Peeling or bubbling paint, early rust, panels that do not line up, rattles, wind noise, water leaks and cracks in body or frame parts can all be warranty defects. Many of these problems lower the value of a vehicle, and some affect safety. If an authorized dealer has repainted, adjusted or resealed your car and the problem keeps coming back, California's lemon law may still help. Here is how these cases work and what to ask an attorney.
Short answer: the best lemon law attorney for a body and paint case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Body, Paint and Structure Problems: Complaints from California Drivers
Since January 2021, California drivers filed 654 safety complaints with NHTSA about 2019 or newer vehicles with body, paint and structure problems.
| Brands with the most complaints | Complaints |
|---|---|
| Tesla | 94 |
| Ford | 93 |
| Toyota | 70 |
| Honda | 39 |
| Volkswagen | 37 |
Most named models: Tesla Model Y (34), Volkswagen ID.4 (31), Tesla Model 3 (30), Ford Escape (21), Ford Explorer (17).
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
What Body, Paint and Structure Problems Look Like in a Lemon Law Case
This group covers the shell of the vehicle and the parts attached to it. Owners report clear coat that peels, paint that bubbles or chips easily, rust starting at seams, trim that falls off, misaligned doors or hood, rattles and wind noise, sunroofs and seals that leak, and cracks in body panels, welds, mounts or frame parts.
Body problems are often argued as cosmetic, but the lemon law looks at value too. A defect that substantially impairs the use, value or safety of the vehicle, and is not fixed after a reasonable number of attempts, requires the manufacturer to replace or repurchase it (Civil Code 1793.2(d)(2)). A car that has been repainted several times, or that leaks water into the cabin, can be worth less and harder to use.
Water leaks deserve special attention. Water inside the car can damage electronics, carpet and wiring, and can lead to mold. If a leak causes electrical problems, keep both complaints on the repair orders.
Manufacturers often try to blame the owner. They may point to bird droppings, car washes, parking in the sun, door dings or a past fender bender. The answer is good records: photos from early in ownership, a clean history, and repair orders that describe the problem in your words.
Is a Body or Structure Defect a Safety Defect?
Most paint and trim problems are not likely to cause death or serious injury. They usually fit the other routes of the Tanner Act presumption: four or more repairs of the same defect, or more than 30 days out of service in total, within 18 months or 18,000 miles (Civil Code 1793.22(b)). Body repairs can take a long time, so the 30-day route comes up often.
Structural problems can be different. A cracked frame member, a failing weld, a loose seat or seatbelt mount, or a hood or liftgate that will not stay latched can be argued as a safety defect. In that case, two repair attempts within the same window can be enough to raise the presumption. If your owner's manual clearly requires direct notice to the manufacturer, that notice applies to the safety and four-repair routes.
The presumption is one way to prove a case, not the only way. Claims can still succeed outside 18 months or 18,000 miles if the defect first showed up under warranty.
Remember that the 30-day rule has a second meaning too. Apart from the presumption, repairs generally must be completed within 30 days unless you agree otherwise (Civil Code 1793.2(b)). Body work that stretches on for weeks, often because of parts or paint matching, is worth tracking closely, with drop off and pick up dates on each repair order.
What to Tell the Service Advisor and What the Repair Order Should Show
Body shops and service departments sometimes do work without a clear written complaint. Make sure every visit is written up through the service department as a warranty repair, with your description.
If the dealer sends your car to an outside body shop, that is still the dealer's warranty repair. What matters is that the dealer's repair order shows your complaint and the work, so ask for a copy that includes the body shop's work, not just the shop's own invoice.
- Where the problem is: 'paint peeling on roof', 'water on rear passenger floor', 'gap at driver door'.
- When it started and whether it is getting worse.
- That there was no accident or damage, if that is true.
- Ask for photos to be taken and added to the file, and take your own.
- For leaks, note when water appears: after rain, car washes or overnight.
