All Tesla Models We Cover

Browse every Tesla model in our database below. Each model page shows NHTSA complaint counts, active recalls, and lemon law eligibility information for every year we cover.

Tesla owners deal with a different kind of repair history. Some fixes happen at a service center, some in your driveway, and some arrive overnight as a software update. When phantom braking, a failing screen or a suspension noise keeps returning no matter how many fixes are pushed, it is fair to ask what your rights are.

California law gives you real ones. Under the Song-Beverly Act, if Tesla cannot repair a warranty defect within a reasonable number of attempts, it must repurchase or replace the vehicle. That includes Model 3, Model Y, Model S, Model X and Cybertruck. Our California lemon law attorney team handles Tesla claims across the state. Tesla Warranty Coverage and Lemon Law

Tesla's official US warranty page lists a Basic Vehicle Limited Warranty of 4 years or 50,000 miles, whichever comes first. The Battery and Drive Unit Limited Warranty lasts 8 years, with a mileage cap that depends on the model. Model S, Model X and Cybertruck are listed at 150,000 miles. Model 3 RWD and Model Y RWD and AWD are listed at 100,000 miles, and certain Premium and Performance versions at 120,000 miles. Each requires the battery to keep at least 70 percent of its capacity over that period. Tesla says the warranty delivered with your vehicle controls, so check yours.

For lemon law purposes, the key is when the defect showed up. A problem reported to Tesla while the basic warranty was active can support a claim even if you call us after it ends. Battery and drive unit defects may qualify for much longer.

Used Teslas are trickier. Following Rodriguez v. FCA US in 2024, an ordinary used car without a new-car warranty generally does not qualify. A used Tesla bought from Tesla keeps any remaining original basic warranty, then gets a Used Vehicle Limited Warranty of 1 year or 10,000 miles, and the balance of the battery and drive unit warranty still applies. Our firm takes CPO, demo and dealer vehicles, so it is worth asking.

Common Tesla Problems in Recalls and Complaints

Since the 2021 model year, Tesla has issued 70 recalls and drivers have filed 13,067 complaints, according to NHTSA recall and complaint data. None of those recalls carried a do-not-drive or park-outside warning. What sets Tesla apart is that 29 recalls were fixed by an over-the-air software update, without a trip to service.

The electrical system led recall components with 12 campaigns. On a Tesla that can involve the touchscreen, the 12-volt system, or high-voltage parts, and owners often describe black screens, lost camera views, or warnings to pull over. Air bags (9), seat belts (7) and steering (6) came next. Forward collision avoidance, exterior lighting and back over prevention each had 5. A recent example is the Model 3 and Model Y headlight recall.

Complaints are heavily concentrated. Forward collision avoidance drew 4,551 complaints, far more than any other area. These reports usually describe what drivers call phantom braking: the car slows hard or brakes for a shadow, an overpass or nothing at all. Vehicle speed control followed with 1,020 complaints, often about unexpected acceleration or slowing. Service brakes and the electrical system had 973 each, steering 871, and lane departure 684. Suspension drew 405.

Many of these systems are controlled by software. That matters because a software update that does not fix the problem is still a repair attempt.

An over-the-air fix is convenient, but it can also leave a thin paper trail. When a recall or a complaint is handled by an update, there may be no service visit at all. That is why your own notes on dates, versions and symptoms carry extra weight on a Tesla claim. These numbers describe reported trends, not proof that any one car is defective.

How a Tesla Lemon Law Claim Works

Tesla repairs happen at company-owned service centers or through mobile service that comes to you. You schedule both in the Tesla app, and that is where your paper trail lives. Download every invoice, estimate and service note from the app's service history. If a technician closes a visit with "no fault found," save that record too.

Over-the-air updates do not always come with a repair order. Write down the date, the software version and whether the problem came back. Screen recordings and dashcam clips are useful evidence when the symptom is intermittent.

In our experience, the same software update gets pushed 5 or 6 times without fixing the problem. We treat each one as a repair attempt. Under Civil Code 1793.22, you are presumed to have a lemon if, within 18 months or 18,000 miles, the same problem was repaired 4 or more times, a defect likely to cause death or serious injury was repaired 2 or more times, or the car was out of service more than 30 days total. The presumption is one route, not the only one.

Many recall-related cases resolve in about 1 to 3 months from the first call, though litigation takes longer. Prior results do not guarantee a similar outcome.

A good Tesla record usually includes:

  • Your purchase or lease agreement and delivery date.
  • Every service invoice and mobile service note from the app.
  • Screenshots of the service request you typed, since that is your complaint in your own words.
  • A simple log of over-the-air updates and whether the problem returned.
  • Dashcam or phone video of the symptom, with the date and mileage.

