Electrical problems account for most of what California Leaf owners report to NHTSA, far more than any other area. For an electric car, that can mean charging trouble, warning messages, sudden power limits or a car that will not start. If your Leaf keeps going back to the Nissan dealer for the same issue, an attorney who understands EV repair records can tell you whether the history supports a lemon law claim.

Short answer: the best lemon law attorney for a Leaf case knows this type of claim, charges you nothing, will go to trial when a manufacturer will not be fair, tells you who will handle your case, and has real reviews you can check.

Nissan Leaf: Complaints from California Drivers

Since January 2021, California drivers filed 142 safety complaints with NHTSA about 2019 or newer Nissan Leaf vehicles.

Source: NHTSA consumer complaint data, California complaints received January 2021 through early October 2026, model year 2019 and newer, counted once per complaint. Models with more vehicles on the road tend to get more complaints.

Leaf Problems California Owners Report

We counted 142 complaints filed with NHTSA by California drivers about the Nissan Leaf. These cover 2019 or newer models and were filed from 2021 through 2026, counted once each. They are owner complaints, not verified defects, and are not adjusted for sales.

Electrical problems dominate with 95 mentions. The rest are far smaller: fuel or EV propulsion (10), brakes (7), driver-assist and collision warning (4), speed control (3) and body or structure (2). One complaint can mention several areas, so the numbers overlap. The 2019 model year had the most complaints by far (67), followed by 2022 (30) and 2020 (29), then 2021 (9), 2023 (5) and 2025 (2). San Diego led with 11 complaints, then San Jose (7), Sacramento (5), and Oakland, Santa Rosa and Palo Alto (4 each).

Our recall pages for the Leaf include 23V048, 23V362, 23V494, 24V071, 25V655 and 26V188. A recall repair on your Leaf can count as a repair attempt.

The large share of 2019 complaints may reflect how long those cars have been on the road and how many were sold. It does not prove that a given year is defective. For your case, the repair orders on your own Leaf are what count.

Save a copy of any NHTSA complaint you filed about your Leaf. It is not a repair attempt, but it can help show when you first noticed and reported the problem.

Which Leaf Problems Are Safety Issues

California's presumption in Civil Code 1793.22(b) is easier to meet for a defect likely to cause death or serious injury: two repair attempts within 18 months or 18,000 miles. For other defects, the presumption needs four attempts for the same defect or more than 30 days out of service.

For an EV like the Leaf, the line often depends on when the problem happens. A car that suddenly limits power or shuts down while driving can be a safety defect. So can brake or speed control complaints. A car that will not charge at home or will not start in the garage is a serious reliability problem, but it is more likely to be argued under the four-repair or 30-day rule.

Unusual range loss, charging failures or battery warnings that Nissan cannot fix can support a claim. Normal battery aging is not a defect, so your records need to show something beyond expected wear. If the 18-month or 18,000-mile window has passed, a claim can still work if the defect first appeared under warranty.

Write down what happened to your driving when the fault appeared. "The car dropped to a crawl in the fast lane" says more than "power warning." Those details help an attorney decide whether to argue the safety rule.

Documenting Electrical and Charging Problems

EV faults can be hard to reproduce at the dealer. Take photos of every warning message, the charge level and the estimated range when it happens. Note where you were charging, the charger type and whether the problem happened at more than one charger. Bring that to the advisor and ask that your words go on the repair order.

Check every order before you leave for your complaint, the mileage, dates and what was done. A software update performed to fix the issue you reported can count as a repair attempt, so it should be listed. Repairs at an independent shop and do-it-yourself fixes do not count toward Nissan's attempts. Keep every order, including ones that say no problem was found.

If the dealer keeps the car for days waiting on a battery part or diagnosis, ask for a loaner or rental and keep the paperwork. A reasonable rental or tow for the Leaf can be part of the incidental damages in a buyback. Under Civil Code 1793.2(b), repairs must be finished within 30 days unless you agree otherwise.

