Should I file with BBB AUTO LINE or hire a lemon law attorney?
Short answer: It depends on how much help you want. BBB AUTO LINE is a free program used by several brands, and the decision binds the manufacturer only if you accept it, so you can say no and keep your claim. But you usually present the case yourself, against a manufacturer that does this often. A lemon law attorney also costs you nothing out of pocket in California, since the manufacturer pays the fees when you win, and handles the whole claim. For a Song-Beverly claim, BBB AUTO LINE is generally not required first.
Side-by-Side Comparison
| BBB AUTO LINE | Lemon law attorney | |
|---|---|---|
| Cost | Free | Nothing out of pocket; the manufacturer pays fees when you win |
| Who prepares your case | Usually you | Your attorney |
| Brands covered | Several manufacturers take part | Any manufacturer |
| If you do not like the result | You can reject it; it binds the manufacturer only if you accept | You decide whether to accept any offer |
| Required first? | Generally not before a California Song-Beverly claim | You can start here |
| Federal warranty claims | May be required first for a Magnuson-Moss claim if your warranty requires a qualifying program | Your attorney checks what applies |
How BBB AUTO LINE Works
BBB AUTO LINE is a dispute resolution program that several vehicle manufacturers use for warranty complaints. You file a claim describing the defect and repair history, and the program tries to help you and the manufacturer reach an agreement.
If there is no agreement, the case may go to a hearing in front of an arbitrator. The arbitrator considers the documents and what each side says, and then issues a written decision. The program is free to the consumer.
A key feature is how the decision works. It binds the manufacturer if you accept it, but it does not bind you. If you reject the decision, you can still pursue your lemon law claim in other ways.
Your warranty booklet or owner's manual should tell you whether your manufacturer uses BBB AUTO LINE or another program. The BBB AUTO LINE website also explains how the process works step by step.
The program is designed so that consumers can use it without a lawyer. Forms are written for regular people, and staff explain the steps. That makes it a reasonable option for some owners with simple, well-documented claims.
Keep in mind that the manufacturer has experience with the program and knows how to present its side. You will be making your case to the arbitrator, usually without anyone on your side who does this every day.
How a Lemon Law Attorney Handles the Same Problem
A lemon law attorney takes over the claim from the start. The attorney collects repair orders, reviews your contract, calculates what a buyback should include and presents the claim to the manufacturer.
For manufacturers that opted in to AB 1755, many claims follow pre-lawsuit steps under Code of Civil Procedure 871.20 and following, including written notice, early document exchange and mediation. Your attorney handles those steps and their deadlines.
If the manufacturer will not resolve the claim, the attorney can file in Superior Court. That brings formal discovery, the chance of a jury trial and, if the court finds a willful violation, a possible civil penalty of up to two times actual damages (Civil Code 1794(c)).
The cost to you is $0 out of pocket in a typical case. Under Civil Code 1794(d), the manufacturer pays the buyer's attorney fees and costs when the buyer wins.
An attorney also deals with the manufacturer's lawyers, so you do not have to. Many people find that the biggest relief is not having to argue about their car with a company that handles these claims every day.
Your attorney will also check whether the restitution being offered includes everything the law allows, such as sales tax, registration fees and reasonable incidental costs. Those details are easy to miss when you are handling a claim yourself.
What the Law Says About Using a Program First
For a California Song-Beverly claim, using a manufacturer program like BBB AUTO LINE is generally not required before filing. Many buyers skip it and go straight to an attorney.
Federal law is different in one respect. Under the Magnuson-Moss Warranty Act, if the written warranty requires a qualifying informal dispute program, you may have to use it first before bringing a Magnuson-Moss claim. That act also lets a winning consumer recover attorney fees (15 U.S.C. 2310(d)(2)).
California also oversees manufacturer arbitration programs through the Department of Consumer Affairs Arbitration Certification Program. Its website explains how certified programs are supposed to work and what consumers can expect.
Because both state and federal rules can apply, ask a lemon law attorney before you file with any program. The review is free, and it helps you decide whether the program fits your goals.