When you write a service request, describe the symptom, not your guess at the cause. "Car braked hard at 65 mph with no vehicle ahead, twice this week" is more useful than "Autopilot bug." Ask that the request stay open until the problem is actually fixed.

Days matter too. If your Tesla sits at a service center waiting for parts, or you cannot drive it while you wait for a fix, those days count toward the 30-day out-of-service presumption. Keep track of when you dropped the car off and when you got it back.

If the claim succeeds, a repurchase refunds your down payment and payments, pays off the loan, and covers incidental costs, minus a mileage offset. Our California lemon law calculator can give you a rough idea. Willful violations can add a civil penalty of up to two times your actual damages, and the manufacturer pays attorney fees under Civil Code 1794(d).

Popular Tesla Models We Handle

Model Y

The Model Y compact SUV is the most recalled Tesla, with 41 recalls since the 2021 model year. It also has the most complaints, at 7,210.

Model 3

Tesla's midsize sedan has 31 recalls and 4,108 complaints.

Model X

The Model X is Tesla's larger SUV with falcon wing rear doors. It also has 31 recalls and 631 complaints.

Model S

The full-size Model S sedan has 28 recalls and 752 complaints.

Cybertruck

Tesla's stainless steel electric pickup has 11 recalls and 323 complaints in a shorter time on sale. Not sure if your car has an open campaign? Check your VIN for recalls.

Across every Tesla model, the same pattern tends to come up in our cases: a driver assist, screen or suspension issue that seems fixed after an update or visit, then returns weeks later. If that sounds familiar, the history you have already built in the Tesla app may be most of what we need to evaluate your claim. Leased Teslas are covered too, and a lessee can seek a refund of payments made and release from the lease.

California Lemon Law for Tesla Owners

The Song-Beverly Consumer Warranty Act protects Tesla owners and lessees in California. If Tesla or its authorized repair facilities cannot fix a warranty defect after a reasonable number of attempts, the manufacturer must repurchase or replace the vehicle (Civil Code 1793.2(d)).

A vehicle is presumed to be a lemon if, within 18 months or 18,000 miles of delivery, the same problem was repaired 4 or more times, a defect that could cause death or serious injury was repaired 2 or more times, or the vehicle was out of service for repairs for more than 30 days in total (Civil Code 1793.22). Many vehicles outside that window still qualify while they are under warranty. New, leased, certified pre-owned, demo and dealer vehicles can qualify; ordinary used cars without a new-car warranty generally no longer do after Rodriguez v. FCA US (2024).

What you can recover

  • Buyback: your down payment, payments, taxes and fees, minus a mileage offset, with the loan or lease paid off.
  • Replacement with a comparable new vehicle.
  • Cash and keep: a cash settlement while you keep the vehicle.
  • Civil penalty of up to two times your damages if the manufacturer willfully failed to comply (Civil Code 1794(c)).

What it costs

You pay nothing, win or lose. We are paid only if you win, and the manufacturer pays our fees, including in settlements. If a case is lost, our firm covers the costs.

Tesla Lemon Law FAQ

Do Tesla over-the-air updates count as repair attempts?

In our experience, yes. An update meant to fix a reported problem can count as a repair attempt, especially when the same problem keeps coming back.

Can phantom braking make my Tesla a lemon?

It can, if it is a warranty defect that Tesla has not fixed after a reasonable number of attempts. Because it can affect safety, 2 failed repair attempts may be enough for the presumption.

Where do I find my Tesla repair records?

Open the Tesla app and go to your service history. Download every invoice and service note, including visits marked no fault found.

How much will it cost me to bring a Tesla lemon law claim?

You pay nothing, win or lose. We are paid only if you win, and the manufacturer pays our fees, including in settlements. If a case is lost, our firm covers the costs.

Does California lemon law cover a used Tesla?

It depends. A used Tesla that still has Tesla's new-car or used vehicle warranty may qualify, while an ordinary used car without a manufacturer warranty generally does not after Rodriguez v. FCA US.

Is my Cybertruck covered by lemon law?

Yes, if it was bought or leased in California with Tesla's warranty and has a defect that Tesla could not repair after reasonable attempts.

Tesla Lemon Law — Your Rights

If your Tesla vehicle has a persistent defect that Tesla’s authorized dealers cannot repair after a reasonable number of attempts, California’s Song-Beverly Consumer Warranty Act may entitle you to a full refund or replacement. This applies to new and certified pre-owned vehicles still within the manufacturer’s original warranty period.

Under the lemon law presumption, you typically need four or more repair attempts for the same problem, two attempts for a safety defect, or 30 cumulative days in the shop. Tesla pays your attorney fees if your claim succeeds — you pay nothing out of pocket.

Did You Know?

The manufacturer — not you — is required to pay your attorney fees under Cal. Civ. Code § 1794(d) if your lemon law claim is successful. You pay nothing upfront and nothing out of pocket.
