The 2021 model year had the most reports (14), followed by 2022 (10), 2023 (8) and 2024 (7). The 2019, 2020 and 2025 model years had 3 or fewer each. San Diego had 4 complaints, and Carmichael, Palmdale, Huntington Beach, Los Angeles and Yorba Linda had 2 each. Counts this small cannot show a regional pattern.

Even with a small total, the shape of the data is clear: the most common XC40 complaint involves driver-assist behavior. That does not prove anything about your car, but it is a reason to document such problems carefully from the first time they happen.

Are XC40 Driver-Assist Problems Safety Defects?

Civil Code 1793.22(b) creates a presumption within 18 months or 18,000 miles after two repairs of a defect likely to cause death or serious injury, four repairs of the same defect, or more than 30 days out of service in total. A driver-assist system that brakes hard with nothing ahead, steers unexpectedly, or fails to warn may be argued as a safety defect that needs only two repairs. Brake problems and speed control issues, like unexpected acceleration or a cruise system that will not disengage, can fit the same category.

Body, trim and many electrical issues are usually treated as non-safety defects, which means four repairs or more than 30 days in the shop. The presumption is one route, not the only one. An XC40 defect that first showed up under warranty can still support a claim after 18 months or 18,000 miles.

Documenting an XC40 Problem With the Volvo Retailer

Driver-assist faults are often tied to specific conditions. Tell the service advisor the speed, road, weather, light and traffic when the problem happened, and what the screen said. If a passenger can safely record video in the XC40, bring it. Write the details down the same day so you do not have to rely on memory.

Ask that your words go on the repair order, and read it before you leave. A software update or sensor calibration done to fix your complaint can count as a repair attempt, so make sure it is listed. Keep XC40 orders that say no fault was found, because those visits can still count. Repairs at an independent shop or work you do yourself do not count toward Volvo's attempts.
