The Audi e-tron was one of the first luxury electric SUVs many California drivers owned, and its owner complaints point mostly to electrical problems. Warning messages, charging trouble and power faults can be hard to reproduce at the dealer. If your e-tron keeps going back for the same defect, here is how California lemon law treats it and how to choose an attorney for an EV case.
Short answer: the best lemon law attorney for an e-tron case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Audi e-tron: Complaints from California Drivers
Since January 2021, California drivers filed 43 safety complaints with NHTSA about 2019 or newer Audi e-tron vehicles.
| Most reported problems | Complaints |
|---|---|
| Electrical system | 22 |
| Transmission and powertrain | 6 |
| Fuel and EV propulsion system | 5 |
| Lights, cameras and visibility | 3 |
| Engine | 1 |
| Airbags | 1 |
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
What California e-tron Owners Report
California owners filed 43 complaints with NHTSA about 2019 and newer e-tron models between 2021 and 2026, each counted once. Each is an e-tron owner's report, not a verified defect, and the totals ignore how many were sold. Forty-three is a small number, so no single category should be read as a trend.
Electrical problems were named in 22 complaints, about half of the total. Powertrain followed with 6, then fuel or EV propulsion (5), lights and visibility (3), and one complaint each for engine and airbags. Any e-tron complaint can mention several systems. The 2019 model year drew 27 complaints, 2021 drew 10, 2022 drew 5 and 2023 drew 1. Sacramento and Los Angeles each had 3, with Lincoln, Folsom, Winchester and National City at 2.
Because most of these reports involve 2019 vehicles, many of those owners are now beyond the first 18 months of ownership. That does not end a claim if the defect first appeared while the e-tron was under warranty, but it does mean the earliest repair orders carry extra weight.
When an e-tron Fault May Be a Safety Defect
Under Civil Code 1793.22(b), within 18 months or 18,000 miles, a reasonable number of repair attempts is presumed if a defect likely to cause death or serious injury was repaired two or more times. For other defects, the presumption comes from four repairs of the same problem or more than 30 days out of service in total.
An electrical fault that cuts drive power on the road, a braking warning that limits stopping, or a lighting failure at night could fit the safety path, depending on the facts. A charging port that refuses some chargers, or a screen that freezes, is usually treated as a non-safety defect. Those problems still count. They simply rely on four repairs or the 30-day path.
The presumption is only one way to show that Audi had enough chances. A claim can also be proven with the full repair history, and if the owner's manual clearly requires direct notice to Audi, send it in writing.
Lighting faults deserve close attention. If a headlight or taillight stops working, or the exterior lights flicker with an electrical warning, describe that plainly and note whether it happened at night. Those details help show whether the problem is likely to cause serious injury, which is what the two-repair path requires.
What to Tell the Audi Advisor About an EV Problem
EV faults often come with a message on the screen. Photograph it before it clears, and note the state of charge, outside temperature, and whether you were driving, parked or charging. If a charge session failed, screenshot the charger's app or screen and note the location and charger type.
Ask the advisor to write your description on the repair order in your words. When you pick up the e-tron, check the dates, mileage, stored codes, and any software update or high-voltage component work. A software update done to fix your reported problem can count as a repair attempt. Keep orders that say no fault was found, because those visits can still count. Repairs at an independent EV shop do not count against Audi.
If the e-tron stays at the dealer while parts are ordered, make sure the order shows the full time. Civil Code 1793.2(b) requires e-tron repairs to be finished within 30 days unless you agree otherwise.
- Photos of warnings with the state of charge
- Charger type, location and app screenshots
- Codes, software updates and parts on each order
- Date in and date out for every visit
Audi of America, Your Dealer and Your Warranty
Audi dealers do the repairs, and the manufacturer responsible under the lemon law is Audi of America, part of Volkswagen Group of America, Inc. Under Civil Code 1793.2(d)(2), if Audi cannot fix a covered defect that substantially impairs use, value or safety after a reasonable number of attempts, it must replace or repurchase the e-tron, and you choose the refund if you prefer.
