Which has more lemon law problems in California, Genesis or Lexus?

Short answer: Neither brand gets special treatment: California's lemon law covers new and leased Genesis and Lexus vehicles the same way, and the manufacturer pays your attorney fees when you win. California owners of 2019 to 2027 models filed 82 Genesis and 209 Lexus complaints with NHTSA (2021 to 2026), but raw counts mostly reflect how many of each are on the road. Genesis complaints center on the electrical system, then the fuel and EV propulsion system; Lexus complaints on the airbags, then the brakes. What decides a claim is your own repair history.

What California Genesis Owners Report

Genesis is a young luxury brand, and its California complaint total is small: 82 NHTSA complaints about 2019 to 2027 models, filed from 2021 to 2026. The electrical system led with 25, close to a third. The fuel and EV propulsion system (11), transmission and powertrain (10), collision warning and driver-assist systems (6) and engine (5) followed.

Genesis complaints are spread across its SUV lineup. The Genesis GV70 had 21, the Genesis GV80 20 and the electric Genesis GV60 17. The Genesis G80 sedan had 14 and the Genesis G70 had 7.

Los Angeles (5) led the Genesis city list, with San Diego, San Francisco, Westminster and San Bernardino at 4 each. Westminster's spot near the top is a reminder that these lists reflect where owners live, not where problems start.

The fuel and EV propulsion category is second for Genesis, which fits a lineup that includes the all-electric GV60 and electrified versions of other models. If your Genesis is electric, describe charging and power problems as specifically as you can at every dealer visit.

With only 82 complaints in total, a few owners can reshape the Genesis picture. Read the numbers as a loose outline, not a measure of any model's quality.

What California Lexus Owners Report

Lexus owners filed 209 California complaints in the same window, about two and a half times the Genesis total. Airbags are the standout category, with 51 complaints. Brakes (25), the electrical system (19), the engine (15) and lights, cameras and visibility (15) follow.

The Lexus RX is the most complained-about Lexus by a wide margin, with 76 complaints. The Lexus ES had 34, the Lexus NX 33, the Lexus TX 17 and the Lexus GX 8.

Lexus complaints came most often from Los Angeles (9), then San Jose (7), San Diego (6), Riverside (5) and Irvine (4). Southern California makes up four of the five cities.

The contrast with Genesis is clear. Genesis owners report electrical and propulsion issues first, while Lexus owners report airbags first. Those are very different kinds of problems, and they lead to different questions when you talk to an attorney: is the defect a safety issue, and how many times has it been repaired?

The newer Lexus TX, a three-row SUV, already has 17 complaints. Because it has been on sale for less time than the RX or ES, its number is not directly comparable. If you own a TX, your own repair history will tell you far more than the brand chart does.

Airbag Faults Versus Electrical Faults: Why the Category Matters

An airbag defect is about as clear a safety issue as there is. If an airbag warning light stays on, the system may not work in a crash. Under Civil Code 1793.22(b), a defect likely to cause death or serious injury that has been repaired 2 or more times within 18 months or 18,000 miles creates a presumption that the manufacturer had a reasonable number of attempts.

Many electrical faults are not safety defects on their own. A screen that reboots is frustrating but may not be dangerous. For those problems, the presumption usually needs 4 or more repairs of the same defect or more than 30 total days in the shop. Some electrical problems do affect safety, such as a fault that disables headlights or a power loss on an EV.

The presumption is a shortcut, not a requirement. A claim can still succeed outside 18 months or 18,000 miles if the defect first showed up under warranty. And if your owner's manual clearly requires you to notify the manufacturer directly, do so in writing for the two-repair and four-repair paths.

Whatever the category, the remedy is the same. Under Civil Code 1793.2(d)(2), the manufacturer must replace or repurchase a vehicle it cannot fix after a reasonable number of attempts, and you can choose the buyback.

Who You Claim Against: Genesis Motor America and Toyota Motor Sales

A Genesis claim usually names Genesis Motor America LLC. A Lexus claim usually names Toyota Motor Sales, U.S.A., Inc., because Lexus is Toyota's luxury brand in the United States. Both brands repair cars through franchised dealers.

Some Genesis and Lexus owners use valet pickup or a dealer loaner during repairs. Those conveniences are welcome, but they can make it easy to forget the paperwork. Each time your car is picked up or dropped off for a warranty repair, make sure a repair order is opened and that you get a copy.

For many claims against manufacturers that opted in to AB 1755, Code of Civil Procedure 871.20 and the sections after it add pre-lawsuit written notice, early exchange of documents and mediation. Your attorney handles those steps and their deadlines.

