Hybrids and plug-in hybrids combine a gas engine, an electric motor, a high-voltage battery and a lot of software. When something goes wrong, owners may see warning lights, reduced power, rough transitions between engine and motor, charging failures or a car that will not start. Because the problem can sit in any of those systems, repair records get complicated fast. If your hybrid keeps going back to the dealer, California's lemon law may help.
Short answer: the best lemon law attorney for a hybrid case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Hybrid and Plug-In Hybrid Vehicles: Complaints from California Drivers
Since January 2021, California drivers filed 1,219 safety complaints with NHTSA about 2019 or newer hybrid and plug-in hybrid vehicles.

| Electrical system | 214 |
| Engine | 142 |
| Transmission and powertrain | 129 |
| Brakes | 105 |
| Collision warning and driver-assist systems | 84 |
| Fuel and EV propulsion system | 77 |
Most named models: Ford Maverick Hybrid (127), Honda Accord Hybrid (105), Honda CR-V Hybrid (80), Toyota Sienna Hybrid (70), Toyota RAV4 Prime (65), Chrysler Pacifica Plug-In Hybrid (62), Toyota Camry Hybrid (60), Ford F-150 Hybrid (57).
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
Common Hybrid and Plug-In Hybrid Problems in Lemon Law Cases
Hybrid problems often show up as a 'check hybrid system' or similar warning, a car that will not shift out of park or will not power on, sudden loss of power, shuddering or clunking when the engine starts or stops, high-voltage battery or inverter faults, cooling system problems for the battery, and 12-volt battery failures that leave the car dead. Plug-in hybrids add charging faults, a charge port that will not lock, and electric range that drops sharply.
Hybrids also have regular car problems. Brakes, driver-assist cameras, fuel system parts and electrical systems can fail like they do on any car. Since a hybrid uses its motor to help slow the car, some brake complaints are tied to the hybrid system itself.
Under the Song-Beverly Act, if a warranty defect substantially impairs use, value or safety and the manufacturer or its dealers cannot fix it after a reasonable number of attempts, the manufacturer must replace or repurchase the vehicle. You can choose a buyback instead of a replacement (Civil Code 1793.2(d)(2)).
Lower fuel economy than the window sticker is not, by itself, a defect, because real results vary with driving and weather. But a sudden drop in mileage or electric range together with warning lights can point to a hybrid system problem worth reporting.
Plug-in hybrid owners should also watch how the car behaves at home. If it charges on one charger but not another, note both, and try a second outlet or public charger if you can. That helps show the fault is in the car and answers a common reply that the home charger is to blame.
Hybrid Warranties, Software Updates and Repair Attempts
Many hybrids carry a separate warranty for hybrid parts that lasts longer than the basic warranty. Check your warranty booklet for both. A defect covered by either one can support a lemon law claim if it was not fixed after a reasonable number of attempts.
Many hybrid repairs are software updates, sometimes paired with a part. Our firm's position is that a software update counts as a repair attempt when it is done to fix the problem you reported. Ask the dealer to tie each update to your complaint on the repair order.
Loss of power at speed, a car that shuts down while driving, or brakes that do not respond as expected can be argued as defects likely to cause death or serious injury. Within 18 months or 18,000 miles, two repair attempts on that kind of defect can raise the presumption that the manufacturer had enough chances. Other routes are four repairs of the same defect or more than 30 days out of service (Civil Code 1793.22(b)). If the owner's manual clearly requires direct notice to the manufacturer, that applies to the safety and four-repair routes. Claims can still succeed after 18 months or 18,000 miles if the defect first showed up under warranty.
Recalls are common on hybrid systems. A recall is a manufacturer safety repair program, while a lemon law claim is about a defect that was not fixed after reasonable attempts. Recall repairs can count as repair attempts, so if a recall fix does not solve the problem, keep that visit in your history.
What to Tell the Service Advisor About Your Hybrid
Hybrid faults can clear themselves once the car restarts, so the technician may find nothing stored. Take a photo of every warning message and describe what the car did.
- The exact warning message and when it appeared.
- What the car did: lost power, would not start, shuddered, would not charge.
- Driving conditions: speed, hills, heat, cold starts, after charging.
- For plug-in hybrids, which charger you used and what the car showed.
- Say 'This is a safety concern' if the car lost power in traffic.
- Ask that any software update and part replaced be listed for your complaint.
