law attorney reviewed whether the phantom braking met the two-repair safety presumption, confirmed which visits counted, and sent the required notice to the manufacturer.

How to Choose an Attorney for a Driver-Assist Case

These cases depend on digital evidence, so ask how the attorney uses dashcam video, app records and update history. Ask whether they have handled claims where the manufacturer said the system was working as designed, or blamed weather, road conditions or a windshield replacement. For EVs sold without traditional dealers, ask how they handle service records that live inside an app.

Fees should not keep you from getting help. If you win, Civil Code 1794(d) makes the manufacturer pay your attorney fees, costs and expenses. Our clients pay $0, and if we lose the case, the client owes nothing. If the manufacturer offers a settlement under Code of Civil Procedure 998, review it with your attorney before you answer.

  • How do you use dashcam footage and app screenshots?
  • Do over-the-air updates count as repairs in my case?
  • What if the manufacturer says the system worked as designed?
  • Can I turn off the feature and keep driving while the claim is pending?

Next Steps for Driver-Assist and Collision Warning Problems

If a driver-assist feature acts in a way that puts you at risk, stop using it if you can do so safely, and report it right away. Keep the car's software and service history intact, save your videos, and report the problem to NHTSA. Keep making your loan or lease payments.

Then gather your purchase or lease contract and every service record and call 877-536-6620, or use the form on this page, for a free case review.

Timing matters too. Warranty claims generally must be filed within four years under Commercial Code 2725, and the rules about when the clock starts are technical, so it is better to ask early than to wait for one more software update.

Driver-Assist and Collision Warning Problems Lemon Law FAQ

Is phantom braking covered by California lemon law?

It can be. If the vehicle brakes hard with no hazard ahead and the manufacturer cannot fix it after a reasonable number of attempts, it may qualify, and it is often argued as a safety defect.

Do over-the-air updates count as repair attempts for driver-assist problems?

They can. If an update was meant to fix the problem you reported and the problem continues, it may count, so save screenshots of the update notes and your service requests.

Can a windshield replacement affect my driver-assist claim?

It can, because many systems use a camera mounted at the windshield. Tell your attorney who replaced the glass and whether the camera was recalibrated.

How much does a driver-assist lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
