Home › Best Lemon Law Attorney Near Me › Audi Q5
California owner complaints about the Audi Q5 are few, but the ones that exist point mostly to electrical, driver-assist and brake problems. A small number of statewide reports does not make your problem any less real. If your new or leased Q5 keeps going back to an Audi dealer for the same defect, California lemon law may require Audi to repurchase or replace it. Here is how to approach a Q5 claim.
Short answer: the best lemon law attorney for a Q5 case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Audi Q5: Complaints from California Drivers
Since January 2021, California drivers filed 34 safety complaints with NHTSA about 2019 or newer Audi Q5 vehicles.
| Most reported problems | Complaints |
|---|---|
| Electrical system | 10 |
| Collision warning and driver-assist systems | 8 |
| Brakes | 6 |
| Lights, cameras and visibility | 3 |
| Engine | 2 |
| Transmission and powertrain | 2 |
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
What the Small Q5 Complaint Count Tells You
California owners of 2019 or newer Audi Q5 vehicles filed 34 complaints with NHTSA from 2021 through 2026, counting each complaint once. That is a small sample for the Q5. The complaints are owner reports, not verified defects, and they are not adjusted for how many Q5s were sold or are on the road.
The electrical system was named in 10 complaints, driver-assist and collision warning systems in 8, and brakes in 6. Lights, cameras and visibility had 3, and the engine and the transmission and powertrain had 2 each. A complaint can mention more than one component, so these numbers overlap.
The 2021 model year had the most complaints (12). Every other year had 6 or fewer: 2025 had 6, 2024 had 5, 2019 had 4, 2020 had 3, and 2022 and 2023 had 2 each. Sunnyvale, Cupertino, Irvine, Los Angeles and Sherman Oaks each had 2, and La Mesa had 1. Counts this small cannot show a trend by city or year.
The practical takeaway is that a Q5 claim will be judged almost entirely on your own records. If you want your experience on the public record, you can also file a complaint with NHTSA, though that does not start a lemon law claim.
Q5 Safety Defects Versus Other Problems
The Tanner Act presumption in Civil Code 1793.22(b) applies within 18 months or 18,000 miles when a defect likely to cause death or serious injury was repaired two or more times, the same defect was repaired four or more times, or the vehicle spent more than 30 days out of service. If the owner's manual clearly requires you to notify Audi directly, do it.
Driver-assist and brake complaints are the Q5 categories most likely to raise safety questions. A collision system that brakes hard with nothing ahead, or one that fails to warn, may be argued as a safety defect. So can a brake problem that changes how the SUV stops. An electrical fault that disables headlights or a camera you rely on while driving can belong in the same group.
Electrical problems that affect screens, comfort features or warnings while parked are more often treated as non-safety defects, which means four repairs or more than 30 days in the shop. The presumption is only one path. A Q5 defect that first showed up under warranty can still support a claim after 18 months or 18,000 miles.
How to Report a Q5 Problem to the Audi Dealer
Driver-assist faults are often hard to reproduce on a short test drive. Tell the service advisor the speed, road, weather and traffic when it happened, what the screen showed, and what the vehicle did. Photograph warning messages before you shut the car off. If a passenger can safely record it, bring the video.
Make sure your words appear on the repair order and read it before you leave. A software update or sensor calibration done to fix what you reported can count as a repair attempt, so it should be listed. Keep Q5 orders that say no fault was found, because those visits can still count. Repairs at an independent shop or ones you do yourself do not count toward Audi's attempts.
Track the calendar as well. Civil Code 1793.2(b) requires warranty repairs to be completed within 30 days unless you agree otherwise, and the days your Q5 waits for diagnosis or parts count toward the 30-day part of the presumption.
For a camera or headlight complaint, note whether it happened at night, in rain or after a car wash, and photograph the blank screen or dark lamp. Those conditions help the technician test the right way and help show later that the problem was reported accurately each time.

