Under the Song-Beverly Consumer Warranty Act, if Mercedes-Benz USA and its dealers cannot fix a warranty defect after a reasonable number of tries, the manufacturer must offer a replacement or a refund. That refund can include your down payment, monthly payments, and fees, less a mileage offset. If the violation is willful, the law also allows a civil penalty of up to two times your actual damages, and the manufacturer pays your attorney fees.

Mercedes-Benz Warranty Coverage and Lemon Law

Mercedes-Benz USA's model year 2027 Service and Warranty Information booklet lists these terms for passenger cars and SUVs:

• Basic (New Vehicle Limited) Warranty: 4 years or 50,000 miles from delivery or when the vehicle was put into service, whichever comes first.
• Plug-in hybrid high-voltage battery: 6 years or 62,000 miles. In California and certain other states, qualifying plug-in hybrids also carry an extended high-voltage battery warranty of 10 years or 150,000 miles.
• Emissions coverage: separate federal and California emissions warranties, some running 7 years or 70,000 miles for listed parts.

For electric models, the 2027 EQ booklet posted on Mercedes-Benz USA's site lists a battery limited warranty of 8 years or 100,000 miles for the EQB, CLA 250, CLA 350 and G 580, and 10 years or 155,000 miles for the EQE and EQS sedans and SUVs. Terms can change from year to year, and Sprinter vans have their own booklet, so confirm the numbers in the booklet for your exact vehicle.

The warranty sets the window that matters. A defect you reported to an authorized Mercedes-Benz dealer during the 4-year/50,000-mile period, or during the battery coverage for a high-voltage battery problem, can support a lemon law claim even if the warranty has since expired.

Mercedes-Benz Certified Pre-Owned vehicles come with an added limited warranty in addition to any remaining factory coverage. The exact terms are in your CPO paperwork. After Rodriguez v. FCA US (2024), an ordinary used car sold without the new-car warranty generally no longer qualifies, but CPO, demo and dealer vehicles still can, and we take those cases.

Common Mercedes-Benz Problems in Recalls and Complaints

Mercedes-Benz has a large lineup, and its recall record reflects that. Since the 2021 model year, the brand has issued 178 recalls and owners have filed 2,783 complaints, according to NHTSA recall and complaint data.

Four of those recalls carried a do-not-drive warning, and four told owners to park outside because of fire risk. Six were fixed through an over-the-air software update, meaning the car downloaded the fix without a dealer visit. If you own a vehicle under a park-outside or do-not-drive recall, call a lawyer early. In our experience, a recall with no available fix can support a buyback on its own.

Recalls by system

Electrical system recalls stand far ahead of everything else, with 45. That category covers wiring, control modules, displays, charging hardware and high-voltage batteries on electric models. One example is a February 2026 recall involving the traction battery on EQB models. After electrical come structure (20), air bags (11), seat belts (10), seats (9), and exterior lighting, back over prevention and power train with 7 each. Back over prevention covers rearview cameras and their displays.

Complaints by system

Owner complaints follow a similar pattern. Electrical problems lead with 500 complaints. Then come forward collision avoidance (321), engine (310), service brakes (179), power train (163), fuel and propulsion (138) and vehicle speed control (95).

In everyday terms, owners in these categories tend to report things like:

• A blank or rebooting central display, or a cluster full of warning messages
• Automatic braking or collision warnings with no obstacle ahead
• Rough running, loss of power, or the car dropping into a limited-power mode
• Cruise control or speed functions that act on their own or stop working

A complaint is an owner report, not a finding. But if the same symptom shows up on your repair orders more than once, it may be worth a closer look.

How a Mercedes-Benz Lemon Law Claim Works

Mercedes-Benz warranty repairs are done at authorized Mercedes-Benz dealerships, and Sprinter vans are serviced at authorized van dealers. Some dealers may offer pickup or a loaner car. However the car gets there, a repair order should be written for every visit.

Build your paper trail

• Get a copy of every repair order, including recall visits and visits where nothing was found.
• Read each one before you drive away. Make sure the complaint, mileage and dates are right.
• Photograph warning messages on the screen, and save any text or email updates from the dealer.
• Count the days. Under the presumption, more than 30 cumulative days out of service within 18 months or 18,000 miles can be enough on its own. See our page on the 30-day rule.

In our experience, the days your car sits at the dealer waiting for recall parts count toward that 30-day total. The presumption also applies after 4 or more attempts at the same defect, or 2 or more for a defect likely to cause death or serious bodily injury. It is one way to prove a case, not the only way.

Business owners with Sprinter vans

California lemon law can cover a vehicle bought or used mainly for business, if the business has no more than five vehicles registered in California and the vehicle's gross vehicle weight rating is under 10,000 pounds. Check the label on the driver's door jamb for your van's rating.

GLE 350, GLE 450 and AMG GLE 53

Midsize two-row SUVs. The GLE 450 has 21 recalls, the AMG GLE 53 has 19, and the GLE 350 has 158 complaints.

E 350 and E 450

The midsize E-Class sedan. The E 450 has 21 recalls and the E 350 has 20.

C 300, EQB 300 4MATIC and GLB 250

The C 300 is the compact sedan, with 125 complaints. The EQB 300 4MATIC is a small electric SUV with 110 complaints, and the GLB 250 is its gas-powered sibling with 97 complaints.

California Lemon Law for Mercedes-Benz Owners

The Song-Beverly Consumer Warranty Act protects Mercedes-Benz owners and lessees in California. If Mercedes-Benz or its authorized repair facilities cannot fix a warranty defect after a reasonable number of attempts, the manufacturer must repurchase or replace the vehicle (Civil Code 1793.2(d)).

A vehicle is presumed to be a lemon if, within 18 months or 18,000 miles of delivery, the same problem was repaired 4 or more times, a defect that could cause death or serious injury was repaired 2 or more times, or the vehicle was out of service for repairs for more than 30 days in total (Civil Code 1793.22). Many vehicles outside that window still qualify while they are under warranty. New, leased, certified pre-owned, demo and dealer vehicles can qualify; ordinary used cars without a new-car warranty generally no longer do after Rodriguez v. FCA US (2024).

What you can recover

• Buyback: your down payment, payments, taxes and fees, minus a mileage offset, with the loan or lease paid off.
• Replacement with a comparable new vehicle.
• Cash and keep: a cash settlement while you keep the vehicle.
