Volvo buyers tend to choose the brand for safety, so a car that keeps flashing warnings or losing its camera view is especially unsettling. If your XC90, XC60, XC40 or new EX90 has been back to the retailer for the same problem, read on.

California's lemon law applies to Volvo just as it does to every other brand. If Volvo cannot fix a warranty defect after a reasonable number of attempts, it must repurchase or replace the vehicle. Leases count too, and so do many certified used Volvos. Our California lemon law attorney team reviews Volvo cases at no charge, and you can call 877-536-6620.

Volvo Warranty Coverage and Lemon Law

Volvo Car USA's official site describes a New Vehicle Limited Warranty of 4 years or 50,000 miles from the warranty start date, whichever comes first. Volvo's current warranty booklets also list corrosion protection of 12 years with unlimited mileage. Fully electric and plug-in hybrid models carry a high-voltage battery warranty of 8 years or 100,000 miles. Volvo lists 10 years or 150,000 miles for the battery in its newest EX60.

New Volvos also include Complimentary Factory Scheduled Maintenance and roadside assistance for the length of the 4-year/50,000-mile warranty. Maintenance terms vary by model, so check your booklet.

Those free maintenance visits are useful in another way. Every time your Volvo is at a retailer, you have a chance to report a problem and get it written down. Mention anything that has been bothering you, even if it seems minor or comes and goes, and confirm it appears on the repair order before you drive away.

For a lemon law claim, the timing that matters is when the defect first appeared and was reported. A problem logged during the warranty can still support a claim after coverage ends, and battery defects may qualify much later.

Certified by Volvo vehicles get a 12-month, unlimited-mile limited warranty that starts after the new car warranty ends, or 12 months from the certified purchase date, whichever is later. Remaining battery coverage carries over. That matters because after Rodriguez v. FCA US (2024), an ordinary used car without a new-car warranty generally does not qualify. Our firm takes CPO, demo and dealer vehicles.

Common Volvo Problems in Recalls and Complaints

Volvo has a smaller recall count than many brands. According to NHTSA recall and complaint data, it has issued 27 recalls since the 2021 model year, and owners have filed 1,431 complaints. No recall carried a do-not-drive warning, and one told owners to park outside. Five recalls were fixed by over-the-air update, a sign of how much of a modern Volvo runs on software.

The electrical system was the most common recall area, with 7 campaigns. For Volvo's electric and plug-in models that can include the traction battery, as with the EX30 traction battery recall. Seat belts followed with 4 recalls and air bags with 3. Hydraulic brakes, structure, seats and back over prevention each had 2.

On the complaint side, the electrical system again led, with 283 reports. Volvo owners in this group often describe a center screen that freezes or reboots, lost phone connection, dead batteries, or a car that will not start or shift. Back over prevention was next at 151, covering rearview and surround cameras that go black or lag. Forward collision avoidance drew 128 complaints, typically about braking or alerts with nothing in the way.

Service brakes (103), fuel and propulsion system (81), lane departure (69) and engine (63) followed. Propulsion complaints on a plug-in or electric Volvo can involve charging, range and loss of drive power.

The single park-outside recall is worth noting. A park-outside instruction means the manufacturer saw a fire risk serious enough to warn owners away from garages and carports until the repair is done. If you received a notice like that, every day you followed it is part of your story, and it is a good moment to talk to a lawyer.

Because so many of these systems are tied to software, an update may be the repair. When it does not hold, that update is still part of your repair history.

How a Volvo Lemon Law Claim Works

Volvo warranty work is handled by authorized Volvo retailers, the brand's name for its dealers. Some fixes now arrive by over-the-air update, which may not create a repair order. Each time the car goes to a retailer, ask for the printed repair order at pickup and read it before you leave. It should list your complaint in your words, the mileage and the dates in and out.

For updates you receive at home, keep your own log with the date, the software version shown in the car's settings, and whether the problem returned. Photos of error messages on the center screen are useful, and so is a short video when the camera drops out or the car brakes on its own.

When you talk to the service advisor, be concrete:

  • Describe what the car did, not what you think caused it.
  • Give the conditions: speed, temperature, whether it was charging or just started.
  • Say how many times it has happened since your last visit.
  • Ask that the complaint be written on the repair order even if it cannot be reproduced.

What we look for

Under Civil Code 1793.22, you are presumed to have a lemon if, within 18 months or 18,000 miles of delivery, the same problem was repaired 4 or more times, a defect likely to cause death or serious injury was repaired 2 or more times, or the vehicle was out of service for more than 30 days in total. You can still prove a case without it, since the presumption is one route and not the only one.