Who You Deal With: Audi of America
Your Audi dealer makes repairs, but the warranty is backed by Audi of America, which is part of Volkswagen Group of America, Inc. If Audi cannot fix a warranty defect that substantially impairs the Q5's use, value or safety after a reasonable number of attempts, Civil Code 1793.2(d)(2) requires a repurchase or replacement, and you can choose the refund.
Call Audi customer care and save the case number. Recall repairs can count as Q5 repair attempts when they address your complaint. Our site has recall pages for the Q5 and related versions, including 21V947, 22V753, 24V898, 25V080, 25V294 and 26V266. Check your VIN in NHTSA's recall lookup to see which apply.
A Q5 buyback refund is based on what you paid or owe, including sales tax, license and registration fees, plus incidental costs like towing and rentals, minus a mileage offset. Under Civil Code 1793.2(d)(2)(C), that offset uses the miles driven before your first visit for the problem.
You do not need to identify the failed part. California courts have held that a Q5 buyer does not have to prove the exact technical cause, and visits where the dealer could not find or fix the problem can still count.
Made-Up Example: Phantom Braking in a Q5
This Q5 example is invented to explain the process. It is not based on a real Q5 owner or a real result. Grace leased a new Q5. Twice on a quiet road the SUV braked sharply and showed a collision warning with nothing in front of her. The first Q5 repair order said the dealer could not duplicate the problem.
Grace began writing down each event with the time and location, and her passenger recorded the next one. On the second visit the dealer calibrated a sensor and performed a software update. When it happened again, Grace called Audi customer care, saved the case number, and collected her lease and repair orders. A lemon law attorney reviewed whether the sudden braking fit the two-repair safety rule and sent the required notice to Audi.
This Q5 example is not a promise of any result. It shows how notes and video can make a 'could not duplicate' visit meaningful.
Questions to Ask a Q5 Lemon Law Attorney
Look for a consumer-side lemon law attorney who has handled Audi and other luxury brand claims. Ask how they deal with driver-assist complaints the dealer could not reproduce, and whether they will read every repair order before contacting Audi.
Ask about cost. A Q5 buyer who wins recovers attorney fees, costs and expenses from the manufacturer under Civil Code 1794(d). On a Q5 case with our firm, you pay $0 out of pocket, and if we lose, you owe nothing.
Ask how offers will be handled. Audi may suggest a goodwill payment or extended coverage, and after a lawsuit is filed it may serve a formal offer under Code of Civil Procedure 998. Rejecting a 998 offer and not doing better at trial can cost you post-offer costs, so every offer deserves a careful review.
- Have you handled Audi Q5 or other Audi SUV cases?
- Does my driver-assist or brake problem fit the safety rule?
- What is missing from my Q5 repair orders?
- My lease ends soon. What should I do first?
Next Steps for Q5 Owners
Keep making your lease or loan payments and do not turn in or trade the Q5 before getting advice. Gather your contract, every repair order and any case numbers. For many Q5 claims, Code of Civil Procedure 871.20 adds pre-lawsuit notice and mediation steps for manufacturers that opted in. Warranty claims are generally subject to a four-year limit under Commercial Code 2725, so ask for a free case review early.
If you bought the Q5 used or certified pre-owned, ask what warranty came with the sale. After Rodriguez v. FCA US LLC (2024), a used vehicle with only the leftover factory warranty generally is not a new motor vehicle under the lemon law, but other warranty claims may still apply.
If you already turned in or sold your Q5, you may still have a claim. California courts have held that a buyer does not have to still own or possess the vehicle to pursue lemon law remedies, so a past lease or a recent trade is not automatically the end of the road.

Audi Q5 Lemon Law FAQ
There are only a few Q5 complaints on file. Can I still bring a Q5 claim?
Yes. Statewide complaint numbers do not decide your case. Your own repair orders, the warranty and the number of attempts or days out of service are what matter.
Does a sensor calibration on my Q5 count as a repair attempt?
It can, when the dealer performed it to fix the problem you reported. Make sure the repair order lists the calibration next to your complaint.
Who is the manufacturer in an Audi Q5 lemon law claim?
Audi of America, part of Volkswagen Group of America, backs the warranty. Your dealer makes the repairs.
How much does a Q5 lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
