The Honda Accord is one of the most familiar sedans in California, which is why owners are often surprised when a new one keeps returning to the dealer. Driver-assist warnings, engine concerns, electrical faults and fuel system complaints all show up in owner reports. If your Accord has a problem the dealer cannot fix, this page explains how California lemon law treats it and what to look for in an attorney.
Short answer: the best lemon law attorney for an Accord case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.
Honda Accord: Complaints from California Drivers
Since January 2021, California drivers filed 264 safety complaints with NHTSA about 2019 or newer Honda Accord vehicles.
| Most reported problems | Complaints |
|---|---|
| Collision warning and driver-assist systems | 48 |
| Engine | 39 |
| Electrical system | 33 |
| Fuel and EV propulsion system | 28 |
| Steering | 24 |
| Brakes | 22 |
Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.
What Accord Owners in California Tell NHTSA
NHTSA's records show 264 complaints from California owners of 2019 or newer Accords, filed from 2021 through 2026, with each complaint counted once. They are owner descriptions, not proof that a car is defective, and the count does not account for how many Accords were sold. Because so many Accords are on California roads, the total is modest for a car this common.
Driver-assist and collision-warning problems were cited 48 times. Engine complaints followed with 39, then electrical (33), fuel or propulsion (28), steering (24) and brakes (22). One report can list several systems, so the figures overlap. The 2019 model year drew 89 complaints, far more than any other year; 2020 and 2021 had 45 each, 2024 had 26, and 2022 had 29. San Diego owners filed the most (17), followed by Los Angeles (13), San Jose (9) and Sacramento (9).
The heavy tilt toward the 2019 model year may reflect that those cars have been on the road the longest, not that they are worse. A small yearly count, like the 13 complaints for 2023, says very little on its own. Your claim depends on your own repair history.
Safety Defects and Other Accord Problems
Whether your Accord problem is a safety issue changes how many repair visits the law presumes are enough. Civil Code 1793.22(b) says that in the first 18 months or 18,000 miles, two repairs of a defect likely to cause death or serious injury can be enough. For other defects, the presumption comes from four repairs of the same problem or more than 30 total days out of service.
On an Accord, a collision-mitigation system that brakes on its own, an engine that loses power or stalls, a fuel system fault, or steering that pulls or stiffens could fall into the safety group, depending on the facts. A slow infotainment screen or a rattle generally would not. Even when the presumption does not apply, you can still prove that Honda had a reasonable chance to fix the car. If the owner's manual clearly asks you to notify Honda directly about an unrepaired defect, send that notice.
Electrical complaints on an Accord deserve a close look. A fault that only affects a screen is usually not a safety defect, but one that shuts off the headlights, the backup camera or the engine may be. Describe exactly what stopped working so the repair order captures it.
At the Honda Service Desk: What the Repair Order Needs
Your Honda dealer's repair order is the core document in an Accord case. Before the advisor writes anything, explain the symptom plainly: what you felt or saw, how fast you were going, and how often it happens. If a warning message appeared, show a photo of it. Ask the advisor to write your words on the order, not a vague code.
When you pick up the car, read the order before you leave. Check the date in, date out and mileage. Make sure any software update, recall work or part replacement is listed, because work done to fix your reported problem can count as a repair attempt. If the order says no problem found, keep it anyway. Visits where the dealer could not find the cause can still count. Work done at an independent shop does not.
If the dealer asks you to leave the Accord overnight so the problem can show up, agree if you can and ask for a loaner. Each day the car sits at the dealer for a warranty repair counts toward the 30-day total, and repairs must be finished within 30 days unless you agree otherwise under Civil Code 1793.2(b). Rental costs you pay yourself may be recoverable as incidental damages.