That step only affects the presumption if Volvo clearly and conspicuously disclosed it in the warranty or owner's manual, so read yours or send it to us.

In our experience, a software update meant to fix your complaint counts as a repair attempt. We see the same update applied several times without a lasting fix. We also find that a recall repair visit counts as an attempt, especially if you reported the problem before the recall came out.

Our advice is to call an attorney as soon as you get a recall notice, before the repair history gets confusing. You can learn more about the 30-day rule, which can matter when a Volvo waits weeks for parts.

If the claim succeeds, Volvo refunds what you paid, minus a mileage offset, or you may keep the car with a cash settlement. A willful violation can add a civil penalty of up to two times your actual damages, and the manufacturer pays attorney fees. Many recall-related cases resolve in about 1 to 3 months from the first call, and litigation takes longer. Prior results do not guarantee a similar outcome.

Popular Volvo Models We Handle

XC60

The midsize XC60 SUV, sold in mild hybrid and plug-in versions, shares the most Volvo recalls at 11 and has the most complaints, 400.

XC90

Volvo's three-row XC90 also has 11 recalls, along with 291 complaints.

XC40

The compact XC40 has 9 recalls and 249 complaints.

EX90

The EX90 is Volvo's three-row all-electric SUV. It has drawn 150 complaints since its release.

S60 and V60

The S60 sport sedan has 8 recalls and 82 complaints. The V60 wagon and V60 Cross Country have 7 recalls each.

C40

The electric C40 coupe SUV has 6 recalls and 73 complaints.

We also review S90 sedans and the newer EX30 and EX40 electric models. The newer electric Volvos have had several battery and software related recalls in a short time. If you drive one, check your VIN for open recalls and keep track of how long each fix takes. In our experience, the days you spend waiting for recall parts count toward the 30-day out-of-service total, and those days add up quickly.

California Lemon Law for Volvo Owners

The Song-Beverly Consumer Warranty Act protects Volvo owners and lessees in California. If Volvo or its authorized repair facilities cannot fix a warranty defect after a reasonable number of attempts, the manufacturer must repurchase or replace the vehicle (Civil Code 1793.2(d)).

A vehicle is presumed to be a lemon if, within 18 months or 18,000 miles of delivery, the same problem was repaired 4 or more times, a defect that could cause death or serious injury was repaired 2 or more times, or the vehicle was out of service for repairs for more than 30 days in total (Civil Code 1793.22). Many vehicles outside that window still qualify while they are under warranty. New, leased, certified pre-owned, demo and dealer vehicles can qualify; ordinary used cars without a new-car warranty generally no longer do after Rodriguez v. FCA US (2024).

What you can recover

  • Buyback: your down payment, payments, taxes and fees, minus a mileage offset, with the loan or lease paid off.
  • Replacement with a comparable new vehicle.
  • Cash and keep: a cash settlement while you keep the vehicle.
  • Civil penalty of up to two times your damages if the manufacturer willfully failed to comply (Civil Code 1794(c)).

What it costs

You pay nothing, win or lose. We are paid only if you win, and the manufacturer pays our fees, including in settlements. If a case is lost, our firm covers the costs.

Yes, if it is a warranty defect that Volvo has not fixed after a reasonable number of attempts. Over-the-air updates meant to fix it can count as repair attempts.

Is a Certified by Volvo car covered by lemon law?

It may be. Certified by Volvo cars carry a manufacturer warranty, and our firm reviews CPO, demo and dealer vehicles.

My Volvo camera goes black when I reverse. What should I do?

Take it to a Volvo retailer, describe exactly when it happens, and get a repair order. If it keeps coming back, call us.

How much does it cost to hire a Volvo lemon law attorney?

You pay nothing, win or lose. We are paid only if you win, and the manufacturer pays our fees, including in settlements. If a case is lost, our firm covers the costs.

Volvo Lemon Law — Your Rights

If your Volvo vehicle has a persistent defect that Volvo’s authorized dealers cannot repair after a reasonable number of attempts, California’s Song-Beverly Consumer Warranty Act may entitle you to a full refund or replacement. This applies to new and certified pre-owned vehicles still within the manufacturer’s original warranty period.

Under the lemon law presumption, you typically need four or more repair attempts for the same problem, two attempts for a safety defect, or 30 cumulative days in the shop. Volvo pays your attorney fees if your claim succeeds — you pay nothing out of pocket.

Did You Know?

The manufacturer — not you — is required to pay your attorney fees under Cal. Civ. Code § 1794(d) if your lemon law claim is successful. You pay nothing upfront and nothing out of pocket.
