Which has more lemon law problems in California, Volvo or Audi?

Short answer: Neither brand gets special treatment: California's lemon law covers new and leased Volvo and Audi vehicles the same way, and the manufacturer pays your attorney fees when you win. California owners of 2019 to 2027 models filed 171 Volvo and 343 Audi complaints with NHTSA (2021 to 2026), but raw counts mostly reflect how many of each are on the road. Volvo complaints center on the electrical system, then the collision warning and driver-assist systems; Audi complaints on the electrical system, then the collision warning and driver-assist systems. What decides a claim is your own repair history.

What California Volvo Owners Report

Volvo owners in California filed 171 NHTSA complaints about 2019 to 2027 models from 2021 to 2026. The electrical system led with 35, about one in five. Collision warning and driver-assist systems (27), brakes (22), lights, cameras and visibility (11) and the fuel and EV propulsion system (10) followed.

Volvo's SUVs account for most complaints. The Volvo XC40 had 45, the Volvo XC90 41 and the Volvo XC60 26. The new electric Volvo EX90 already had 17, and the Volvo S60 sedan had 15.

San Diego (13) topped the Volvo city list, ahead of San Francisco (7), Los Angeles (6), Sacramento (6) and the small foothill town of Pioneer (5). Volvo's top five areas are spread fairly evenly after the first two, with no single issue standing far above the rest.

Volvo's pattern leans toward safety technology: driver assist, brakes, and cameras and lights together outnumber the electrical category. If your Volvo has a camera or sensor fault that disables safety features, describe the warning exactly as it appears.

The Volvo data also includes 10 complaints in the fuel and EV propulsion category, which covers the brand's plug-in hybrid and electric models. If your Volvo is a plug-in hybrid or an EV, describe charging and power problems in detail each time you visit the dealer.

What California Audi Owners Report

Audi had 343 California complaints in the same window, about twice Volvo's total. The electrical system dominates, with 147 complaints, more than 4 in 10. The next categories are much smaller: collision warning and driver-assist systems (30), fuel and EV propulsion system (24), brakes (21) and engine (20).

The electric Audi e-tron drew the most complaints, 43. The Audi Q5 (34), Audi Q8 (29), Audi Q7 (29) and Audi A4 (28) followed closely, so Audi complaints are spread across EVs, SUVs and sedans.

Los Angeles (21) led the Audi city list. Irvine (11), San Jose (10), San Francisco (6) and Huntington Beach (6) followed. Orange County shows up twice in the top five, which simply reflects where many Audi owners live.

Because so many Audi complaints are electrical, it is worth knowing that one electrical fault can show up in many ways: a dead battery, a screen that freezes, warning lights or a car that will not start. Keep track of each symptom and its date.

The e-tron's position at the top of the list is notable because it is Audi's EV. Owners of gas Audis like the Q5, Q7 and A4 are more likely to have complaints grouped under engine or transmission, while e-tron complaints can involve charging and high-voltage systems.

Intermittent Electrical Problems and the Lemon Law

Both brands' top category is the electrical system. Electrical problems are often intermittent. They appear for a few days, vanish when the car reaches the dealer, then come back. That makes documentation the whole game.

A visit where the dealer says it could not duplicate the problem can still count. Oregel v. American Isuzu Motors (2001) held that the buyer does not have to prove the exact technical cause, and visits where the dealer could not find or fix the defect can be part of a reasonable number of attempts.

Take short videos or photos when the problem happens, showing the warning and the time. Bring them to the dealer and ask that they be noted on the repair order. Under Civil Code 1793.22(b), the presumption applies after 4 repairs of the same defect within 18 months or 18,000 miles, or more than 30 days in the shop, so consistent descriptions help the visits add up.

Some electrical faults affect safety, such as a failure that disables headlights or braking assistance. Those can fall under the two-repair path for defects likely to cause death or serious injury.

When you drop the car off, ask the service advisor to keep the car long enough to try to reproduce the problem, especially if it only happens on a cold start or after the car sits overnight. A same-day visit that ends with no test drive is less useful to you than a visit where the technician actually tried to find the fault.

