Engine

High Claim VolumeSong-Beverly Strength: Very Strong

Engine and cooling problems are among the most serious defects under California’s Song-Beverly Act. Owners of the 2022 Kia Soul have reported issues including stalling, overheating, loss of power, rough idling, excessive oil consumption, and check engine lights that return after dealer repairs. With 20 NHTSA complaints on record, this defect pattern is well-documented. Owner reports include: “Vehicle is only 4 years old. Engine light came on. I used my Fixd code reader to diagnose. It mentioned several sensors which I replace cam shaft sensor. Intake sensor. Crank shay sensor. All were replaced, engine light came back on after each replacement. I took it to dealership for service and diagnosis. They indicated engine replacement due to timing being out of line; sheared king pin. Vehicle has been serviced regularly. Never anticipated having to replace an engine on a four year old vehicle. Still making payments and now $9,000 repair is Absurd! Additionally, these symptoms are consistent with similar symptoms listed in other kia soul recalls. This is my second Kia but probably will be my last if the manufacturer does not rectify this problem. Codes: P0017, P000B, P0068, P0014” (NHTSA Complaint #11723229)

Moderate Claim VolumeSong-Beverly Strength: Strong

Engine and cooling problems are among the most serious defects under California’s Song-Beverly Act. Owners of the 2022 Kia Soul have reported issues including stalling, overheating, loss of power, rough idling, excessive oil consumption, and check engine lights that return after dealer repairs. With 15 NHTSA complaints on record, this defect pattern is well-documented. Owner reports include: “The contact owns a 2022 Kia Soul. The contact stated that the vehicle was consuming an excessive amount of engine oil. Additionally, the contact stated that the low oil pressure warning light failed to illuminate while the engine oil level was significantly low. The vehicle was taken to the dealer, where an oil consumption test was performed. The contact stated that on the first test, the vehicle had consumed 1.1 quart of oil after 1,946 miles. The contact stated that on the second test, the vehicle had consumed 1/2 quart of oil after 1,047 miles. The dealer informed the contact the oil consumption test met the manufacturer’s guidelines, and the contact was referred to the manufacturer for assistance. The manufacturer was contacted but no assistance was provided. The failure mileage was approximately 51,000.” (NHTSA Complaint #11686390)

Powertrain

Moderate Claim VolumeSong-Beverly Strength: Moderate

Powertrain and transmission defects directly impair the vehicle’s core function and are generally considered substantial defects under California lemon law. Owners of the 2022 Kia Soul have reported harsh shifting, shuddering, slipping, and transmission warning lights. 5 NHTSA complaints have been submitted for this defect category. Owner reports include: “Check engine light came on so I took the car to a mechanic who scanned the vehicle and found diagnostic trouble code P0017 (Crankshaft Position – Camshaft Position Correlation). This code indicates a timing issue that could be related to a timing chain or camshaft sensor malfunction. The car only has 92,000 miles and is less than 10 years old, I bought it pre-owned. I contacted KIA corporate and was told to take the car to a dealership for evaluation, but the dealership refused to inspect the car without a $250 diagnostic fee, stating it was not covered because the vehicle was purchased used. My understanding is that powertrain issues like this should be covered under warranty, and this may relate to existing recalls such as Recall SC336, which concerns engine performance and safety. This could pose a serious safety risk if the engine fails while driving.” (NHTSA Complaint #11676696)

Engine and cooling problems are among the most serious defects under California’s Song-Beverly Act. Owners of the 2022 Kia Soul have reported issues including stalling, overheating, loss of power, rough idling, excessive oil consumption, and check engine lights that return after dealer repairs. With 3 NHTSA complaints on record, this defect pattern is well-documented. Owner reports include: “My 2022 Kia Soul experienced a sudden loss of motive power and stalling while driving, creating a high risk for a rear-end collision in traffic. An authorized Kia dealership (Mike Miller Kia) performed a major timing repair in March 2025 [XXX] ) to address these safety issues. However, the exact same failure occurred again in January 2026. The dealership now documents that the engine was 4 quarts low on oil, nearly empty, despite proper maintenance. This indicates a severe oil consumption defect that leads to timing failure and unpredictable engine stalls. I believe this vehicle poses an unreasonable safety risk due to this recurring stalling condition, which matches the defect described in NHTSA Recall 25V099 (SC336), though my VIN is currently excluded. With 3 NHTSA complaints on record, this defect pattern is well-documented. Owner reports include: “I had this car go to the garage back in February under the 2021-2023 Seltos and Soul engine recall. The engine was fine but the check engine light is has been on since MARCH. I personally believe this was software related as I had MULTIPLE technicians verify the sensor and wiring is still in top shape. My OBD2 Reader shows the engine is pulling a large amount of retarded timing and it only happens under acceleration.” (NHTSA Complaint #11680309)

