Engine complaints make up the biggest share of what California CX-5 owners report to NHTSA, followed by electrical issues. Most of the reports involve the 2019 model year. If your Mazda keeps going back to the dealer for the same engine or electrical problem, a lemon law attorney can review your repair orders, explain which rule applies and tell you whether timing is a concern for an older vehicle.
Short answer: the best lemon law attorney for a CX-5 case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Mazda CX-5: Complaints from California Drivers
Since January 2021, California drivers filed 82 safety complaints with NHTSA about 2019 or newer Mazda CX-5 vehicles.
| Most reported problems | Complaints |
|---|---|
| Engine | 34 |
| Electrical system | 14 |
| Brakes | 5 |
| Airbags | 4 |
| Lights, cameras and visibility | 3 |
| Collision warning and driver-assist systems | 3 |
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
What California CX-5 Owners Report to NHTSA
Our count found 82 complaints that California drivers filed with NHTSA about the Mazda CX-5. Every CX-5 report in it involves a 2019 or newer model, was filed from 2021 through 2026 and is counted once. These are owner complaints, not verified defects, and they are not adjusted for how many CX-5s were sold.
Engine problems were mentioned in 34 complaints, more than twice the next area. Electrical issues had 14, brakes 5, airbags 4, and lights, cameras and visibility and driver-assist 3 each. Since one complaint can name several areas, these totals overlap. The 2019 model year accounted for more than half of the complaints (44). Later years were much lower: 2020 (13), 2021 (7), 2025 (6), 2022 and 2024 (4 each), 2023 (3) and 2026 (1). Sacramento had the most reports (7), then San Diego (5), San Francisco and Gardena (3 each), and Berkeley and Morongo Valley (2 each).
We do not currently have a CX-5 recall page on our site. You can still check your own VIN for open recalls on NHTSA's recall lookup.
The heavy concentration in the 2019 model year may reflect how long those vehicles have been on the road and how many were sold. It is not proof that the 2019 CX-5 is defective. Newer CX-5 owners should not take the lower counts as a sign their problem is minor.
If you have filed your own NHTSA complaint, save a copy. It is not a repair attempt, but it can help show when you first noticed the problem.
CX-5 Engine and Electrical Problems: Safety or Not
Under Civil Code 1793.22(b), a defect likely to cause death or serious injury needs only two repair attempts within 18 months or 18,000 miles for the presumption. Other problems need four repairs for the same defect or more than 30 days total in the shop.
Engine problems are judged by what they do. If your CX-5 stalls, hesitates badly when you accelerate into traffic, or loses power on the freeway, that may be argued as a safety defect. A rough idle, a noise or a warning light without a driving problem is more likely to rely on the four-repair or 30-day rule. Brake and airbag complaints are often treated as safety issues. Electrical faults vary, from a screen that freezes to lights or controls that stop working.
The presumption is not the only way to prove a case. A claim can succeed after 18 months or 18,000 miles if the defect first appeared while the vehicle was under warranty.
Time Limits for Older CX-5s
Many CX-5 complaints involve the 2019 model year, which means many of those vehicles are now several years old. Warranty claims generally have a four-year limit under Commercial Code 2725, and when that clock starts can be technical. If your CX-5 has had repeat repairs and you are near or past the end of your warranty, talk to an attorney soon.
Being out of warranty now does not automatically end a claim. What often matters is whether the defect first showed up and was reported while the vehicle was under warranty. That is why your earliest repair orders can be the most important ones in the file.
Gather your oldest paperwork first: the purchase or lease contract, the warranty booklet and the first repair order that mentions the problem. Those documents help an attorney see when the warranty started, when the defect first appeared and how much time may be left. If you have moved or changed dealers, request copies of older repair orders from the dealer that did the work.
Reporting CX-5 Problems at the Mazda Dealer
Describe what the engine does and when. Say whether it happens cold or warm, at a stop or at speed, and whether a warning light came on. If the engine shakes or makes a noise, record a short video with sound. Ask the Mazda advisor to copy your words onto the order.
Before you leave, confirm the order lists your complaint, mileage, dates and work performed. An update on your CX-5 aimed at the reported problem can count as a repair attempt. Repairs at an independent shop, or work you do yourself, do not count toward Mazda's attempts. Keep every order, even ones marked no problem found, because California courts have held that you do not have to prove the exact technical cause.
If the dealer keeps the CX-5 for more than a day, ask for a loaner or rental and keep the paperwork. Reasonable rental and towing costs can be incidental damages in a buyback, and the days count toward the 30-day rule.
- Cold or warm engine, idle or speed
- Warning lights and any stored codes
- Video with sound of shaking or noise
- Your words on each repair order
Mazda's U.S. Company and Your Claim
Mazda dealers repair the CX-5, but the new vehicle warranty comes from Mazda's U.S. company, Mazda North American Operations. A CX-5 lemon law claim is made against Mazda, the manufacturer. The dealer's repair orders are your evidence.
Under Civil Code 1793.2(d)(2), if Mazda cannot fix a warranty defect that substantially impairs use, value or safety after a reasonable number of attempts, it must replace or repurchase the vehicle, and you can choose a repurchase. Restitution includes the price paid or payable, collateral charges like tax and registration, and incidental damages like towing and rental, minus a mileage offset based on miles driven before you first reported the problem.
Mazda's dealer has 30 days to complete repairs unless you agree otherwise, under Civil Code 1793.2(b). Keep making your payments while a claim is open.
If Mazda is found to have willfully violated the law, a civil penalty of up to two times actual damages may be available under Civil Code 1794(c). An attorney will review how your repair requests were handled before saying whether that applies.
If you bought the CX-5 used, the rules differ. After Rodriguez v. FCA US LLC (2024), a used car with only leftover factory warranty is generally not a new motor vehicle under the lemon law's vehicle section, though other warranty claims may still exist.
Made-Up Example: A CX-5 That Hesitates
This example is made up to explain the process. Nina is a made-up owner. Nina bought a new CX-5. In its first year, the engine began hesitating when she accelerated from a stop, and once it nearly stalled in an intersection. The dealer found no codes and returned the vehicle.
Nina started recording each event and noting the date and mileage. At Nina's second visit, the Mazda dealer installed a software update. The hesitation came back, and on the third visit the dealer replaced a part. Years later, with the problem still returning, she worried it was too late.
In a free case review, the attorney focused on her first repair orders, which showed the problem started under warranty, checked the time limits, looked at whether hesitation in traffic was a safety defect, and explained the next steps.
Nina's early repair orders mattered more than the recent ones. They showed when the problem first appeared, which helped answer the question of whether the defect was covered.
Questions to Ask and Next Steps for CX-5 Owners
Ask the attorney whether your engine problem is likely a safety defect. Ask how close you are to any deadline and what they need to check it. Ask how they handle visits where the dealer found no codes. Ask what you will pay: a buyer who wins recovers attorney fees and costs from the manufacturer under Civil Code 1794(d). CX-5 owners pay our firm $0 out of pocket, and if we lose, you owe nothing.
Then gather your contract and every repair order, oldest first. Save your videos and notes. Look up the CX-5's VIN on NHTSA's recall site. Call 877-536-6620 for a free case review, especially if your CX-5 is older and the problem keeps coming back.
- Is my hesitation or stalling a safety defect?
- Am I close to a deadline?
- Do no-code visits still count?
- What does a lost CX-5 case cost me?