- Ask that any sublet body shop work be listed on the dealer's repair order.
What California NHTSA Complaint Data Shows About Body and Structure
The figures below are owner complaints to NHTSA from California drivers about 2019 or newer models, filed from 2021 through 2026. They are not adjusted for sales, so a model with many cars on the road can show more complaints.
There were 654 complaints in this group. By model, the most were for the Tesla Model Y (34), Volkswagen ID.4 (31), Tesla Model 3 (30), Ford Escape (21) and Ford Explorer (17). By make, the top five were Tesla (94), Ford (93), Toyota (70), Honda (39) and Volkswagen (37).
NHTSA complaints about body and structure can include safety concerns such as parts coming loose, not just appearance. A complaint is an owner's report, not a finding of a defect. If your model is listed, check the NHTSA recall lookup with your VIN and consider filing your own report.
If your car has had any accident, even a minor one, tell your attorney right away. It does not end a claim for an unrelated defect, but the manufacturer will look for it, and your attorney needs to know so the defect can be separated from any damage.
Example: Paint That Keeps Failing
This is a made-up example to show the process. It is not a real client and does not predict any result. Ana buys a new SUV in Bakersfield. At ten months, the clear coat on the roof begins to peel. She has never had an accident, and she has photos of the car from the day she bought it.
The dealer sends the car to a body shop to repaint the roof. Six months later the peeling returns and spreads to the hood. A second repaint follows, and the car is out of service for several weeks. Ana starts to notice a slight leak at the sunroof after rain and reports that too.
Ana contacts a lemon law attorney. The attorney reviews the repair orders, the body shop invoices, her photos and the total days the car was out of service. The attorney explains how loss of value and the 30-day route may apply, then handles communication with the manufacturer while Ana keeps the car insured and her payments current.
Ana also kept her photos organized by date and saved the repaint invoices. When the manufacturer suggested the paint failure came from outside causes, her early pictures showed the car's condition before any problem started.
How to Choose an Attorney for a Body or Paint Case
Body and paint cases often come down to whether the manufacturer can blame something other than a factory defect. Look for an attorney who asks for your early photos and history, and who explains how they would answer those defenses.
A buyer who wins recovers attorney fees, costs and expenses from the manufacturer (Civil Code 1794(d)). Our firm charges $0 out of pocket, and if we lose, you owe nothing.
A good attorney will also be clear about which problems are worth pursuing. A single small chip is different from paint that fails across several panels after repeated repaints. Honest guidance up front saves you time and helps you focus your repair visits on the defect that matters.
- How do you prove a paint or rust problem is a factory defect?
- Do body shop repairs done through the dealer count as repair attempts?
- Could my structural problem be treated as a safety defect?
- How do you count days out of service when a body shop has the car?
Next Steps for Body, Paint and Structure Problems
Do not pay an independent body shop to fix a warranty defect; those repairs do not count toward a lemon law claim and can give the manufacturer a reason to blame outside work. Take dated photos of the problem every few weeks so you can show it getting worse.
Collect your contract, repair orders, body shop invoices and rental receipts. Warranty claims generally must be filed within four years (Commercial Code 2725), and timing can be technical. Call 877-536-6620 or use the form on this page for a free case review.

Body, Paint and Structure Problems Lemon Law FAQ
Can peeling paint qualify under California lemon law?
It can. A paint defect that is covered by the warranty, substantially lowers the vehicle's value and is not fixed after a reasonable number of attempts may qualify, even though it is not a safety problem.
The manufacturer says my paint damage is environmental. What should I do?
Ask that the finding be written on the repair order, and keep dated photos and your car's history. An attorney can review whether the evidence points to a factory defect.
Do days at the body shop count toward the 30-day rule?
Days the car is out of service for warranty repairs can count, including time at a body shop the dealer sent it to. Make sure the dealer's repair order shows the dates.
How much does a body and paint lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