What California NHTSA Complaint Data Shows for Hybrids
The figures below are owner complaints to NHTSA from California drivers about 2019 or newer hybrid and plug-in hybrid models, filed from 2021 through 2026. They are not adjusted for sales, so popular models can show more complaints simply because more are on the road.
There were 1,219 complaints in that set. By make, the most were for Toyota (339), Ford (268), Honda (214), Hyundai (145) and Kia (87), followed by Chrysler (62), Jeep (51) and Mazda (19). By model, the top eight were the Ford Maverick Hybrid (127), Honda Accord Hybrid (105), Honda CR-V Hybrid (80), Toyota Sienna Hybrid (70), Toyota RAV4 Prime (65), Chrysler Pacifica Plug-In Hybrid (62), Toyota Camry Hybrid (60) and Ford F-150 Hybrid (57).
By component group, the most common were electrical (214), engine (142), powertrain (129), brakes (105), driver-assist systems (84) and fuel system (77). A complaint is an owner's report, not a finding of a defect. If your model is listed, check the NHTSA recall lookup with your VIN and file your own report.
These counts cover all kinds of complaints about hybrid models, not only problems with the hybrid system itself. A Toyota or Honda hybrid with a brake or camera complaint, for example, is counted here. That is why the component groups are worth reading alongside the model list.
Example: A Hybrid That Loses Power
This example is made up to show the process. It is not a real client or a promised result. Kevin buys a new hybrid crossover in Stockton. At 9,000 miles, a hybrid system warning appears and the car drops into reduced power on Highway 99. He pulls over, restarts, and the warning clears.
The dealer finds a stored code and installs a software update for his complaint. A month later it happens again, and the dealer replaces an inverter part. Kevin takes photos of the warnings each time and keeps every repair order.
He contacts a lemon law attorney, who reviews the purchase contract, both repair orders, the photos and both warranty booklets. Because the car lost power in traffic, the attorney looks at the safety route, handles any required notice to the manufacturer and requests the vehicle's records. Kevin keeps his loan payments current and uses only the authorized dealer.
Notice that Kevin did not ignore the first warning just because it cleared after a restart. By reporting it right away, he started the repair history early, which also keeps the miles before his first repair visit low. The mileage offset is based on those miles (Civil Code 1793.2(d)(2)(C)).
How to Choose an Attorney for a Hybrid Lemon Law Case
Hybrid cases can involve several systems and several warranties at once. A good attorney will sort that out for you and explain plainly which problems drive your claim. Ask these questions during your free case review.
A buyer who wins recovers attorney fees, costs and expenses from the manufacturer (Civil Code 1794(d)). At our firm, you pay $0 out of pocket, and if we lose, you owe nothing.
Also ask how the attorney stays in touch. Hybrid cases can involve long waits for parts and several updates, and you will want to know what to do each time the warning comes back. A clear plan for those moments is a good sign.
- Have you handled hybrid and plug-in hybrid cases with power loss or high-voltage faults?
- Do you count software updates as repair attempts?
- Which of my warranties covers the problem, and does that matter for my claim?
- Is my power loss problem a safety defect under the two-repair rule?
Next Steps for Hybrid and Plug-In Hybrid Owners
If the car loses power or will not start, have it towed to an authorized dealer and keep the receipts. Independent shop and do-it-yourself repairs do not count as repair attempts, and high-voltage parts should only be handled by trained technicians.
Gather your contract, every repair order and photos of warning messages. Warranty claims generally must be filed within four years (Commercial Code 2725), and timing can be technical. Call 877-536-6620 or use the form on this page for a free case review.
Keep making your loan or lease payments during the claim, since missed payments can hurt your credit. Do not install aftermarket chargers, tuners or apps that change how the hybrid system works, because the manufacturer may blame them for the problem.

Hybrid and Plug-In Hybrid Vehicles Lemon Law FAQ
Is a hybrid covered by California lemon law?
Yes. New and leased hybrids and plug-in hybrids sold with the manufacturer's new car warranty are covered like any other new vehicle in California.
My hybrid battery warning keeps coming back. Can that make my car a lemon?
It can if the dealer has not fixed it after a reasonable number of tries and the problem substantially affects use, value or safety. Keep photos of each warning and every repair order.
Does lower fuel economy than the sticker count as a defect?
Not on its own, because real mileage varies with driving and weather. A sudden drop paired with warning lights or power loss may point to a defect worth having reviewed.
How much does a hybrid lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
