Brakes are the one system every driver needs to trust completely. When a new vehicle has a soft or sinking pedal, grinding, pulling, a brake warning light, or brakes that engage on their own, it is more than an annoyance. Many brake defects can count as safety defects under California lemon law, which can mean fewer repair attempts are needed before the manufacturer must act.
Short answer: the best lemon law attorney for a brake case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Brake Problems: Complaints from California Drivers
Since January 2021, California drivers filed 1,705 safety complaints with NHTSA about 2019 or newer vehicles with brake problems.
Most named models: Tesla Model Y (132), Tesla Model 3 (99), Fisker Ocean (78), Volkswagen Atlas (36), Honda Civic (26).
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
Brake Problems That Show Up in Lemon Law Cases
Brake complaints fall into two broad groups. The first is the hardware you can feel: a pedal that goes soft or sinks to the floor, grinding or squealing on new pads, vibration when stopping, or a car that pulls to one side. The second is electronic. Newer vehicles use computer controls, regenerative braking on hybrids and EVs, and automatic emergency braking. Owners report brakes that engage when nothing is in the way, warning lights for the brake system, and a pedal that feels different from one stop to the next.
Either kind can support a claim. Under Civil Code 1793.2(d)(2), if a warranty defect that substantially impairs use, value or safety is not fixed after a reasonable number of attempts, the manufacturer must replace or repurchase the vehicle, and you may choose the buyback.
Regenerative braking deserves special mention. On many hybrids and EVs, the electric motor slows the car first and the friction brakes take over as needed. When that hand-off does not work smoothly, owners feel the car surge forward or the pedal change in the middle of a stop. Manufacturers may describe this as normal, so describe exactly what you felt, at what speed and on what kind of road.
- Soft, spongy or sinking brake pedal
- Longer stopping distances than normal
- Brake system or ABS warning lights
- Grinding, vibration or pulling while braking
- Brakes that apply on their own or regenerative braking that cuts out
Why Many Brake Defects Count as Safety Defects
A car that does not stop when you need it to, or stops when you do not expect it to, can cause a serious crash. That is why brake defects are often argued as defects likely to cause death or serious injury. Under Civil Code 1793.22(b), if such a defect was repaired two or more times within 18 months or 18,000 miles, the law presumes the manufacturer had a reasonable number of attempts.
The two-repair rule also asks that you directly notify the manufacturer if your owner's manual clearly requires it, so check your manual. Not every brake noise is a safety defect, and normal pad and rotor wear is usually a maintenance item. When the issue is noise or vibration without a clear safety effect, the four-repair rule or the 30-day out-of-service rule may be the better path. A claim can also succeed outside the 18-month or 18,000-mile window if the defect first showed up under warranty.
Recalls can be part of the picture too. Recall repairs can count as repair attempts, so if the manufacturer issued a brake-related recall for your vehicle and the problem returned after the recall work, that visit belongs in your count.
What to Tell the Dealer and What the Repair Order Must Say
Use clear, safety-focused language. "The pedal sank almost to the floor while I was stopping at a red light" or "the car braked hard on the freeway with no car in front of me" tells the technician exactly what to look for. Say whether you nearly hit something. If you had a close call, report it on the repair order.
Read the repair order before you leave. If it only says "brake noise" when you described a sinking pedal, ask the advisor to correct it. If the dealer updated software for the brake system or a related driver-assist feature, the update can count as a repair attempt when it was done to fix your complaint. Brake work at an independent shop does not count toward the manufacturer's repair attempts.
- Your complaint, including any near miss
- Date, mileage and days the car was at the dealer
- Parts replaced and any software or module updates
- Warning messages or codes recorded
- Whether the technician could reproduce the problem
California NHTSA Complaint Data for Brake Problems
These are owner complaints filed with NHTSA by California drivers in the brakes category, for 2019 or newer models, filed from 2021 through 2026. The counts are not adjusted for sales, so models that sell in large numbers show more complaints, and each complaint is an owner report, not a finding of a defect. The data includes 1,705 California brake complaints.
Tesla led the makes with 243 complaints, followed by Honda (150), Toyota (145), Ford (128) and Chevrolet (117). By model, the Tesla Model Y had 132, the Tesla Model 3 had 99, the Fisker Ocean had 78, the Volkswagen Atlas had 36 and the Honda Civic had 26. Three of the top models are electric vehicles, which blend regenerative braking with traditional brakes. Search your VIN on NHTSA's recall lookup and report a brake safety problem to NHTSA if you have one.
Tesla's totals reflect, in part, how many Model Y and Model 3 vehicles are on California roads. The Fisker Ocean appears near the top even though it was sold in much smaller numbers than the Teslas, which is a reminder that complaint counts and sales do not move together. Treat these numbers as background, not proof about your own vehicle.
Made-Up Example: A Brake Pedal That Keeps Sinking
This example is made up to show the process, not a real client or outcome. Elena bought a new midsize SUV. A few months later, the brake pedal felt soft and sank lower than normal when she stopped on a downhill street. A brake warning light came on and went off.
The dealer bled the brakes on the first visit and replaced a part on the second. Both times, Elena described the sinking pedal and the warning light, and she checked that the repair orders said so. When the pedal sank again a month later, she gathered her purchase contract, both repair orders and a note about the downhill stop. She called a lemon law attorney, who reviewed whether the defect met the two-repair safety presumption, checked her owner's manual for any direct notice requirement, and sent the required notice to the manufacturer.
How to Choose an Attorney for a Brake Defect Case
Ask whether the attorney regularly argues the two-repair safety presumption and what evidence they use to show a brake defect is dangerous. Ask how they handle cases where the manufacturer calls the problem pad wear or normal regenerative braking feel. For electric vehicles, ask whether they understand how brake and driver-assist software interact.
You should not pay to have your case reviewed. Under Civil Code 1794(d), the manufacturer pays the attorney fees, costs and expenses when you win. Working with our firm costs you $0, and you owe nothing if we lose.
Your own evidence can carry a lot of weight in a brake case. Dashcam footage, phone videos and notes written right after a frightening stop all help show what happened. Ask the attorney how they would use that evidence and whether you should save it in a particular way before the next dealer visit.
- Does my brake problem fit the two-repair safety rule?
- Do I need to notify the manufacturer directly?
- How do you answer the claim that this is normal wear?
- Can my phone video or dashcam help?
Next Steps If Your Brakes Are Not Safe
If your brakes feel unsafe, do not keep driving the vehicle. Have it towed to an authorized dealer and keep the towing bill and any rental receipts. Those can count as incidental damages in a buyback under Civil Code 1793.2(d)(2)(B). Check for open recalls and report the problem to NHTSA.
For many claims against manufacturers that opted in to the newer procedures under Code of Civil Procedure 871.20, there are pre-lawsuit written notice, early document exchange and mediation steps. Your attorney handles those steps, but your repair orders and notes are what make them work, so keep everything together in one folder.

Brake Problems Lemon Law FAQ
How many repair attempts do I need for a brake defect in California?
If the brake defect is likely to cause death or serious injury, two repair attempts within 18 months or 18,000 miles can create a presumption that the manufacturer had enough chances. The presumption is not the only way to qualify.
Are worn brake pads covered by lemon law?
Normal pad and rotor wear is usually maintenance, not a defect. If the brakes wear out unusually fast or fail despite repairs, an attorney can review whether a warranty defect is the cause.
Does phantom braking count as a brake defect?
Brakes that apply on their own can be a serious safety problem. Report each event, ask for a repair order, and have an attorney review whether it qualifies.
How much does a brake lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
