The Rivian R1T is an electric pickup sold and serviced directly by Rivian, so your repair history lives mostly in the Rivian app and your email rather than on a dealer's paper repair orders. California owner complaints for the R1T are few and spread across several systems. If your new or leased R1T keeps needing service for the same defect, California lemon law may require Rivian to repurchase or replace it.

Short answer: the best lemon law attorney for an R1T case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Rivian R1T: Complaints from California Drivers

Since January 2021, California drivers filed 38 safety complaints with NHTSA about 2019 or newer Rivian R1T vehicles.

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.

California R1T Complaint Data

California owners of 2022 and newer Rivian R1T trucks filed 38 complaints with NHTSA from 2021 through 2026, each counted once. That is a small sample for the R1T. These are owner reports, not verified defects, and they are not adjusted for how many trucks were sold.

The electrical system and suspension were tied at 5 complaints each. Driver-assist and collision warning systems and airbags had 4 each, and lights, cameras and visibility and the transmission and powertrain had 3 each. One R1T complaint can name more than one component, so these counts overlap.

The 2022 model year had the most complaints (19), followed by 2023 (14). The 2024 and 2025 model years had 2 each, and 2026 had 1. San Jose had 3 complaints, and Carmel Valley, San Francisco, Bakersfield and Redondo Beach had 2 each. With numbers this small, no category, year or city stands out as a reliable trend.

That makes your own records the heart of any R1T claim. The statewide count cannot tell you whether your truck qualifies, but your service requests, update notes and days out of service can.

Safety Defects and Other R1T Problems

The presumption in Civil Code 1793.22(b) applies within 18 months or 18,000 miles if a defect likely to cause death or serious injury was repaired two or more times, the same defect was repaired four or more times, or the truck spent more than 30 days out of service. If the owner's manual clearly requires direct notice to Rivian, give it.

Suspension problems that affect handling or control, airbag warnings that keep returning, and driver-assist systems that brake or steer unexpectedly are the R1T complaint types most likely to be argued as safety defects. An electrical fault that cuts drive power or lighting while driving can fit too.

Screens, app connectivity, trim and comfort features are more often treated as non-safety defects, which usually means four repairs or more than 30 days of downtime. The presumption is one route. An R1T defect that first showed up under warranty can still support a claim after 18 months or 18,000 miles.

Keeping a Strong R1T Service Record

Most R1T repairs start with a request in the Rivian app. The text you type often becomes the complaint on the service record, so be specific: what happened, when, at what speed, how often, and whether it continued after the last service. Attach photos or video of warning messages when you can.

After each service, save the invoice or summary and note the date and mileage. A software update performed to fix your complaint can count as a repair attempt, whether done at a service center, by a mobile technician or over the air, so save the release notes and the date. Over-the-air updates that arrive without a request are harder to tie to your complaint, so write down what changed. Repairs by an independent shop or work you do yourself do not count toward Rivian's attempts.

R1T warranty repairs must be completed within 30 days unless you agree otherwise under Civil Code 1793.2(b). Keep a log of days the truck is at a service center or waiting for parts.

Tell your attorney about any towing, off-road driving or accessories you added. Manufacturers sometimes point to how a truck was used when it has repeated problems. Whether that matters depends on the facts, and it is far easier to address when your attorney knows from the start. Towing and hauling within the published ratings is ordinary use for a pickup.

  • Your description on every service request
  • Dates, mileage and whether service was mobile or at a center
  • R1T parts replaced and software versions installed
  • Screenshots of warnings and update notes
  • Days without the truck and any rental used

Who You Deal With: Rivian

Rivian sells and services its trucks directly through its own service centers and mobile technicians, so there is no separate dealer. Your claim is against Rivian, the manufacturer that backs the warranty. Under Civil Code 1793.2(d)(2), if Rivian cannot fix a warranty defect that substantially impairs the R1T's use, value or safety after a reasonable number of attempts, it must repurchase or replace the truck, and you can choose the refund.