One more point: the program and a lemon law claim are not either-or forever. You can start with the program and still hire an attorney later, as long as you have not accepted a decision that limits your options and no deadline has passed.
If your warranty booklet mentions a dispute program, read that section closely and bring it to your case review.
Example: Trying the Program, Then Getting Help
This is a made-up example. Omar bought a new minivan with a sliding door that kept failing to close. After three repairs, he filed with BBB AUTO LINE on his own because he saw it mentioned in his warranty booklet.
At the hearing, the manufacturer's representative said the door had been fixed on the last visit. Omar brought his repair orders but was not sure how to explain why the problem was the same defect each time. The arbitrator's decision offered another repair attempt.
Omar rejected the decision, which he was allowed to do because it did not bind him. He then contacted a lemon law attorney, who reviewed the repair orders and explained how the repeat visits might count under Civil Code 1793.22(b).
This example is made up and only shows the order of events. It does not mean the program is unfair or that an attorney would get a different result. It shows why it helps to know your options before you start.
Omar's attorney also told him that the time spent in the program had not ruined his claim, but that he should not wait any longer. The attorney began the pre-lawsuit steps that applied to his manufacturer the following week.
The main takeaway is that the program and an attorney can both be part of the story. What matters is knowing what each one can and cannot do before you start.
How to Prepare if You Use BBB AUTO LINE
If you decide to try the program, preparation makes a big difference. Arbitrators decide based on what is in front of them, so organized records help your case.
Write a one-page summary of what went wrong, in your own words. Keep it factual and short, and point to the repair orders that support each statement.
Before you accept any decision, read it closely and consider talking to a lemon law attorney. Accepting a decision can affect what you can pursue later.
After the hearing, keep a copy of the written decision and any letters from the program. If you later talk to an attorney, those papers show exactly what was offered and what you said.
If you are unsure whether to accept a decision, ask the program how long you have to respond, and use that time to get a free review.
- Every repair order, in date order
- A timeline with dates, mileage and days out of service
- Your purchase or lease contract
- Receipts for towing, rental cars or other costs
- Photos or videos of the problem, if you have them
Questions to Ask Before You Decide
The right choice depends on your goals and comfort level. A few questions can help you sort it out.
Do you want to present the case yourself? In the program, you usually do. With an attorney, someone else handles the presentation and the negotiation.
What result are you after? If you want a full buyback that includes taxes, fees, incidental costs and a loan payoff under Civil Code 1793.2(d)(2)(B), ask whether the program is likely to give you that, and compare it with what an attorney would pursue.
Is your manufacturer disputing the defect? When a manufacturer insists the car is fixed or that nothing is wrong, having an attorney who can request records and, if needed, file a lawsuit may matter more.
Finally, is time a factor? Warranty claims generally have a four-year statute of limitations under Commercial Code 2725, so ask how long the program typically takes before you rely on it.
There is no wrong answer to these questions. Some people value doing it themselves, and others value having someone handle it. The goal is to pick the path that fits you.
You can read about the program directly on the BBB AUTO LINE website before deciding.
Common Mistakes With Manufacturer Programs
Manufacturer programs can work well for some owners, but a few mistakes come up again and again. Knowing them in advance helps you use the program wisely or decide to skip it.
One mistake is going in without complete records. If a repair order is missing, the manufacturer may argue that a visit never happened or was for a different problem. Gather every order before you file.
Another mistake is accepting a decision too quickly. Some decisions offer one more repair attempt or a partial remedy. If you accept, you may limit what you can pursue later, so take time to think it over.
A third mistake is assuming the program is required. For a California Song-Beverly claim it generally is not. Some people delay getting help because they think they must finish the program first.
A fourth mistake is stopping loan or lease payments while the program is pending. Keep paying. Missed payments can hurt your credit and lead to repossession, no matter how strong your claim is.
Finally, some owners forget that the clock keeps running. Using a program does not pause every deadline, so ask an attorney about timing before you rely on it.
