The Tesla Model S is a large electric sedan that Tesla sells and services itself, with no franchised dealer in the middle. California owners who report problems to NHTSA most often mention steering and driver-assist behavior. If your Model S keeps returning to a Tesla service center for the same issue, the right attorney will know how to turn app invoices and over-the-air update notes into a clear repair history.

Short answer: the best lemon law attorney for a Model S case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.

What California Model S Owners Report to NHTSA

We reviewed 155 complaints that California owners filed with the National Highway Traffic Safety Administration (NHTSA) about 2019 or newer Model S sedans, filed from 2021 through 2026. Each complaint is counted once. These are owner reports, not verified defects, and the totals are not adjusted for how many cars Tesla sold, so they cannot tell you how the Model S compares with any other car.

Steering was the most common category in these reports (26 complaints), followed closely by driver-assist and collision warning issues (23). Electrical problems came next (15), then suspension (11), lights, cameras and visibility (9) and airbags (5). A single complaint can fall into more than one category.

By model year, 2021 through 2024 cars produced most of the reports (31, 36, 35 and 29), with 15 for 2020, 7 for 2019 and 2 for 2025. San Francisco owners filed the most (26), followed by Los Angeles (9), San Diego (5) and Irvine (4). These are small numbers. They show what some owners chose to report, not how often a problem happens, and your own repair history matters far more than any chart.

Which Model S Problems May Be Safety Defects

California lemon law has a shortcut for serious safety problems. Under the Tanner Act presumption in Civil Code 1793.22(b), if a defect likely to cause death or serious injury was repaired two or more times within 18 months or 18,000 miles, the manufacturer is presumed to have had a reasonable number of attempts. Steering that pulls, binds or feels disconnected, and driver-assist features that brake or swerve for no reason, may fit that description. An airbag warning that keeps coming back may too.

Other complaints usually follow the regular rules. A suspension clunk, a glitchy screen or a camera that drops out now and then may not be a safety defect, so the presumption would come from four repairs of the same problem or more than 30 total days out of service. Some issues sit in between. A camera failure is a nuisance on one drive and a real hazard on another, depending on what it disables.

The presumption is only one way to prove a case. A claim can still succeed outside 18 months or 18,000 miles if the defect first appeared while the car was under warranty. Tesla has issued recalls on this model, including 22V037, and recall repairs can count as repair attempts.

Getting Your Complaint Into Tesla Service Records

Most Model S visits are booked through the Tesla app, and the written record that comes back is often short. When you schedule, describe the symptom in plain words: what happened, your speed, the type of road, whether Autopilot or another assist feature was on, and how often it repeats. Attach photos or video when the app allows it. If a technician messages you through the app, save those messages too.

After the visit, open the invoice or service summary and check that it lists your complaint, the dates and the mileage. A software update done to fix the problem you reported can count as a repair attempt, so make sure the record says why the update was performed. Repairs at an independent shop, or fixes you make yourself, do not count toward the manufacturer's attempts.

  • Your complaint in your own words, not a one-line code
  • Date in, date out and odometer reading
  • Any software version or update installed during the visit
  • Parts replaced, or a note that the issue could not be duplicated
  • Mobile service visits, which belong in your repair history as well

Who You Deal With on a Model S Claim

With most brands, a franchised dealer does the repairs and a separate U.S. company stands behind the warranty. Tesla works differently. Tesla, Inc. sells the car, issues the warranty and runs its own service centers, so the same company handles both your repairs and any lemon law claim. That can make records easier to find, because nearly everything sits in your Tesla account.

It also means you have to keep those records yourself. Download or screenshot every invoice, estimate and appointment summary. Save the release notes that appear after over-the-air updates, especially any that mention the problem you reported. If a feature is limited or switched off after an update, write down the date. These items help show the defect, each attempt to fix it and how long the car was unavailable.

Repairs must be completed within 30 days unless you agree otherwise under Civil Code 1793.2(b). Track how many days your Model S sits at the service center, including time spent waiting for parts.

Some owners also use Tesla's mobile service, where a technician comes to your home or office. Those visits should produce an invoice in the app as well. If one does not, write down the date, what the technician did and what you were told, and ask Tesla to add the record.

Made-Up Example: A Model S With a Steering Complaint

This example is made up to show the process. It is not a real client and does not describe a real result. Daniel bought a new Model S and, a few months later, felt the steering tug toward the shoulder on the freeway. He booked a visit through the app and attached a short video. The technician performed an alignment and wrote that the issue could not be duplicated.

The tug returned, so Daniel booked a second visit, and this time the record showed a software update. When it happened a third time, with a steering alert on the screen, Daniel saved the alert, the update notes and all three invoices. He then asked a lemon law attorney for a free review. The attorney checked whether the steering problem was likely a safety defect, counted the days out of service, and explained the written notice Tesla would receive before any lawsuit.

Questions to Ask an Attorney About a Model S Case

Ask how the attorney uses app records and update history, since a Model S file looks different from a dealer-based case. Ask whether the firm represents only consumers and whether it reviews your records before you sign anything. Ask how it counts repair attempts when Tesla says a car is working as designed.

Cost should be simple to understand. When a buyer wins, the manufacturer pays attorney fees, costs and expenses under Civil Code 1794(d). With our firm you pay $0 out of pocket, and if we lose, you owe nothing. For many claims there are also pre-lawsuit notice and mediation steps under Code of Civil Procedure 871.20 for manufacturers that opted in, so ask how those steps would apply to you.

  • Have you handled steering or driver-assist claims on electric cars?
  • Which of my service records are missing something important?
  • Do my over-the-air updates count as repair attempts?
  • How would a buyback be figured, including the mileage offset?

Next Steps for Model S Owners

Gather your purchase or lease contract, every service invoice from the app and any roadside assistance records. Write a short timeline of each problem with dates and mileage. Keep making your loan or lease payments while a claim is pending, because missed payments can hurt your credit and lead to repossession.

Do not wait too long. Warranty claims generally must be filed within four years under Commercial Code 2725, and the timing rules are technical. If you bought your Model S used, the rules changed after the 2024 Rodriguez decision, but other claims may still be available, so ask for a review anyway.

If your Model S has been to a Tesla service center several times, ask Tesla for a full service history before you call an attorney. Seeing every visit on one list makes it easier to spot a repeat complaint, such as the same steering or camera issue written up in slightly different words each time.

You can look up open recalls on NHTSA's recall site and report a new safety problem there too. Then call 877-536-6620 or use the form on this page for a free case review.

What to Look For in a Model S Lemon Law Attorney

  1. Has handled claims against Tesla and knows how to read app-based service invoices, mobile service records and over-the-air update notes as repair evidence.
  2. Can explain when a steering pull or a driver-assist event may count as a safety defect needing only two repair attempts.
  3. Asks for your update history and screenshots of warnings, not just the paper invoices, before judging your case.
  4. Costs you nothing. The manufacturer pays your fees when you win (Civil Code section 1794(d)). No retainer, no hourly bills.

Tesla Model S Lemon Law FAQ

Is a Model S covered by California lemon law even though Tesla has no dealers?

Yes. A Model S bought or leased new in California is covered by the Song-Beverly Act like any other new car. Tesla is both the seller and the warranty company, so the claim is made against Tesla.

Does an over-the-air update count as a repair attempt on a Model S?

It can, if the update was meant to fix the problem you reported. Save the release notes and your service request so the link between the two is clear.

My Model S steering pulls but Tesla says it is normal. What should I do?

Keep reporting it, save videos and alerts, and make sure each visit is written up. A steering problem may count as a safety defect, so a free review is worth getting.

How much does a Model S lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
