The Toyota RAV4 is one of the most common compact SUVs in California, sold in gas, hybrid and plug-in versions. California owners who reported problems to NHTSA most often named airbags and the engine. If your RAV4 keeps returning to a Toyota dealer for the same concern, an attorney can help you figure out whether those visits add up to a lemon law claim.

Short answer: the best lemon law attorney for a RAV4 case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.

What RAV4 Owners in California Have Reported

Our count found 265 complaints filed with NHTSA by California RAV4 owners for 2019 or newer models, filed between 2021 and 2026, with each complaint counted once. These are reports from owners, not verified defects. The totals are not adjusted for sales, and the RAV4 sells in large numbers, so a high count does not by itself mean the RAV4 has more problems than other SUVs.

Airbags were the top category (54 complaints), with engine problems close behind (47). Electrical issues followed (30), then lights, cameras and visibility (15), fuel system or EV propulsion (13) and body or structure (12). One owner's report can touch several categories.

Most reports came from 2019 through 2021 models (56, 75 and 70). Newer years had fewer: 20 for 2022, 21 for 2023, 14 for 2024 and 9 for 2025. Los Angeles led the cities with 24, followed by San Jose (7) and Sacramento, Anaheim and San Diego (6 each). These patterns describe what owners chose to report, not how likely your RAV4 is to have a problem.

Notice that the airbag and engine groups together are larger than all of the other listed categories combined.

When a RAV4 Problem Counts as a Safety Defect

Airbag problems are a clear example of what may count as a safety defect. An airbag warning light that will not go away, or a passenger airbag that seems to switch off for an adult, can mean the system may not protect you in a crash. Under Civil Code 1793.22(b), a defect likely to cause death or serious injury that has been repaired two or more times within 18 months or 18,000 miles raises a presumption that the manufacturer had a fair chance to fix it.

Engine problems can go either way. Stalling, losing power while merging or a car that will not restart may be safety issues. An oil smell or an odd noise with no loss of power is more likely to fall under the four-repair or 30-day rules. Electrical and body complaints are judged the same way, by what the defect does to the car.

Toyota has issued recalls on the RAV4, including 22V519, and repairs done under a recall can count as repair attempts. The presumption is not the only path. A claim can still succeed later if the defect first showed up during the warranty.

Making Each Toyota Dealer Visit Count

Tell the service advisor what you saw, not what you think is wrong. For an airbag light, say when it came on, whether it stayed on, and whether anyone was in the passenger seat. For an engine problem, describe the speed, the warning messages and whether the SUV shook, hesitated or stalled. A photo of the dashboard with the mileage visible is often more useful than a long explanation.

Before you leave, read the repair order. It should record your complaint, the dates, the mileage and what the technician did. If the order is missing your description, ask for it to be added. If the dealer updated software to fix your complaint, make sure that is written down, because a software update done to fix your problem can count as a repair attempt. Work done at an independent shop or by you at home does not count.

If the light stays off for weeks and then comes back, return to the dealer anyway. A gap between visits does not erase the earlier repairs.

  • Photos of warning lights with the odometer showing
  • The exact wording of any message on the screen
  • Whether the problem happened cold, warm, at speed or at idle
  • Hybrid or plug-in system warnings, if your RAV4 has one
  • Copies of every order, even when no repair was made

Toyota's Role in a RAV4 Lemon Law Claim

The dealer that services your RAV4 is an independent business. The warranty is backed by Toyota's U.S. company (your warranty booklet names the exact company), and that is who a lemon law claim is made against. The dealer's job is to repair the vehicle and keep records. The decision to repurchase or replace it is made by the manufacturer.

If you contact Toyota directly, keep notes of each call with the date and a case number. Do not sign a release or accept a goodwill offer before an attorney reviews it. If the owner's manual clearly requires direct notice to the manufacturer, send it in writing.

Keep track of days out of service. Under Civil Code 1793.2(b), warranty repairs must be completed within 30 days unless you agree otherwise. A RAV4 waiting at the dealer for a part is still out of service, and those days can add up to the 30-day part of the presumption.

If Toyota arranges for a specialist to inspect your RAV4, ask that the findings be written down and added to your records. That inspection is part of your repair history, just like a regular dealer appointment.

Made-Up Example: A RAV4 Airbag Light That Keeps Returning

This is an invented example that shows the process only. It is not a real client and does not describe any outcome. Kevin leased a new RAV4. A few months in, the airbag warning light came on during his commute and stayed on. The dealer cleared a code and returned the SUV the same day.

The light came back within two weeks. On the second visit, the dealer replaced a part and kept the SUV for six days while waiting for it. When the warning returned a third time, Kevin took dated photos of the dashboard, collected both orders and his lease, and contacted a lemon law attorney for a free review. The attorney explained that an airbag defect may be a safety issue, checked whether the visits fell within 18 months or 18,000 miles, and outlined the notice that would go to Toyota.

Kevin did not need to know which part had failed. He only needed records showing the same warning, the visits and the time the SUV was off the road.

What to Ask a Lawyer About Your RAV4

A good first question is how the attorney decides whether your RAV4 problem is a safety defect, since that changes how many repair visits matter. Ask whether they have handled hybrid or plug-in RAV4 claims if yours is one. Ask what is missing from your paperwork and how they handle a dealer that wrote "no problem found."

Ask about fees in plain words. A buyer who wins gets attorney fees, costs and expenses paid by the manufacturer, as Civil Code 1794(d) provides. At our firm, you pay $0 out of pocket and owe nothing if we lose. Ask how the case would move forward, including the pre-lawsuit notice and mediation steps that apply to many claims under Code of Civil Procedure 871.20 for manufacturers that opted in.

Ask, too, whether your case could involve more than one defect. An airbag fault and an engine fault are counted separately when adding up repair attempts, but every day your RAV4 sat in the shop for warranty work counts toward the 30-day total.

  • Is my airbag or engine problem likely a safety defect?
  • Do my lease and repair orders show enough repair attempts?
  • How would my mileage offset be figured?
  • Who will keep me updated, and how often?

Next Steps for RAV4 Owners

Collect your purchase or lease contract and every repair order. Note each date the problem appeared and the mileage. Keep receipts for towing or rental cars, since reasonable costs like these can be part of a buyback. Keep making your payments while the claim is pending.

If your RAV4 is a hybrid or plug-in model, also save any messages about the hybrid system, charging or the high-voltage battery. Hybrid parts often carry their own warranty period, so check your warranty booklet for the terms.

Run your VIN through NHTSA's recall lookup, and file a safety report with NHTSA if your RAV4 has a safety problem. The four-year limit in Commercial Code 2725 generally applies to warranty claims, but the start date can be tricky, so get advice sooner rather than later. Toyota RAV4 Lemon Law FAQ

Can a RAV4 with an airbag warning light qualify under California lemon law?

A RAV4 with repeat repairs for an airbag problem may qualify. Because airbag defects may be safety issues, two repair attempts within 18 months or 18,000 miles can be enough for the presumption.

Are hybrid and plug-in RAV4 models covered?

Yes. Hybrid and plug-in RAV4s bought or leased new in California are covered by the lemon law the same way as gas models.

Should I accept a goodwill offer from Toyota for my RAV4?

Have an attorney review any offer or release before you sign. Some offers ask you to give up your lemon law rights.

How much does a RAV4 lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
