You bought a Genesis expecting a quiet, polished luxury car, and instead you are scheduling another Service Valet pickup for the same warning message. This page is for California owners and lessees of the GV70, GV80, GV60, G70, G80, G90 and the Electrified models who are wondering whether their vehicle is a lemon.
California's Song-Beverly Consumer Warranty Act (Civil Code sections 1790 to 1795.8) requires a manufacturer that cannot fix a warranty defect after a reasonable number of attempts to replace the vehicle or buy it back. That applies to Genesis vehicles bought or leased new in California, and we also take certified pre-owned, demo and dealer vehicles sold with a new-car warranty. Ordinary used purchases with only the leftover factory warranty generally no longer qualify after the California Supreme Court's 2024 ruling in Rodriguez v. FCA US LLC.
Genesis Warranty Coverage and Lemon Law
Genesis lists these terms on its official U.S. site for new vehicles:
- New Vehicle Limited Warranty: bumper-to-bumper coverage for 5 years or 60,000 miles.
- Powertrain Limited Warranty: the engine and transmission of gas models for 10 years or 100,000 miles.
- EV battery: repair or replacement of the EV battery for 10 years or 100,000 miles.
- Complimentary Scheduled Maintenance: 3 years or 36,000 miles, whichever comes first.
- Service Valet: a three-year subscription. Genesis says it can pick up your vehicle from your home or office for service at your nearest Genesis retailer, and a courtesy loaner may be available.
Some third-party sources say the long powertrain term is reduced for later owners. We could not confirm that on Genesis's site, so check the warranty booklet if you bought your Genesis from someone else. The same goes for Genesis Certified Pre-Owned coverage and the corrosion terms: read the documents from your own purchase for exact numbers.
The 5-year bumper-to-bumper term matters most here. Song-Beverly claims rest on defects covered by the express warranty, and the electrical, software and driver-assist problems that dominate Genesis complaints are basic-warranty items. A long warranty gives you time, but not unlimited time. The sooner a problem is on a repair order, the stronger your position.

Common Genesis Problems in Recalls and Complaints
According to NHTSA recall and complaint data, Genesis has issued 27 recalls since the 2021 model year. Owners have also filed 1,063 complaints with NHTSA about vehicles from those years. Remember that a complaint reflects an owner's experience, not a confirmed defect.
The electrical system leads the recalls
The electrical system is the most frequent recall component, with 8 recalls. Several of these involve the instrument cluster, the digital display behind the steering wheel that shows speed and warning lights. Examples include an instrument cluster recall covering the G80, GV70 and GV80 and a G90 driver-assistance recall. The gasoline fuel system and seat belts follow with 6 recalls each, including a fuel hose and fitting recall on four models. The power train has 2, and service brakes, engine and engine cooling, back over prevention and structure have 1 each.
One Genesis recall in this period told owners to park outside until the repair was done. None told owners not to drive. Two recalls were remedied with over-the-air software updates, which Genesis sent to the vehicle wirelessly.
Which models have the most recalls
The GV60 has the most, 10. The GV70 and GV80 have 9 each, the G80 has 8, the G90 has 7, and the G70 and GV70 Electrified have 4 each. The G80 Electrified has 2.
What owners are reporting
Electrical problems lead complaints too, with 172. Owners in this area commonly describe screens that freeze or reboot, battery drain, and warning lights that come and go. The engine follows with 110 complaints, often about hesitation, noises or check engine lights. The fuel and propulsion system has 109, a category that includes fuel delivery on gas models and the drive system on electric models.
Forward collision avoidance has 100 complaints, usually about unexpected braking or false alerts. Unclassified or other issues account for 94 and the power train for 84. Exterior lighting (51) and vehicle speed control (48), which includes cruise control and acceleration complaints, complete the list.
How a Genesis Lemon Law Claim Works
Genesis does business through Genesis retailers, and warranty work is performed at authorized retailer service departments. With Service Valet, your car may be picked up and returned without you ever walking into the building. That is convenient, but it can leave you without a clear record of what you told the technician. Close that gap.
- Put your complaint in writing. When you book Service Valet, describe the problem in the request or send a follow-up email. Say what happens, how often, and under what conditions, such as "cluster went black twice at highway speed this week."
- Get every repair order. Ask the retailer to email the closed repair order after each visit. It should show the dates, mileage, your complaint, and the work done, or a note that the problem could not be duplicated.
- Track days out of service. Write down the pickup and return date for every valet visit. Those days add up toward the 30-day mark.
- Save software and update notices. Keep the notice for any over-the-air update and ask the retailer to note dealer reflashes. In our experience, a software update can count as a repair attempt, and the same one is sometimes repeated 5 or 6 times without a fix.
- Film the problem. A short video of a dark cluster, a frozen center screen or a driver-assist warning, with the date and mileage, is strong evidence.
The presumption applies within 18 months or 18,000 miles, whichever comes first, after 4 or more repairs for the same problem, 2 or more for a defect likely to cause death or serious bodily injury, or more than 30 days out of service. It is a benchmark, not a requirement.
In our experience, a recall repair visit can count as a repair attempt, especially if you complained before the recall, and days waiting for recall parts count toward the 30 days. Do not put off that first visit. The buyback offset is measured from the first time you reported the problem, so waiting too long is the biggest mistake we see.
What you can recover
A repurchase refunds what you paid, less miles driven before the first repair visit for the defect, divided by 120,000, times the price paid. Estimate yours with our California lemon law calculator and read what a lemon law buyback is. For a willful violation, a court may add a civil penalty of up to two times actual damages. AB 1755, effective in 2025, set new procedures for manufacturers that elected into them; some manufacturers have elected into these procedures. See what changed with AB 1755.

