The Kia K5 has a modest number of California NHTSA complaints, but fuel system and electrical issues show up most often. Most of the reports involve the first model year in the data. If your K5 keeps going back to the Kia dealer for the same problem, a lemon law attorney can review your repair orders and tell you whether the number of visits, the type of defect or the days out of service support a claim.

Short answer: the best lemon law attorney for a K5 case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Kia K5: Complaints from California Drivers

Since January 2021, California drivers filed 51 safety complaints with NHTSA about 2019 or newer Kia K5 vehicles.

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.

What K5 Owners in California Report

California drivers filed 51 complaints with NHTSA about the Kia K5 in our count. Those K5 reports involve 2019 or newer models, were filed from 2021 through 2026, and are counted one time each. They are owner reports, not verified defects, and are not adjusted for sales. Fifty-one is a small number, so a few reports either way would change the ranking.

Fuel system and propulsion issues were mentioned most (11). Electrical problems followed (9), then transmission or powertrain (6), engine (5), and body or structure and airbags (4 each). Because one complaint can name more than one area, these totals overlap. The 2021 model year accounted for about half of the complaints (26), followed by 2022 (11) and 2023 (8). Later years had very few: 2025 (3), 2024 (2) and 2026 (1). Los Angeles had 4 complaints, and Rialto, Riverside, San Diego, Sacramento and San Bernardino had 2 each.

The pattern by year may reflect how long earlier cars have been on the road, not that they are worse. Your own repair orders are what matter.

We have pages for K5 recalls 21V447, 23V149, 25V351, 25V493 and 25V794. Check your VIN to see which, if any, apply to your car.

K5 Safety Defects and the Presumption

The Tanner Act presumption in Civil Code 1793.22(b) works two ways. For a defect likely to cause death or serious injury, two repair attempts within 18 months or 18,000 miles can be enough. For other defects, it takes four attempts for the same problem or more than 30 days in the shop.

On a K5, a fuel system problem that causes stalling, a fuel smell in the cabin or a sudden loss of power would often be argued as a safety issue. An airbag warning that keeps returning may be one too. Electrical faults depend on the effect: a dead battery in your driveway is a reliability problem, while lights or controls failing on the road raise safety concerns. Body and structure complaints are usually judged by whether they affect safety or only appearance.

Meeting the presumption is not required. A claim can succeed outside 18 months or 18,000 miles if the defect first showed up while the car was under warranty.

If your owner's manual clearly says you must notify Kia directly about a problem, do it in writing and keep a copy. For the two-repair and four-repair parts of the presumption, that direct notice can matter. Your attorney can help you send it the right way.

How to Report K5 Problems at the Kia Dealer

Start with the symptom, not your guess about the cause. Say "the car stalled at a light and would not restart for a minute" rather than "fuel pump problem." Include the date, the mileage, the fuel level and whether a warning light came on. If you smelled fuel, say where and when.

Have the Kia advisor put your own description on the repair order. Before you leave, make sure it lists your complaint, the mileage, the dates and what was done, even if the result was no problem found. Keep every copy. On a K5, an update performed for your reported problem can count as a repair attempt. Repairs at an independent shop and fixes you do yourself do not count toward Kia's attempts.

If the dealer keeps your K5 overnight or longer, ask for a loaner or rental and keep the paperwork. Reasonable rental and towing costs can be part of what is refunded in a buyback. Each day the car sits at the dealer for warranty repairs also counts toward the 30-day rule.

  • Your description of the symptom in plain words
  • Fuel level, warning lights and any smell
  • Dates in and out and mileage
  • Parts, updates and recall work performed

Kia America and the Dealer's Role

Kia dealers handle repairs, but the warranty on a new K5 comes from Kia America, Inc. The lemon law claim names Kia America as the manufacturer. The dealer's job is to repair the car, and its repair orders are your record of each attempt.

Under Civil Code 1793.2(d)(2), if Kia cannot fix a warranty defect that substantially impairs use, value or safety after a reasonable number of attempts, it must replace or repurchase the car, and you can choose a repurchase. Restitution is the price paid or payable, including collateral charges like sales tax, license and registration, plus incidental damages, minus a mileage offset. The offset is based on miles driven before you first brought the car in for the problem.

Repairs must be finished within 30 days unless you agree otherwise, under Civil Code 1793.2(b). Keep making your car payments while a claim is pending, since missed payments can hurt your credit or lead to repossession.

If you bought your K5 used, the rules are different. After Rodriguez v. FCA US LLC (2024), a used car sold with only leftover factory warranty generally does not count as a new motor vehicle under the lemon law's vehicle section. Used and certified pre-owned buyers may still have other warranty claims, so a review is still worth it.

You also do not need to still have the car. California courts have held that a buyer does not have to still own or possess the vehicle to pursue lemon law remedies, though you should talk to an attorney before selling.

A Made-Up K5 Example

This is an invented example to show how a case moves. It is not a real client or a real outcome. Jordan bought a new K5 for commuting. A few months in, the car stalled twice at stoplights. The first time, the dealer found a stored code and performed a software update.

The second time, the dealer replaced a part. A third stall happened on a freeway on-ramp. Jordan had been writing down each event with the date, mileage and fuel level. He brought those notes, his contract and both repair orders to a free case review.

The attorney reviewed whether stalling was a safety defect repaired twice within the presumption window, counted the days the car was out of service and explained the pre-lawsuit notice steps that apply for manufacturers that opted in. Jordan kept driving the K5 when it was safe and kept up his payments.

What made Jordan's file strong was consistency. Each repair order described the same symptom in similar words, and his notes filled in the details the dealer did not write down.

Questions to Ask a K5 Lemon Law Attorney

Ask how the attorney handles cases where the dealer could not reproduce the problem. Ask whether your fuel or electrical issue is likely to be treated as a safety defect. Ask what records they need from you and how long the pre-lawsuit process usually takes.

Ask what a K5 case will cost you. Under Civil Code 1794(d), a K5 buyer who wins has the attorney fees, costs and expenses paid by Kia. K5 owners pay our firm $0 out of pocket, and if we lose, they owe nothing. Ask too whether the attorney will review any settlement offer with you line by line before you decide.

You might also ask whether the attorney handles only the consumer side of lemon law cases. Someone who spends all of their time pushing manufacturers will know what Kia tends to ask for and how to respond.

  • Is stalling on my K5 a safety defect?
  • What if the dealer says no problem found?
  • Do I need to keep the car during the case?
  • What will a lost K5 case cost me?

K5 Owners: Next Steps

Gather your contract and every repair order. Keep a simple log of each event. Look up your VIN on NHTSA's recall site and save the result. If the problem keeps returning, call 877-536-6620 for a free review before you sell or trade in the K5.

Do not wait for the problem to become constant before calling. Early reports help with the mileage offset, and an attorney can tell you what to document next.

  • Your log of stalls or warnings
  • Photos of dashboard messages
  • Rental and towing receipts

Kia K5 Lemon Law FAQ

My K5 stalls. Could it qualify under California lemon law?

A K5 with repeat repairs for stalling may qualify if the defect is covered by Kia's warranty and was not fixed after a reasonable number of attempts. Stalling is often argued as a safety issue.

Only 51 California complaints were filed about the K5. Does that hurt my case?

No. Those K5 totals are only background. Your case depends on your own car's defect and repair history.

Who handles a K5 lemon law claim, the dealer or Kia?

The claim is against Kia America, which issued the warranty. The Kia dealer's repair orders are the proof of each attempt.

How much does a K5 lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
