On [XXX], while driving on a state highway with my family—including my [XXX] and [XXX] children—the vehicle suddenly and without warning limited its speed to 35 MPH. This created an immediate and dangerous situation on a high-speed road, significantly increasing the risk of a rear-end collision. I was unable to accelerate beyond this limit, forcing me to pull over abruptly and navigate traffic hazards. This incident could have resulted in a serious accident or injury. I immediately reported this issue to Lucid Customer Care and took the vehicle to an authorized Lucid service center. The vehicle was out of service for 25 days (February 23, 2025 – March 19, 2025) for diagnostics and repairs. Ongoing Safety Concerns & Lack of Response from Lucid Motors Since this incident, I have repeatedly contacted Lucid Motors Customer Care, but I have received no clear response regarding the cause of this dangerous failure or any assurance that this will not happen again. Furthermore: My vehicle has experienced a total of 45 days of downtime in the first 10 months of my lease due to various mechanical failures, including a heating system failure ([XXX]). Lucid has failed to provide a resolution or clear direction regarding my attempts to return the vehicle. I have lost confidence in the safety of this vehicle and am concerned that this issue may impact other Lucid Air vehicles on the road. Request for NHTSA Investigation Given the seriousness of this defect, I am requesting that NHTSA investigate this issue to determine: Whether other Lucid Air vehicles have experienced sudden speed limitation issues. If this defect poses an ongoing safety risk to drivers and passengers. Whether Lucid Motors is adequately addressing and communicating these defects to consumers. I believe this defect could pose a serious INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)” (NHTSA Complaint #11649614)

Advanced driver assistance system (ADAS) defects — including malfunctioning forward collision warnings, lane keep assist failures, and erratic automatic emergency braking — can create dangerous driving conditions. The 2023 Lucid Air has 1 NHTSA complaint for this defect type. Owner reports include: “The contact owned a 2023 Lucid Air. The contact stated that while driving at 20 MPH, the vehicle in front started to brake; therefore, the contact depressed the brake pedal. The vehicle then, instead of decreasing in speed it accelerated independently. As a result, the contact crashed into the rear of the vehicle in front. The impact then caused the vehicle crashed into the rear to crash into the vehicle in front of it. Another vehicle on the side lane was also impacted due to the crash. The contact stated that the air bags deployed. The contact stated that he sustained bruises to both legs. Medical attention was required. Another unknown occupant was injured, but no further information was available. A police report was filed.  The contact stated that the failure was not diagnosed by a dealer or independent mechanic. The vehicle was towed to an unknown body shop, and then the vehicle was towed to Ace Auto Body. The manufacturer was notified of the failure, and they informed him that they were not responsible for the failure. The contact mentioned the vehicle was deemed a total loss. The approximate failure mileage was 20,000. The VIN was invalid.” (NHTSA Complaint #11696405)

Risk: Power loss will shut down electric motors, causing a loss of drive power and increasing the risk of a crash.

Risk: A rearview camera image that does not display while in reverse decreases the driver’s visibility, increasing the risk of injury or crash.

Risk: Inoperative windshield wipers can reduce visibility, increasing the risk of a crash.

Risk: Overheated rear seats can increase the risk of a burn injury.

Component: VISIBILITY:DEFROSTER/DEFOGGER/HVAC SYSTEM

Defect: See NHTSA database for details.

Risk: A high voltage coolant heater that fails to defrost the windshield can reduce the driver’s view, increasing the risk of a crash.

Remedy: Lucid will update the software to identify a high voltage coolant heater failure and provide a warning to the driver. High voltage coolant heaters that fail will be replaced. California Lemon Law — Song-Beverly Act

California’s Song-Beverly Consumer Warranty Act (Cal. Civ. Code §§ 1790–1795.8) is one of the strongest lemon laws in the United States. It protects buyers and lessees of new and certified pre-owned vehicles that develop substantial defects the manufacturer cannot repair after a reasonable number of attempts.

Under Cal. Civ. Code § 1793.22, a lemon law presumption is triggered when any of the following apply to your 2023 Lucid Air:

  • 4+ repair attempts for the same non-safety defect without resolution
  • 2+ repair attempts for a defect likely to cause death or serious bodily injury
  • 30+ calendar days out of service for warranty repairs (cumulative, not consecutive)

Once the presumption is triggered, the burden shifts to Lucid to prove the vehicle is not a lemon. Under Cal. Civ. Code § 1794(d), Lucid must pay your attorney’s fees if you prevail — meaning qualified representation costs you nothing out of pocket.

Steps to Protect Your 2023 Lucid Air Claim

Step 1: Document every repair visit. Keep all repair orders, work orders, and dealer invoices. Each visit counts as a repair attempt, even if the dealer says nothing is wrong.

Step 2: Keep returning for repairs. You must give Lucid a reasonable opportunity to fix the defect. Visit different authorized Lucid dealers if needed and ask for written documentation of each visit.

Step 3: Contact a California lemon law attorney. Once you believe the threshold has been met — 4 attempts for non-safety defects, 2 for safety defects, or 30 days out of service — contact an attorney for a free case evaluation. Under § 1794(d), Lucid pays your fees if you win.

2023 Lucid Air Lemon Law Questions

How many repair attempts qualify my 2023 Lucid Air as a lemon?

Under Cal. Civ. Code § 1793.22, four or more repair attempts for the same non-safety defect, or two attempts for a safety-related defect, triggers the lemon law presumption. Additionally, 30 or more cumulative days out of service qualifies regardless of the number of repair attempts.

NHTSA complaints support the claim by establishing a pattern, but are not a prerequisite.

What is the time limit to file a lemon law claim for my 2023 Lucid Air?

California lemon law claims are generally subject to a four-year statute of limitations from the date you discovered or should have discovered the defect.
