A Tesla Model X that keeps going back to the service center for the same steering, suspension or driver-assist problem can be draining, especially when the fix is a software push you never see happen. California lemon law treats a Model X like any other new vehicle sold with a factory warranty. What decides most cases is how well the problem was reported, how many times Tesla tried to fix it, and whether the records prove it.

Short answer: the best lemon law attorney for a Model X case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Tesla Model X: Complaints from California Drivers

Since January 2021, California drivers filed 193 safety complaints with NHTSA about 2019 or newer Tesla Model X vehicles.

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.

What California Model X Owners Report to NHTSA

We looked at owner complaints filed with the National Highway Traffic Safety Administration (NHTSA) by California drivers of 2019 or newer Tesla Model X vehicles, filed from 2021 through 2026. No complaint is counted twice. There were 193 in total. These are reports written by owners, not findings that any Model X is defective, and the numbers are not adjusted for how many were sold or are on the road.

Steering was the component named most often (36 complaints), followed by suspension (22), the electrical system (18), driver-assist and collision warning systems (15), body and structure (12), and lights, cameras and visibility (8). One complaint can name more than one component, so these figures overlap and do not add up to the total.

By model year, the 2023 Model X had the most complaints (57), then 2022 (44), 2020 (30) and 2019 (25). Later years had far fewer, which partly reflects that newer cars have had less time on the road. The cities with the most complaints were San Jose (10), Irvine (6), San Francisco (6), Fremont (5), Los Angeles (5) and San Diego (5). City counts this small should be read as a rough picture of where owners live, not a trend.

Which Model X Problems May Count as Safety Defects

California's Tanner Act presumption in Civil Code 1793.22(b) says that within the first 18 months or 18,000 miles, a reasonable number of repair attempts is presumed if a defect likely to cause death or serious injury was repaired two or more times, the same defect was repaired four or more times, or the vehicle was out of service more than 30 total days. If the owner's manual clearly requires you to notify the manufacturer directly, do that as well.

Steering and suspension problems, the two biggest categories for this model, are the kind of faults that can affect control of the vehicle. A driver-assist system that brakes hard for no reason, or a collision warning that fails, may also be argued as a safety issue. Whether a specific fault qualifies depends on what it actually does on the road, so describe the effect, not just the warning.

Body and structure complaints, trim, rattles and many screen glitches are usually treated as non-safety problems. Those cases tend to rely on four attempts or more than 30 days in the shop. The presumption is only one path, and a claim can still succeed after 18 months or 18,000 miles if the defect first appeared while the warranty was in effect.

How to Document a Model X Problem With Tesla Service

Most Model X owners start a repair through the Tesla app. Whatever you type into that request often becomes the complaint on the invoice, so write it carefully. Say what happened, at what speed, how often, and whether it happened again after the last visit. Attach photos or short videos of warning messages if the app allows it.

After each visit, download or screenshot the invoice and keep it with the date and mileage. If a technician performs a software update to address what you reported, that can count as a repair attempt, so note the update and save the release notes you see on the screen. Over-the-air updates that arrive without a visit are harder to tie to your complaint, so write down the date and what changed. Repairs by an independent shop or work you do yourself do not count toward Tesla's repair attempts.

  • Your description of the symptom, in your words, on every request
  • Date in, date out and odometer reading for each visit
  • Any parts replaced or adjustments made to steering or suspension
  • Software versions installed and the date of each update
  • Any note that the technician could not reproduce the problem

Who You Deal With: Tesla, Inc.

Tesla sells and services its vehicles directly, so there is no separate dealer standing between you and the manufacturer. Your claim is against Tesla, Inc., and the service centers and mobile technicians who worked on your Model X are Tesla's own. That can make the paper trail simpler, because one company holds the records, but it also means most of your evidence lives inside the app and your email.

Under Civil Code 1793.2(d)(2), if Tesla cannot fix a warranty defect that substantially impairs the use, value or safety of the vehicle after a reasonable number of attempts, it must replace or repurchase it, and you can choose a refund instead of a replacement. Before you ask for anything, export your service history so you are not depending on access you might lose later.

A refund in a buyback is built from what you paid or still owe, including sales tax, license and registration fees, plus incidental costs like towing or rentals, minus a mileage offset. The offset is based on the miles on the Model X before you first brought it in for the problem, under Civil Code 1793.2(d)(2)(C). That is one more reason to report problems as soon as they start.

If a recall has been issued for your vehicle, recall repairs can count as repair attempts for the same problem. Our site has pages for Model X recalls including 21V868, 22V233, 22V264, 22V843, 23V244 and 23V679. Check your own VIN on NHTSA's recall lookup to see which apply to your car.

Made-Up Example: A Model X Steering Complaint

What follows is a made-up Model X example that shows the process. It does not describe a real Model X owner or a real result. Daniel leased a new Model X and noticed a clunk and a pull in the steering at highway speed. He opened a service request in the app, and the mobile technician found nothing wrong.

Daniel began writing down the speed and road each time it happened and recorded a short video from the passenger seat with his partner's help. On the second visit, the service center made an adjustment and installed a software update. The pull came back within a month. On the third request he attached his notes, and the invoice listed the complaint in his words. He then saved every invoice, his lease contract and his notes, and asked a lemon law attorney for a free review. The attorney counted the visits, looked at whether the steering fault could be argued as a safety defect, and handled the required written steps with Tesla.

Questions to Ask a Lawyer About a Model X Case

Choose someone who has handled Tesla claims and can work from app records rather than paper repair orders. Ask how they treat over-the-air updates, what they do when the service center writes that the vehicle is operating as designed, and whether they will tell you what is missing from your file before anything is sent to Tesla.

Ask about the cost of a Model X case in plain terms. A Model X buyer who wins recovers attorney fees, costs and expenses from the manufacturer under Civil Code 1794(d). On a Model X case with our firm, you pay $0 out of pocket, and if we lose, you owe nothing.

  • How many Tesla cases have you handled, and how do you build the timeline?
  • Do my steering or suspension visits fit the two-repair safety rule?
  • How do you count software updates that were done to fix my complaint?
  • What happens if I am offered a settlement I am unsure about?

Next Steps for a Model X Owner

Keep driving the car if it is safe to do so, keep making your lease or loan payments, and do not trade in the Model X before you get advice. Gather your purchase or lease contract, every service invoice and your update notes, then ask for a free case review. For many claims, manufacturers that opted in follow pre-lawsuit notice and mediation steps under Code of Civil Procedure 871.20, and an attorney can handle those for you. Warranty claims generally must be filed within four years under Commercial Code 2725, so it is better to ask early.

If you bought your Model X used, the rules are different. After Rodriguez v. FCA US LLC (2024), a used vehicle sold with only the rest of the original factory warranty generally is not a new motor vehicle under the lemon law, but used buyers may still have other warranty or fraud claims worth reviewing. And if you already sold or returned the car, you may still have a claim, because California courts have held that you do not need to still own the vehicle.

Tesla Model X Lemon Law FAQ

Is a Tesla Model X covered by California lemon law?

Yes. A Model X bought or leased new in California with Tesla's factory warranty is covered by the Song-Beverly Act. Buying directly from Tesla instead of a dealer does not change that.

Do over-the-air updates count as repair attempts on a Model X?

An update that was done to fix the problem you reported can count. Save the date, the version and the release notes, and connect them to your service request when you can.

My Model X steering problem only happens sometimes. Can I still bring a Model X claim?

Possibly. You do not have to prove the exact cause, and visits where Tesla could not find the problem can still count. Notes and videos showing when it happens make those visits stronger.

How much does a Model X lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
