An engine problem can turn a new car into a constant worry. Some owners deal with a check engine light that keeps coming back. Others face oil consumption, overheating, knocking noises, rough idle or a sudden loss of power on the freeway. In a California lemon law case, the key questions are whether the warranty covers the defect, how many times the dealer tried to fix it, and whether the problem puts you at risk.

Short answer: the best lemon law attorney for an engine case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Common Engine Problems in California Lemon Law Cases

Engine defects range from annoying to dangerous. Some owners notice they are adding oil between changes. Others see a flashing check engine light, feel the car shake at idle, or hear ticking and knocking that gets louder. The most serious cases involve stalling or a sudden loss of power while merging or driving on the highway.

Under Civil Code 1793.2(d)(2), if the manufacturer or its dealers cannot fix a warranty defect that substantially impairs use, value or safety after a reasonable number of attempts, the manufacturer must replace or repurchase the vehicle, and you can choose the buyback. You do not have to know which part is failing. Your job is to report the symptom each time and keep the paperwork.

  • Excessive oil consumption or low oil warnings
  • Check engine light that returns after each repair
  • Misfires, rough idle, shaking or hesitation
  • Overheating or coolant loss
  • Stalling or sudden loss of power while driving

When an Engine Defect May Be a Safety Issue

A car that stalls at an intersection or loses power on the freeway can put you and others in danger. Under Civil Code 1793.22(b), a defect likely to cause death or serious injury that was repaired two or more times within 18 months or 18,000 miles creates a presumption that the manufacturer had a reasonable number of attempts. Stalling and loss of power are the engine symptoms most likely to be argued as safety defects.

Oil consumption, noise or a check engine light alone usually are not treated that way. For those, the presumption comes from four repair attempts for the same problem or more than 30 total days out of service. Remember that the presumption is not the only path. A defect that first appeared under warranty can still support a claim after 18 months or 18,000 miles, so do not assume you waited too long.

What to Say at the Dealer and What the Repair Order Should Show

Be specific about what the engine does. "The car lost power and the check engine light flashed while I was merging onto the freeway at about 60 miles per hour" is far more useful than "engine light on." If you have stalled, say so plainly, and say whether it happened in traffic. If you are adding oil, tell the advisor how much and how often, and ask whether an oil consumption test will be done.

Manufacturers often argue that engine problems come from missed maintenance. Keep every oil change receipt, even from quick-lube shops, because those show you cared for the car. Maintenance done elsewhere is fine for that purpose, but repairs for the defect itself must be done by an authorized dealer to count as repair attempts. Repairs at an independent shop or that you do yourself do not count.

  • Your exact complaint, including stalling or loss of power if it happened
  • Mileage and dates in and out
  • Diagnostic codes found
  • Parts replaced, software updates, and any technical service bulletin used
  • Oil consumption test results, if one was done

California NHTSA Complaint Data for Engine Problems

These counts are owner complaints that California drivers filed with NHTSA in the engine category, for 2019 or newer models, filed from 2021 through 2026. They are not adjusted for sales, so top-selling vehicles naturally appear more often, and a complaint is an owner's report rather than proof of a defect. The data counts 2,271 California engine complaints in total.

Among makes, Ford had 314 complaints, Toyota 223, Honda 202, Chevrolet 175 and Hyundai 163. Among models, the GMC Sierra 1500 had 73, the Chevrolet Silverado 1500 had 65, the Ford EcoSport had 61, the Toyota Corolla had 56 and the Ram 1500 had 55. Three of the top five models are full-size pickups, which many California drivers use for work and towing. Check NHTSA's recall lookup for your VIN, because a recall repair for an engine problem can also count as a repair attempt.

If your truck is registered to a business, it can still be covered. California lemon law protects business vehicles when the business has no more than five vehicles registered in California and the vehicle is under 10,000 pounds gross vehicle weight, under Civil Code 1793.22(e)(2). Many half-ton pickups fall under that weight limit, but check the rating on the door jamb sticker and ask an attorney before assuming either way.

Made-Up Example: An Engine That Uses Too Much Oil

This example is made up to show how the process works. It is not a real client and says nothing about results. Marcus bought a new pickup truck. Around 9,000 miles, a low oil warning came on, even though he had changed the oil on schedule. The dealer topped off the oil and told him to come back for a consumption test.

Marcus kept his oil change receipts and wrote down every time he added oil. The dealer ran the test, confirmed high consumption and replaced parts. A few months later the warning returned and the truck began to misfire. After two more visits, Marcus collected his purchase contract and every repair order and called a lemon law attorney. The attorney reviewed whether the misfires had caused any loss of power, counted the visits for the same defect, and prepared the written notice to the manufacturer.

How to Choose an Attorney for an Engine Defect Case

Ask how the attorney responds when a manufacturer blames maintenance, aftermarket parts or fuel quality. A good attorney will want to see your service history, not just the warranty repair orders. Ask whether they have handled engine claims for your make and how they use technical service bulletins as evidence.

Cost should never be a reason to wait. A buyer who wins recovers attorney fees, costs and expenses from the manufacturer under Civil Code 1794(d). With our firm you pay $0, and if we lose, you owe nothing. If the manufacturer acted willfully, the law also allows a civil penalty of up to two times actual damages under Civil Code 1794(c), though no attorney can promise one.

  • Have you handled engine claims against my manufacturer?
  • How do you answer the claim that I missed maintenance?
  • Do my stalling events help show a safety defect?
  • What happens if the manufacturer makes a settlement offer?

Recalls, Service Bulletins and Next Steps for Engine Trouble

Engine problems often come with paperwork from the manufacturer. A recall is a safety repair program, while a technical service bulletin (TSB) is a repair instruction sent to dealers for a known issue. A TSB is not a safety recall, but it can show the manufacturer knew about a problem. Recall repairs can count as repair attempts, so a recall visit for your engine issue belongs in your file.

Watch for repair orders that describe the same defect in different words. One visit might say "misfire, replaced spark plugs," the next "rough idle, updated engine software," and a third "check engine light, replaced coil." An attorney can show that these visits were all attempts to fix one engine defect, which matters for the four-repair count under Civil Code 1793.22(b).

Also track how long the car sits at the dealer. Engine repairs that require parts on back order can keep a car out of service for weeks. More than 30 total days out of service for repairs within the first 18 months or 18,000 miles is another way to meet the presumption, and dealers must generally complete repairs within 30 days unless you agree otherwise.

If the car stalls or loses power, put safety first and have it towed to the dealer if needed. Save the towing and rental bills, because reasonable incidental costs can be part of a buyback. Keep going back to the dealer each time the problem returns, and keep your loan or lease payments current.

Engine Problems Lemon Law FAQ

Does a check engine light that keeps coming back qualify for lemon law?

It can, if the light points to a warranty defect that the dealer cannot fix after a reasonable number of tries. Bring the car in each time the light returns and make sure each repair order lists the complaint and codes.

The dealer says my engine problem is from poor maintenance. What should I do?

Keep and share every oil change and service receipt. An attorney can review those records and respond if the manufacturer blames maintenance instead of a defect.

Is engine stalling a safety defect under California lemon law?

Stalling while driving may be treated as a defect likely to cause death or serious injury, which can trigger the two-repair presumption. It depends on the facts, so have an attorney review your repair orders.

How much does a engine lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
