The Kia Soul is a small, boxy hatchback that many California drivers pick for city commuting. In complaints that California owners filed with NHTSA, the engine came up far more than anything else, in half of all reports. If your Soul keeps going back to a Kia dealer for an engine problem or anything else that will not stay fixed, an attorney can tell you whether your repair history may support a lemon law claim.

Short answer: the best lemon law attorney for a Soul case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Kia Soul: Complaints from California Drivers

Since January 2021, California drivers filed 64 safety complaints with NHTSA about 2019 or newer Kia Soul vehicles.

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.

What Kia Soul Owners in California Have Told NHTSA

We counted 64 complaints filed with NHTSA by California owners of 2019 or newer Souls, filed from 2021 through 2026. Each was counted once. These are owner complaints, not confirmed defects, and they are not adjusted for how many Souls were sold. It is a small set, so a few reports can change the picture.

Engine complaints dominated, with 32 of the 64. The next categories were much smaller: transmission or powertrain (9), electrical (6), brakes (4), airbags (3) and lights or visibility (2). A single report can mention more than one area.

By model year, 2021 had the most reports (23), followed by 2020 (15), 2023 (10), and 2019 and 2022 (7 each), with 2 for 2024. The city list is unusual. Redding led with 7 reports, ahead of San Diego and Los Angeles (5 each) and San Ramon, Chula Vista and West Sacramento (3 each). With counts this small, a cluster in one city may reflect just a few owners, so do not read too much into it.

Because engine reports make up half of the total, an engine concern on a Soul is the issue most worth documenting carefully, starting with the first warning light.

Engine Trouble and the Safety Question

An engine that stalls, loses power on the freeway, or goes into a reduced power mode with no warning can leave a small car stranded in traffic. A problem like that may be a defect likely to cause death or serious injury. For those defects, Civil Code 1793.22(b) sets a presumption after two repair attempts within the first 18 months or 18,000 miles.

Not every engine complaint is a safety issue. Burning oil between changes, a ticking noise, or a check engine light with no change in how the car drives may be serious defects that hurt the car's value and use, but they usually fall under the other parts of the presumption: four repairs for the same problem, or more than 30 days out of service in total.

Kia has issued recalls on the Soul, including 21V259, and recall repairs can count as repair attempts. If your engine problem appeared during the warranty, you may still have a claim even after 18 months or 18,000 miles. The question is whether Kia had a reasonable number of chances to fix it.

The 9 transmission or powertrain complaints are a reminder that a loss of power can come from more than the engine itself.

What to Say at the Kia Service Desk

Engine problems are often described too vaguely on repair orders. Tell the service advisor exactly what happened: the car stalled at a light, lost power on an on-ramp, made a knocking sound when warm, or needed oil added between services. Give the mileage when it started. If a warning light came on, show a dated photo of it.

If the dealer asks you to come back for an oil consumption test, keep every record of that test, including the start and end mileage. Each visit for the same problem should be written up, even if the dealer only checks fluid levels. A software update done to fix your engine complaint can count as a repair attempt. An oil change or repair at an independent shop does not count against Kia, though you should still keep those receipts to show the car was maintained.

Before leaving, confirm that the order lists your complaint in your words, the dates in and out and any work done. If it does not, ask for a corrected copy.

If the dealer replaces your engine, keep going back if problems return. A replacement is itself a repair attempt, and any visits after it matter too.

  • How much oil you added and when
  • Noises, smells or smoke, and when they happen
  • Warning lights and any reduced power messages
  • Whether the car stalled or would not restart
  • Your maintenance receipts, kept in one place

Kia America's Role in a Soul Claim

Kia dealers handle the repairs, but the warranty is backed by Kia America, Inc., the brand's U.S. company. Your lemon law claim is against the manufacturer. The dealer cannot agree to buy back your Soul on its own, even if the service staff are sympathetic.

Kia may offer an extended warranty, a goodwill repair or a trade-in deal along the way. Do not sign anything that releases your rights until an attorney has looked at it. If your owner's manual clearly requires you to notify the manufacturer directly, send a written notice and keep a copy.

A long engine repair can take weeks. Civil Code 1793.2(b) gives the manufacturer 30 days to finish warranty repairs unless you agree to a longer time. Write down the date the dealer took your Soul and the date it was ready, and keep any rental receipts.

If your Soul spends weeks at the dealer waiting for an engine or another major part, ask for a rental or loaner and keep the paperwork. Those days can add up to the 30-day part of the presumption.

Made-Up Example: A Soul That Stalls at Low Speed

This example is invented. It is not a real client and does not show any result. Luis bought a new Soul for his commute. A few months later, it stalled twice while he was slowing for a light, and the check engine light came on. The dealer read a code, cleared it and sent him home.

The stalling returned. On the second visit, the dealer updated the engine software and kept the car for four days. A third stall happened in a parking lot. Luis wrote down each date and mileage, took a photo of the warning light, collected both repair orders and his contract, and asked a lemon law attorney for a free review. The attorney explained that stalling in traffic may be a safety defect, checked that both repairs were within 18 months and 18,000 miles, and described the notice that would go to Kia America.

Luis also kept his oil change receipts with his repair orders, so Kia could not easily blame missed maintenance for the stalling.

Questions to Ask a Lemon Law Attorney About Your Soul

Ask the attorney how often they handle engine cases against Kia and how they treat oil consumption claims. Ask whether your stalling or power loss counts as a safety defect. Ask what records you should collect now, including maintenance receipts.

Ask how fees work. When a buyer wins, Civil Code 1794(d) makes the manufacturer pay attorney fees, costs and expenses. At our firm you pay $0 out of pocket, and if we lose, you owe nothing. Ask how a buyback would be calculated under Civil Code 1793.2(d)(2), and how pre-lawsuit notice and mediation steps under Code of Civil Procedure 871.20 work for many claims against manufacturers that opted in.

Also ask whether the attorney will look at your oil change receipts before the manufacturer does. If there is a gap in your maintenance, it is better to know early and explain it.

  • Does my engine problem need two or four repair attempts?
  • Should I accept Kia's extended warranty offer?
  • Do my oil consumption test visits count?
  • What happens if the dealer replaces the engine?

Next Steps for Kia Soul Owners

Put your contract, every repair order, your maintenance receipts and any towing or rental receipts in one folder. Keep a short log of each engine event with the date and mileage. Keep making your loan or lease payments while your claim is open.

If you live far from a Kia dealer, warranty work still has to go to an authorized one. Keep towing receipts, because reasonable towing costs can be included in a buyback. A photo of each oil change sticker is worth keeping too.

Use NHTSA's recall lookup to check your VIN for open recalls, and report a safety problem to NHTSA if your Soul stalls or loses power. Warranty claims generally must be filed within four years under Commercial Code 2725. A free case review is one call away at 877-536-6620, or you can use the form on this page.

Kia Soul Lemon Law FAQ

Can a Kia Soul with engine problems qualify under California lemon law?

A Soul with repeat repairs for an engine problem that the dealer cannot fix may qualify. If the problem causes stalling or loss of power, it may be a safety issue that needs only two repair attempts within 18 months or 18,000 miles.

Do I need maintenance records for a Soul engine claim?

Yes, keep them. Manufacturers often ask for proof of oil changes, so receipts help show the problem was not caused by poor maintenance.

Should I accept an extended warranty from Kia instead of a buyback?

Talk to an attorney first. An extended warranty may not fix the problem, and some offers ask you to give up your lemon law rights.

How much does a Soul lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