Either way, the manufacturer pays your attorney fees, costs and expenses when you win under Civil Code 1794(d).

If you leased your Genesis or Lexus, the claim works the same way. Leased vehicles are covered by California lemon law too; in a lease buyback, what you paid is typically refunded and the lease is paid off. Keep the lease agreement with your repair orders.

  • Genesis: Genesis Motor America LLC
  • Lexus: Toyota Motor Sales, U.S.A., Inc.
  • Both: franchised dealer repairs
  • Both: valet and loaner visits still need repair orders

Example: A GV60 That Will Not Charge

This is a made-up example. Helen bought a new 2023 Genesis GV60 in Westminster. About three months in, the car began refusing to charge at home and at public chargers, and a warning appeared on the dash.

A valet driver picked the car up for the first visit, and the dealer updated software. The problem came back within weeks. On the second visit, the dealer replaced a charging component and kept the car 16 days. On the third visit it stayed 17 more days.

Helen had kept every repair order, the valet pickup receipts and screenshots of failed charging sessions. Her attorney counted 33 days out of service within 18 months, one path under Civil Code 1793.22(b), and sent a repurchase demand to Genesis Motor America LLC.

Helen kept paying her loan the whole time. Her attorney also looked at her rental and rideshare costs, since a buyback includes incidental damages. This is an illustration only and does not predict any real result.

Helen never had to explain why the charging system failed. Her role was to report each failure, let the dealer try to fix it, and keep copies. Finding the root cause was the manufacturer's job, not hers.

Why 82 Versus 209 Does Not Rank These Brands

It would be easy to read Lexus's 209 complaints against Genesis's 82 as a sign that one brand is better built. The numbers cannot support that. Raw counts are not adjusted for how many vehicles each brand has sold in California, and Lexus has many more cars on the road.

Genesis is also newer, so some of its models have had less time to collect reports. A model sold for six years will usually have more complaints than one sold for two.

NHTSA complaints are owner reports, not verified defects, and many owners never file one. The only numbers that truly matter for your claim are your own: repair visits, days in the shop and the mileage at the first visit.

If your car's problem is not in either brand's top list, that does not hurt you. The law looks at your vehicle, not at what other owners report.

There is also the question of who files. Some owners report to NHTSA after the first scare; others work only with the dealer and never file. A brand whose buyers lean one way or the other will show a different total for reasons that have nothing to do with build quality.

Next Steps for Genesis and Lexus Owners

Check your VIN on the NHTSA recall site first. Recall repairs count as repair attempts, and a recall shows the manufacturer itself identified a problem. Then collect your paperwork and request a free case review.

You pay $0 out of pocket for a lemon law case. Keep making loan or lease payments throughout, and do not wait too long: warranty claims generally must be brought within four years under Commercial Code 2725, and the rules on when that clock starts are technical.

Before the review, write a one-page timeline: the date you bought the car, when the problem started, each repair visit with the mileage, and how many days the car was at the dealer each time. A clear timeline makes the first conversation faster and helps the attorney spot which path under the presumption may fit.

If you are thinking about trading the car in, talk to an attorney before you do. Under Martinez v. Kia Motors America (2011), you do not have to still own the vehicle to pursue lemon law remedies, but the claim is easier to organize while the car and the paperwork are in one place.

  • Purchase or lease contract
  • Every repair order, including valet and loaner visits
  • Charging screenshots or warning light photos
  • Rental, rideshare and towing receipts
  • Recall letters and recall repair orders

Signs Your Genesis May Qualify

  • Your Genesis has been in for the electrical system 2 or more times and it is a safety issue
  • The same Genesis problem has been repaired 4 or more times
  • Your Genesis has been out of service more than 30 days for warranty repairs
  • You own a Genesis GV70 and the problem keeps coming back

Signs Your Lexus May Qualify

  • Your Lexus has been in for the airbags 2 or more times and it is a safety issue
  • The same Lexus problem has been repaired 4 or more times
  • Your Lexus has been out of service more than 30 days for warranty repairs
  • You own a Lexus RX and the problem keeps coming back

Key Facts (as of October 2026)

  • Complaint counts are California owner reports to NHTSA for 2019 to 2027 model years, filed 2021 to 2026. They are not verified defects and are not adjusted for sales.
  • The two brands' top problem areas differ: Genesis owners report the electrical system most, Lexus owners the airbags.
  • For either brand, a reasonable number of repair attempts is presumed within 18 months or 18,000 miles after 2 tries for a serious safety defect, 4 tries for the same defect, or more than 30 days in the shop (Civil Code 1793.22(b)).