  • Photos of warning messages, charge level and range
  • Where and how you were charging
  • Your words on the repair order
  • Any update, battery test or part replaced
  • Dates in and out and the mileage

Nissan North America and Your Leaf Claim

Nissan dealers repair the Leaf, but the new vehicle warranty comes from Nissan North America, Inc. Nissan North America is the party a Leaf claim is made against. Your warranty booklet may list separate coverage for the battery or electric drive parts in addition to the basic coverage. Read it closely, because a defect covered by any of those warranties can support a claim if it was not fixed.

Under Civil Code 1793.2(d)(2), if Nissan cannot fix a warranty defect that substantially impairs use, value or safety after a reasonable number of attempts, it must replace or repurchase the car, and you can choose a repurchase. Restitution is the price paid or payable, plus collateral charges like tax and registration and incidental costs such as towing or rental, minus a mileage offset based on miles before you first reported the problem.

Leased Leafs are covered too. Keep making your loan or lease payments while a claim is open, and do not return a leased car early without talking to an attorney.

If Nissan is found to have willfully violated the law, a civil penalty of up to two times actual damages may be available under Civil Code 1794(c). Whether that applies depends on how your requests were handled.

Made-Up Leaf Example

This example is invented to show how the process works. Helen is not a real person, and no outcome is described. Helen leased a new Leaf for her commute. A few months in, the car showed a warning and limited power on the freeway, then returned to normal after she restarted it.

The dealer found a stored code and installed a software update. A month later, the same warning appeared and the car would not charge at home. The dealer replaced a part. When the power limit happened again, Helen gathered her photos of the warning, her lease, and both repair orders.

In a free case review, the attorney looked at whether the power limit while driving was a safety defect, counted the days the car spent at the dealer and explained the notice and lease buyback steps. Helen kept making lease payments throughout.

Helen did not need to know why the car limited power. The law does not make a Leaf owner prove the exact technical cause. Her photos and the two repair orders for the same warning were the backbone of her claim.

Questions to Ask About a Leaf Lemon Law Case

Ask whether the attorney has handled EV cases and how they separate a battery defect from normal aging. Ask how they handle a charging problem that the dealer cannot reproduce. Ask how a lease affects the resolution and what records they need.

Ask what a Leaf case will cost. When a Leaf owner wins, Nissan pays the attorney fees, costs and expenses under Civil Code 1794(d). Leaf owners pay our firm $0 out of pocket, and if the case is lost, they owe nothing. Ask how the attorney would advise you on a Code of Civil Procedure 998 offer for your Leaf.

Ask whether the attorney works only for consumers and who will be your contact. With an older Leaf, ask early about timing. Warranty claims generally have a four-year limit under Commercial Code 2725, and timing rules are technical.

  • Is my power limit or shutdown a safety defect?
  • How do you prove a charging problem?
  • What happens to my Leaf lease?
  • Who pays your fees?

Next Steps for Leaf Drivers

Save every repair order and your contract or lease. Photograph each warning message with the charge level showing. Note where you charge. Search the Leaf's VIN on NHTSA's recall site. Then call 877-536-6620 for a free case review if the problem keeps coming back.

If your Leaf is leased and the lease is ending soon, call before you turn it in. Timing can affect how a lease case is resolved.

  • Contract or lease and every repair order
  • Photos of warnings with charge level and range
  • A note of where and how you charge
  • Rental and towing receipts

Nissan Leaf Lemon Law FAQ

Is a Nissan Leaf covered by California lemon law?

Yes. Electric vehicles bought or leased new in California are covered like any other new vehicle. A Leaf with repeat repairs for an electrical or battery problem may qualify.

My Leaf has lost range. Is that a defect?

Normal battery aging is not a defect, but sudden or unusual range loss, charging failures or battery warnings that Nissan cannot fix may be. Keep records of what you see.

Does a Leaf software update count as a repair attempt?

An update done to fix the problem you reported can count. Check that the Leaf repair order names the update.

How much does a Leaf lemon law attorney cost?

Usually nothing. California Civil Code section 1794(d) makes the manufacturer pay your attorney fees and costs when you win. At America's Lemon Lawyer you pay $0, win or lose.