How Claims Work Against Volvo Car USA and Volkswagen Group of America

A Volvo claim usually names Volvo Car USA, LLC. An Audi claim usually names Volkswagen Group of America, Inc., because Audi is part of that group in the United States. Both brands repair vehicles through franchised dealers.

The dealer is not usually the main party in a lemon law claim; the manufacturer is responsible for the warranty. But the dealer's records are the main evidence. Ask for every repair order before you leave, and check that the mileage, dates and your complaint are correct.

For many claims against manufacturers that opted in to AB 1755, Code of Civil Procedure 871.20 and the sections after it add pre-lawsuit written notice, early document exchange and mediation steps. Your attorney handles those deadlines. If you win, Civil Code 1794(d) requires the manufacturer to pay your attorney fees.

Some owners first try the manufacturer's customer care line. That is fine, and it can create a useful record. Keep the case number, the date and the name of the person you spoke with, and follow up in writing so there is a copy of what you reported.

  • Volvo: Volvo Car USA, LLC
  • Audi: Volkswagen Group of America, Inc.
  • Both: repairs at franchised dealers
  • Both: the manufacturer, not you, pays attorney fees when you win

Example: An Audi Q5 With a Battery That Keeps Dying

This is a hypothetical example. Nate bought a new 2023 Audi Q5 in Huntington Beach. Starting at about 4,000 miles, the car sometimes would not start in the morning, and the screen showed several warnings at once.

On the first visit, the dealer tested the battery and found nothing wrong. Nate began taking photos of the dash each time. The second visit ended with a new battery. On the third, it updated software. On the fourth, it replaced a control module. Each repair order described the same no-start complaint.

After the fourth visit within 18 months, Nate called a lemon law attorney. The attorney counted the visit where nothing was found, reviewed whether the manual required direct notice to Volkswagen Group of America, and sent a repurchase demand under Civil Code 1793.2(d)(2). This example does not predict any real outcome.

Nate's photos helped because they showed the date, the mileage on the dash and the warnings, all in one image. He also saved the receipt for a jump start and a tow on a morning the car would not start, since a buyback includes incidental costs like towing under Civil Code 1793.2(d)(2)(B).

Why 343 Versus 171 Does Not Rank These Brands

Audi's 343 complaints are about double Volvo's 171. That is not a reliability ranking. Raw counts are not adjusted for how many of each brand are sold in California, and the two brands have different lineups and different numbers of EVs on the road.

Owners also report differently. Some file a federal complaint at the first warning light. Others only call the dealer. Every complaint is the owner's own report, not a verified defect, and one complaint can list more than one problem area.

Shares are more telling than totals here. The electrical system is about one in five Volvo complaints and more than 4 in 10 Audi complaints. Even so, that pattern does not tell you anything certain about your own car.

Timing matters too. These numbers cover complaints filed from 2021 to 2026 about 2019 to 2027 models. A newer model like the Volvo EX90 has had much less time on the road to collect reports, so its 17 complaints are not comparable with a model that has been sold for years. If you own a newer model, focus entirely on your own records.

Documents to Keep for a Volvo or Audi Claim

Start a single folder, paper or digital, and keep everything in it. Ask the dealer for a printed service history on your VIN if you are missing any visits. If you used an app to schedule service, save screenshots of each appointment.

Keep making loan or lease payments while your claim is pending. And be aware of timing: warranty claims generally must be brought within four years under Commercial Code 2725, but the rules are technical, so a free case review early on is the safest step.

If your Volvo or Audi was bought as a certified pre-owned car, say so when you ask for a review. Under Rodriguez v. FCA US LLC (2024), a used car sold with only the balance of the factory warranty is generally not a new motor vehicle under the lemon law's vehicle section, but used and CPO buyers may still have claims under other warranties or laws.

Key Facts (as of October 2026)

  • Complaint counts are California owner reports to NHTSA for 2019 to 2027 model years, filed 2021 to 2026. They are not verified defects and are not adjusted for sales.
  • Both brands' most-reported areas include the collision warning and driver-assist systems and electrical system.
  • For either brand, a reasonable number of repair attempts is presumed within 18 months or 18,000 miles after 2 tries for a serious safety defect, 4 tries for the same defect, or more than 30 days in the shop (Civil Code 1793.22(b)).
