The Ford Escape is a common commuter SUV in California, and owners who keep returning to a Ford dealer for engine, fuel system or electrical problems often wonder when enough is enough. If your new or leased Escape has a warranty defect Ford has not fixed after a reasonable number of tries, the lemon law may require a repurchase or replacement. Here is what Escape owners report and how to protect your claim.
Short answer: the best lemon law attorney for an Escape case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
California Escape Complaint Data
From 2021 through 2026, California owners of 2019 or newer Ford Escapes filed 131 complaints with NHTSA, each counted a single time. These are owner reports, not verified defects, and they are not adjusted for how many Escapes Ford sold here.
Engine problems were named most often (30). Body and structure came next (21), then the fuel system (19), the electrical system (18), the transmission and powertrain (15) and lights, cameras and visibility (3). A complaint can list more than one component, so the categories overlap.
The 2020 model year had the most reports by far (64), followed by 2019 (26) and 2022 (21). The 2021 model year had 9, and later years only a handful. San Diego (7) led the city list, with Los Angeles and Oakland at 5 each, and Santa Clarita and Sacramento at 4. With counts that low, the city list says more about where Escape owners live than about any local pattern.
Keep in mind that a complaint total is not the same as your case. NHTSA reports can show that other owners describe similar symptoms, but your own repair orders, dates and mileage are what decide whether your Escape qualifies.
When an Escape Problem May Be a Safety Defect
Civil Code 1793.22(b) creates a presumption during the first 18 months or 18,000 miles. It applies after two repairs of a defect likely to cause death or serious injury, four repairs of the same defect, or more than 30 days out of service. If the owner's manual clearly requires direct notice to Ford, give it.
Engine faults that make an Escape stall, lose power while merging or refuse to restart can be argued as safety problems. So can a fuel system issue that involves a leak or a smell of fuel. Describe exactly what happened so the repair order shows the risk, not just a warning light.
Body and structure complaints, such as water leaks, noises or trim, are usually not safety defects. Those cases more often rely on four attempts or more than 30 days in the shop. The presumption is helpful but not required, and a defect that first appeared under warranty can still support a claim later on.
Getting the Repair Order Right at a Ford Dealer
Tell the service advisor what you noticed, when it started and how often it happens. If the engine light came on, take a photo of the dash and note the mileage. If you smelled fuel or saw a drip, say so plainly. The words on the order are what Ford will read later.
Ask for a copy of every repair order, even when no repair was done. A software update or module reprogramming performed to fix your concern can count as a repair attempt. Repairs at an independent shop, or ones you do yourself, do not count against Ford, so keep the car at a Ford dealer for warranty work.
Watch the days, not just the visits. Under Civil Code 1793.2(b), warranty repairs must be completed within 30 days unless you agree otherwise, and more than 30 total days out of service within 18 months or 18,000 miles can support the presumption on its own. Keep a simple log with drop-off and pick-up dates, plus any time the dealer kept the Escape while waiting on parts.
- Your concern in your own words, matching what you said at check-in
- Mileage in and out, and the dates of each visit
- Codes found, parts replaced and programming performed
- Any field service action or recall work done during the visit
- Total days the Escape stayed at the dealer
Who You Deal With: Ford Motor Company
Your warranty and any lemon law obligation come from Ford Motor Company, not the dealership. Under Civil Code 1793.2(d)(2), if Ford's dealers cannot fix a warranty defect that substantially impairs the Escape's use, value or safety after a reasonable number of attempts, Ford must repurchase or replace it, and the choice of a refund is yours. Restitution includes what you paid plus collateral charges and incidental damages, minus a mileage offset.
Calling Ford's customer relationship center creates a record that the manufacturer knew about the problem. Keep the case number. Recall repairs on an Escape can count as repair attempts for the same problem. Our recall pages for the Escape include 21V625, 21V869, 22V109, 22V191, 22V484 and 22V859. Run your VIN through NHTSA's recall lookup to see which apply to you.
Do not stop at the dealer. If the dealer tells you nothing more can be done, ask Ford directly to review the vehicle and note the response. You also do not have to prove the exact technical cause of an engine or fuel problem. California courts have held that visits where the dealer could not find or fix the defect can still count, which matters for an Escape that runs rough one day and fine the next.
A Made-Up Escape Example
This Escape example is fictional and only shows the process. It is not about a real client or a real outcome. Marcus leased a new Escape for his commute. The engine light came on and the SUV shook at stoplights, and once it stalled in a left turn lane.
On the first visit the dealer cleared a code and reprogrammed a module. Two weeks later the shaking returned, and the second order listed a part replacement. After the third visit, Marcus added up the days without the car and saw it had been gone for most of a month. He pulled every repair order, his lease, and his rental receipts, and asked a lemon law attorney to look. The attorney checked whether the stall could be argued as a safety defect, counted the days out of service, and sent the required notice to Ford.
This Escape example does not promise any outcome. It shows how one owner moved from scattered visits to an organized file, which is what lets an attorney and the manufacturer evaluate the claim quickly. If your Escape has a similar history, the same habits help: save each order, note each day without the car, and keep receipts for any towing or rentals.
Questions for a Lawyer Before You Hire
Ask whether the attorney regularly handles claims against Ford and how they deal with repair orders that say no problem was found. Ask who will actually work on your file and how often you will hear from them.
Also ask about cost. Civil Code 1794(d) requires the manufacturer to pay a winning Escape buyer's attorney fees, costs and expenses. With our firm the cost to you is $0 out of pocket, and you owe nothing if we lose.
A careful attorney will also look at the whole history, not just the engine. An Escape with one engine visit, one electrical visit and one fuel system visit may still add up, especially if the days out of service pass 30. Ask the lawyer to walk you through how they would count your visits and what they think is missing before anything is sent to Ford.
- Have you handled Ford Escape engine or fuel system claims?
- Do my stalling visits fit the safety rule or the four-repair rule?
- Can my Escape rental and towing costs be included?
- What should I do if Ford calls me directly with an offer?
What to Do Next With Your Escape
Keep making your payments and keep the Escape insured and registered. Do not sell or trade it before getting advice. Collect your contract, all repair orders and any receipts for towing or rentals. For many claims, Code of Civil Procedure 871.20 adds pre-lawsuit notice and mediation steps for manufacturers that opted in, and an attorney can manage them. Then request a free case review.
If you bought the Escape used, the answer depends on how it was sold. After Rodriguez v. FCA US LLC (2024), a used vehicle with only the remaining factory warranty generally is not covered as a new motor vehicle, but a used or certified pre-owned buyer may still have claims under another warranty, the implied warranty or federal law. Warranty claims are generally subject to the four-year rule in Commercial Code 2725, so do not wait until you are sure.

Ford Escape Lemon Law FAQ
Does California lemon law cover a leased Ford Escape?
Yes. A leased Escape is covered the same as a purchased one. In a lease buyback, Ford typically refunds what you paid and pays off the lease.
My Escape stalled twice and was repaired twice. Is that enough?
It may be. If the stall is a defect likely to cause death or serious injury and it was repaired twice within 18 months or 18,000 miles, the presumption can apply. An attorney can review your Escape repair orders.
Does it matter if my Escape is a hybrid?
Hybrid and plug-in hybrid Escapes sold new with Ford's warranty are covered like the gas version. The same rules for repair attempts and days out of service apply.
How much does a Escape lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
