California's lemon law is not only for family cars. A vehicle bought or leased for a business can qualify too, but only if the business has no more than five vehicles registered in California and the vehicle is under 10,000 pounds gross vehicle weight. That rule decides many business cases before anything else. Here is how it works, what records a business should keep, and how to choose an attorney for a work truck, van or company car.

Short answer: the best lemon law attorney for a business vehicle case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Which Business Vehicles Are Covered by California Lemon Law

The Song-Beverly Act covers new and leased vehicles sold with the manufacturer's new car warranty. For vehicles bought or used for business, it adds two conditions. The business must have no more than five vehicles registered in California, and the vehicle must have a gross vehicle weight under 10,000 pounds (Civil Code 1793.22(e)(2)).

Both conditions matter. A small contractor with three pickups can qualify. A company with six or more vehicles registered in California generally does not qualify under this rule, even if the vehicle with the defect is a small sedan. The count is about the business's registered vehicles, not just the one with the problem.

Gross vehicle weight rating, often shown as GVWR, is the maximum loaded weight the manufacturer rates the vehicle for. It is not the same as the curb weight or the towing capacity. You can usually find it on the label in the driver door jamb. Many cars, SUVs, half-ton pickups and smaller vans are under 10,000 pounds, but some heavy-duty pickups, cab-and-chassis trucks and large vans can be rated higher, so check your own vehicle.

Two numbers decide this first step: how many vehicles are registered to the business in California, and the weight rating of the vehicle with the defect. Gather your registrations and a photo of the door label before you call an attorney.

What a Lemon Law Claim Looks Like for a Business Vehicle

Once a business vehicle qualifies, the rules are the same as for a personal vehicle. If a warranty defect substantially impairs the vehicle's use, value or safety and the manufacturer or its dealers cannot fix it after a reasonable number of attempts, the manufacturer must replace or repurchase it, and the buyer can choose a buyback instead of a replacement (Civil Code 1793.2(d)(2)).

The Tanner Act presumption also applies. Within 18 months or 18,000 miles, a reasonable number of attempts is presumed if a defect likely to cause death or serious injury was repaired two or more times, the same defect was repaired four or more times, or the vehicle was out of service more than 30 days in total (Civil Code 1793.22(b)). Business vehicles can reach 18,000 miles quickly, but the presumption is only one way to prove a case. Claims can still succeed after that if the defect first showed up under warranty.

Mileage matters in another way too. Restitution is reduced by a mileage offset based on the miles driven before the vehicle was first taken in for the problem (Civil Code 1793.2(d)(2)(C)). For a high-mileage work vehicle, reporting a defect early can make a real difference.

Leased business vehicles are covered too, as long as the same business rule is met. A lease buyback typically refunds what was paid and pays off the lease. The manufacturer must also generally complete repairs within 30 days unless you agree otherwise (Civil Code 1793.2(b)), which matters when a work vehicle sits at the dealer and the business is waiting.

Records a Business Should Keep for a Lemon Law Claim

Businesses often have more drivers and more paperwork than a family does. That can help a claim if the records are organized, or hurt it if repairs and complaints are scattered.

Assign one person at the business to collect repair orders and driver notes. Scattered paperwork is one of the most common problems in business vehicle claims, and one organized file makes the attorney's review faster and clearer.

  • Current DMV registrations for every vehicle registered to the business in California.
  • The purchase or lease contract, and the door jamb label showing the GVWR.
  • Every repair order from an authorized dealer, with dates, mileage and the complaint.
  • Regular maintenance records, which help answer claims of neglect or abuse.
  • Notes from each driver who experienced the problem, with dates and conditions.
  • Towing, rental and other receipts tied to the defect.

Defenses Manufacturers Raise in Business Vehicle Cases

Manufacturers often look first at the business rule. Expect questions about how many vehicles the business has registered and whether the vehicle is over the weight limit. Having registrations and the door label ready answers those questions early.

They may also argue that heavy use, overloading, towing beyond the rating, or aftermarket equipment such as racks, lift kits, toolboxes or upfits caused the problem. Dealer-installed and upfitter equipment can raise separate questions about who is responsible. Keep records of what was added, who installed it and when.

Only repairs by the manufacturer's authorized dealers count toward a lemon law claim. Fleet owners sometimes send vehicles to an independent shop to save time, but those repairs do not count and can give the manufacturer a reason to blame outside work.

Another common argument is that a defect does not substantially impair the vehicle because it can still be driven. For a work vehicle, being unreliable on the job can impair its use and value, so record each time the problem kept the vehicle off the road or forced a change in plans.

Example: A Small Contractor's Work Truck

This is a made-up example to show the process. It is not a real client and does not predict any result. Luis runs a small landscaping company with three pickups registered in California. He buys a new half-ton pickup for the business, and the door jamb label shows a GVWR under 10,000 pounds.

At 7,000 miles, the truck starts losing power on the highway with a warning on the dash. The dealer replaces a sensor. Two weeks later it happens again while towing within the rated limit, and the dealer installs a software update for the complaint. Luis has each driver write down what happened and keeps every repair order.

He contacts a lemon law attorney, who first confirms the business rule using the registrations and the door label, then reviews the repair history. Because the truck lost power at highway speed, the attorney looks at the safety route, handles any required notice to the manufacturer, and keeps Luis informed while his company keeps making the truck payments.

Notice that the attorney's first step was not the defect at all. It was the registrations and the weight label. In business cases, confirming the rule early avoids months of effort on a vehicle that cannot qualify under the lemon law's business provision.

How to Choose an Attorney for a Business Vehicle Case

Look for an attorney who starts with the business vehicle rule instead of skipping it, and who will tell you plainly if your vehicle falls outside it. Business owners also want efficient communication, so ask who will be your contact.

A buyer who wins recovers attorney fees, costs and expenses from the manufacturer (Civil Code 1794(d)). Our firm charges $0 out of pocket, and if we lose, you owe nothing.

Ask, too, whether the attorney has worked with businesses that use their vehicles hard every day. They should understand that work trucks and vans carry loads, tow and rack up miles, and be able to explain how that affects the case without treating normal work use as abuse.

  • How do you confirm the five-vehicle and 10,000 pound rules for my business?
  • Does business mileage or towing hurt my claim?
  • How do upfits or added equipment affect the case?
  • If my vehicle does not qualify under the business rule, what other options might I have?

Next Steps for Business Owners With a Defective Vehicle

Pull your registrations and check the GVWR on the door label. Keep sending the vehicle to an authorized dealer for every repair and make sure each repair order lists the complaint in plain words. Keep making loan or lease payments during the claim.

Warranty claims generally must be filed within four years (Commercial Code 2725), and timing rules are technical, so talk to an attorney early. If your vehicle falls outside the business rule, other warranty claims may still apply. Call 877-536-6620 or use the form on this page for a free case review.

If you use a personal vehicle for rideshare or delivery work, the analysis can be different, so mention that use during your case review. Keep insurance current, and do not let drivers or outside shops try their own fixes on the problem while the claim is being evaluated.

What to Look For in a Business vehicle Lemon Law Attorney

  1. Checks the business vehicle rule first: how many vehicles are registered to the business in California and the vehicle's gross vehicle weight rating.

  3. Understands what options may remain when a business vehicle falls outside the lemon law's business rule.