California Lemon Law for Genesis Owners
The Song-Beverly Consumer Warranty Act protects Genesis owners and lessees in California. If Genesis or its authorized repair facilities cannot fix a warranty defect after a reasonable number of attempts, the manufacturer must repurchase or replace the vehicle (Civil Code 1793.2(d)).
A vehicle is presumed to be a lemon if, within 18 months or 18,000 miles of delivery, the same problem was repaired 4 or more times, a defect that could cause death or serious injury was repaired 2 or more times, or the vehicle was out of service for repairs for more than 30 days in total (Civil Code 1793.22). Many vehicles outside that window still qualify while they are under warranty. New, leased, certified pre-owned, demo and dealer vehicles can qualify; ordinary used cars without a new-car warranty generally no longer do after Rodriguez v. FCA US (2024).
What you can recover
- Buyback: your down payment, payments, taxes and fees, minus a mileage offset, with the loan or lease paid off.
- Replacement with a comparable new vehicle.
- Cash and keep: a cash settlement while you keep the vehicle.
- Civil penalty of up to two times your damages if the manufacturer willfully failed to comply (Civil Code 1794(c)).
What it costs

Genesis Lemon Law FAQ
Does California lemon law cover my Genesis GV70?
Yes, if you bought or leased it new in California, or bought it certified or as a demo with a new-car warranty, and Genesis could not fix a warranty defect after a reasonable number of attempts. The same rules apply to the GV70 Electrified.
Who pays my attorney fees in a Genesis lemon law case?
You pay nothing, win or lose. We are paid only if you win, and the manufacturer pays our fees, including in settlements. If a case is lost, our firm covers the costs. California law makes the manufacturer pay reasonable attorney fees when the buyer prevails.
Can I get a buyback for a Genesis with a recall?
Possibly. In our experience, a recall repair visit can count as a repair attempt, and a recall with no available fix can support a buyback on its own. Call an attorney as soon as you get a recall notice.
Do Service Valet visits count as repair attempts?
Yes. A valet pickup is still a warranty visit at a Genesis retailer, so it counts if the problem is documented. Ask for the repair order after each one and note the pickup and return dates.
Does an over-the-air update on my Genesis count as a repair?
In our experience, a software update meant to fix a problem you reported can count as a repair attempt. Save the update notice and tell the retailer whether the problem came back.
How long does a Genesis lemon law case take?
In our experience, recall-related cases often resolve in about 1 to 3 months from the first call, while litigated cases take longer. Prior results do not guarantee a similar outcome.

Genesis Lemon Law — Your Rights
If your Genesis vehicle has a persistent defect that Genesis’s authorized dealers cannot repair after a reasonable number of attempts, California’s Song-Beverly Consumer Warranty Act may entitle you to a full refund or replacement. This applies to new and certified pre-owned vehicles still within the manufacturer’s original warranty period.
Under the lemon law presumption, you typically need four or more repair attempts for the same problem, two attempts for a safety defect, or 30 cumulative days in the shop. Genesis pays your attorney fees if your claim succeeds — you pay nothing out of pocket.
The manufacturer — not you — is required to pay your attorney fees under Cal. Civ. Code § 1794(d) if your lemon law claim is successful. You pay nothing upfront and nothing out of pocket.