California Lemon Law — Song-Beverly Act

California’s Song-Beverly Consumer Warranty Act (Cal. Civ. Code §§ 1790–1795.8) is one of the strongest lemon laws in the United States. It protects buyers and lessees of new and certified pre-owned vehicles that develop substantial defects the manufacturer cannot repair after a reasonable number of attempts.

Under Cal. Civ. Code § 1793.22, a lemon law presumption is triggered when any of the following apply to your 2022 Kia Soul:

  • 4+ repair attempts for the same non-safety defect without resolution
  • 2+ repair attempts for a defect likely to cause death or serious bodily injury
  • 30+ calendar days out of service for warranty repairs (cumulative, not consecutive)

Once the presumption is triggered, the burden shifts to Kia to prove the vehicle is not a lemon. Under Cal. Civ. Code § 1794(d), Kia must pay your attorney’s fees if you prevail — meaning qualified representation costs you nothing out of pocket.

What You Can Recover

If your 2022 Kia Soul qualifies as a lemon under California law, Kia may be legally required to:

  • Repurchase your vehicle — Full refund of your down payment, all monthly payments, registration fees, and incidental costs (towing, rentals), minus a mileage offset for miles driven before the first repair attempt
  • Replace your vehicle — Provide a new, comparable vehicle at no cost to you
  • Pay your attorney’s fees — Under § 1794(d), Kia pays all legal fees if you prevail
  • Civil penalty up to 2x damages — If Kia willfully violated the Act, courts may award double the actual damages

Steps to Protect Your 2022 Kia Soul Claim

Step 1: Document every repair visit. Keep all repair orders, work orders, and dealer invoices. Each visit counts as a repair attempt, even if the dealer says nothing is wrong.

Step 2: Keep returning for repairs. You must give Kia a reasonable opportunity to fix the defect. Visit different authorized Kia dealers if needed and ask for written documentation of each visit.

Step 3: Contact a California lemon law attorney. Once you believe the threshold has been met — 4 attempts for non-safety defects, 2 for safety defects, or 30 days out of service — contact an attorney for a free case evaluation. Under § 1794(d), Kia pays your fees if you win.

Step 4: Send a demand letter. Your attorney will send Kia a formal demand letter. Most California lemon law cases resolve through negotiation without going to trial.

2022 Kia Soul Lemon Law Questions

How many repair attempts qualify my 2022 Kia Soul as a lemon?

Under Cal. Civ. Code § 1793.22, four or more repair attempts for the same non-safety defect, or two attempts for a safety-related defect, triggers the lemon law presumption. Additionally, 30 or more cumulative days out of service qualifies regardless of the number of repair attempts.

Does Kia pay my attorney fees?

Yes. Under Cal. Civ. Code § 1794(d), Kia is required to pay your reasonable attorney’s fees and court costs if you prevail in a lemon law claim. This means qualified lemon law representation is free to you if your case succeeds.

Can I file a lemon law claim without an active recall?

Yes. A recall is not required to file a lemon law claim. The Song-Beverly Act covers any substantial defect that impairs the use, value, or safety of the vehicle that the manufacturer cannot repair after a reasonable number of attempts. NHTSA complaints support the claim by establishing a pattern, but are not a prerequisite.

What is the time limit to file a lemon law claim for my 2022 Kia Soul?

California lemon law claims are generally subject to a four-year statute of limitations from the date you discovered or should have discovered the defect. However, you must still be within the manufacturer’s original warranty period when the defect first appears. Contact an attorney promptly to preserve your rights.