Because one company holds the records, export or screenshot your service history now so you do not depend on app access later. Recall repairs on an R1T can count as repair attempts for the same problem. Our site has R1T recall pages for 22V319, 22V641, 22V744, 23V109, 23V783 and 23V883. Run your VIN through NHTSA's recall lookup to see which apply to your truck.

An R1T buyback refund is based on what you paid or owe, including sales tax, license and registration fees, plus incidental costs like towing and rentals, minus a mileage offset based on miles driven before your first service visit for the problem.

You do not need to prove the exact technical cause. California courts have held that visits where the manufacturer could not find or fix the defect can still count.

Made-Up Example: An R1T Suspension Warning

This R1T example is fictional and only shows the process. It does not describe a real R1T owner or a real result. Chris bought a new R1T. A suspension warning appeared on the highway, and the truck rode noticeably differently until he parked and restarted it.

He opened a service request in the app, and a mobile technician performed a software update. Three weeks later the warning returned, and the truck went to a service center, where a part was replaced and the truck stayed for ten days. When the warning appeared again, Chris took screenshots, saved every invoice and his update notes, and asked a lemon law attorney for a free review. The attorney considered whether the suspension fault could be argued as a safety defect, counted the days out of service and handled the written steps with Rivian.

This example is not a promise of any outcome. It shows how app records, screenshots and update notes can stand in for traditional repair orders.

Questions to Ask a Lawyer About an R1T Case

Choose an attorney who has handled direct-sale EV cases and is comfortable building a case from app records. Ask how they count over-the-air updates and mobile service visits, and what they do if Rivian says the truck is operating as designed.

Ask what it costs. When an R1T buyer wins, Civil Code 1794(d) requires the manufacturer to pay attorney fees, costs and expenses. On an R1T case with our firm, you pay $0 out of pocket, and if we lose, you owe nothing.

Ask how the attorney handles offers. Rivian may propose a goodwill credit or another resolution, and after a lawsuit is filed it may serve a formal offer under Code of Civil Procedure 998. Rejecting a 998 offer and not doing better at trial can cost you post-offer costs, so go over every offer with your lawyer.

A careful attorney will also ask whether you have stopped using the truck for work, towing or trips because of the defect. That kind of detail helps show how the problem substantially impairs the R1T's use, value or safety.

  • Have you handled Rivian or other direct-sale EV claims?
  • Do my mobile service visits and updates count as repair attempts?
  • Does my suspension or airbag problem fit the safety rule?
  • How do you build a timeline from app records?

Next Steps for R1T Owners

Keep making your loan or lease payments and do not sell the truck before getting advice. Export your service history and save your purchase or lease contract. For many R1T claims, Code of Civil Procedure 871.20 adds pre-lawsuit notice and mediation steps for manufacturers that opted in. Warranty claims generally have a four-year limit under Commercial Code 2725, so ask for a free case review early.

If you bought the R1T used, ask what warranty came with the sale. After Rodriguez v. FCA US LLC (2024), a used vehicle with only the leftover factory warranty generally is not a new motor vehicle under the lemon law, though other warranty claims may still apply.

If you already sold the truck, you may still have a claim, because California courts have held that the buyer does not need to still own it. Keep your old service history and contract either way.

Rivian R1T Lemon Law FAQ

Is a Rivian R1T covered by California lemon law?

Yes. An R1T bought or leased new in California with Rivian's factory warranty is covered by the Song-Beverly Act. Buying directly from Rivian instead of a dealer does not change that.

Do mobile service visits count as repair attempts?

They can. A visit by a Rivian mobile technician to fix the problem you reported can count as a repair attempt by the manufacturer. Save the invoice or summary for each one.

Does an over-the-air update count as a repair on an R1T?

An R1T update done to fix the problem you reported can count. Save the date, version and release notes, and link them to your service request when you can.

How much does a R1T lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