- Your complaint written in your own words
- Dates in and out, and mileage at drop-off
- Diagnostic results, codes and technician notes
- Parts, software updates and recall work performed
Dealing With Your Dealer and American Honda
Your Honda dealer does the repairs, but the lemon law duty belongs to the manufacturer. In the United States that is American Honda Motor Co., Inc. When an Accord cannot be fixed after reasonable attempts, Civil Code 1793.2(d)(2) requires the manufacturer to replace or repurchase it, and you get to choose the refund instead of a replacement.
Calling Honda's customer line can be useful, but keep notes of every call and the case number. A goodwill offer such as a free extended warranty is not the same as a buyback, so do not sign anything before you understand it. Our recall pages cover several Accord campaigns, such as 23V858 and 24V763. Look up your VIN on NHTSA's site, since recall repairs can count as repair attempts if they address the defect you have.
You do not have to accept a manufacturer arbitration program before using the Song-Beverly Act. If you choose one, its decision binds the manufacturer only if you accept it. Also, after the California Supreme Court's 2025 decision in the Ford Motor Warranty Cases, manufacturers generally cannot use the arbitration clause in a dealer's sales contract to force you into arbitration. Ask your attorney which route fits your situation.
Made-Up Example: An Accord With Repeat Warnings
This example is made up to show how a case can unfold. It is not a real client or outcome. Lena bought a new Accord. Within the first year, a collision warning flashed and the brakes engaged on an empty road twice in one month. She took it to her Honda dealer, and the order said the system was inspected and a camera was recalibrated.
The warning returned. On the second visit, the dealer performed a software update. When it happened a third time, Lena asked for copies of every repair order and called a lemon law attorney. The attorney checked that each order showed her complaint, counted the visits within the 18-month window, and explained why the braking events might be treated as a safety defect. Then the attorney prepared the notice to American Honda.
Nothing in this example means that every Accord with a warning light qualifies. Lena's case moved forward because the same symptom kept coming back and each visit was written down clearly.
Questions to Ask Before Hiring an Accord Attorney
A good fit for an Accord case is an attorney who works only for consumers and who will review your repair orders before you agree to anything. Ask how they handle visits marked as could not duplicate, and whether they have dealt with American Honda on similar problems.
Ask how fees work. When an Accord buyer wins, the manufacturer pays attorney fees, costs and expenses under Civil Code 1794(d). Our Accord clients pay $0 out of pocket, and owe nothing if we lose.
It also helps to ask how the attorney communicates. You should know who is handling your file, how often you will hear from them, and how to reach them when the problem happens again.
- Have you handled Accord or other Honda cases with similar problems?
- Does my problem fit the two-repair safety path or the four-repair path?
- What is missing from my repair orders, and can it be fixed?
- How will you handle any goodwill offer Honda makes?
What an Accord Owner Should Do Next
Gather your sales or lease contract, every repair order, and any letters or emails from Honda. Keep a simple log: date, mileage, what happened, and who you spoke to. Keep paying your loan or lease while the claim is pending.
Timing matters. Warranty claims are generally subject to a four-year limit under Commercial Code 2725, and the rules on when the clock starts are technical. Many claims also now involve a pre-lawsuit notice and mediation process under Code of Civil Procedure 871.20 for manufacturers that opted in. A free case review can tell you where your Accord stands and what to do before the next dealer visit.
If you have already traded in or sold the car, you may still have a claim. The buyer does not have to still own the vehicle to pursue lemon law remedies. Mention any trade-in during your review.

Honda Accord Lemon Law FAQ
Is a Honda Accord covered by California lemon law?
Yes. A new Accord bought or leased in California is covered by the Song-Beverly Act. An Accord with repeat repairs for the same warranty defect may qualify for a buyback or replacement.
Do I have to go back to the same Honda dealer every time?
No. Any authorized Honda dealer's repair counts. What matters is that each visit is documented on a repair order that describes your complaint.
Honda offered me an extended warranty. Should I take it?
Talk to an attorney first. An extended warranty is not the same as a buyback, and signing a release could affect your rights.
How much does a Accord lemon law attorney cost?
Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