Check your warranty booklet for any separate coverage on high-voltage battery or drive parts, in addition to the basic warranty. A defect covered by either one can support a claim if it was not fixed after a reasonable number of tries. Our recall pages list e-tron campaigns 21V569, 21V595 and 21V707. Check your VIN at NHTSA, since recall work can count as a repair attempt if it addresses your problem.
Audi may respond to a complaint with a goodwill repair, an extended warranty or a trade-in incentive. None of those is a buyback, and some come with a release of your claims. You also do not have to use a manufacturer arbitration program before bringing a Song-Beverly claim, and after the 2025 Ford Motor Warranty Cases decision, manufacturers generally cannot force arbitration using the dealer's sales contract. Review any written offer with an attorney before signing.
Made-Up Example: An e-tron That Will Not Charge
This example is made up to show the process. The details are invented, and no real e-tron client is described. Helen leased a new e-tron. A few months in, it began refusing to charge at home, and one morning a warning appeared and the SUV would not shift into drive. Her Audi dealer found stored codes and installed a software update.
Two months later the charging failures came back, along with the same warning. The dealer kept the e-tron for 18 days waiting for a part. Helen saved photos of each warning, her charger's app screenshots and both repair orders. After a third failure, she asked for a free case review. The attorney counted the visits and days out of service, considered whether a no-drive condition could be a safety issue, and explained how a lease buyback typically works.
This example is about how a record comes together, not about any result. A real e-tron claim depends on that vehicle's own history.
What made Helen's file useful was simple: the same warning described the same way on each order, photos that matched the dates, and a lease that showed what she had paid.
Questions to Ask an Attorney About an e-tron
Choose someone who is comfortable with EV evidence. Ask whether they have handled Audi or other electric vehicle cases, how they treat software updates and charging complaints, and how they respond if Audi blames a home charger.
Ask about cost. Under Civil Code 1794(d), a buyer who wins recovers attorney fees, costs and expenses from the manufacturer. With us, an e-tron claim costs you $0 out of pocket, and nothing if we lose.
Ask, too, who will handle your file day to day and how often you will hear from them. An EV case can involve more service visits while it is pending, and you should know what to say at each one and how each new order will be added to your record.
- Have you handled e-tron or other EV cases?
- Does my battery or high-voltage warranty change anything?
- How will you answer a claim that my charger caused the problem?
- How does a lease buyback work for my e-tron?
Next Steps for e-tron Owners
Gather your lease or purchase contract, both warranty booklets, every repair order, and your photos and charger screenshots. Keep receipts for towing, rentals or public charging you paid because the e-tron was out of service, since reasonable incidental costs can be part of a refund. Keep making your payments.
Commercial Code 2725 generally gives e-tron owners four years to bring warranty claims. For manufacturers that opted in, Code of Civil Procedure 871.20 adds written notice, document exchange and mediation steps for many claims. If you already sold, traded or turned in the e-tron, you may still have a claim. A free review of your e-tron records can show where you stand.
Keep copies of dealer texts and emails about parts and repair status, since they often fill in dates the repair orders leave out. If you charge at home, keep a note of your charger brand and installation date, because Audi may ask about it.

Audi e-tron Lemon Law FAQ
Is the Audi e-tron covered by California lemon law?
Yes. An e-tron bought or leased new in California is covered by the Song-Beverly Act. An e-tron with repeat repairs for the same electrical, charging or other warranty defect may qualify.
My e-tron is a 2019. Can I still bring a claim?
Possibly. A defect that first appeared under warranty can still support a claim, but the four-year limit and other timing rules apply, so get a review soon.
Do charging problems count under the lemon law?
They can. A charging defect covered by the warranty that is not fixed after a reasonable number of attempts may support a claim, even if it is not a safety defect.
How much does a e-tron lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
