Exterior Lighting

Emerging PatternSong-Beverly Strength: Very Strong

The 2023 Genesis G70 has generated 4 NHTSA complaints for this defect category. If your vehicle has experienced recurring issues in this area that the dealer has been unable to repair after multiple attempts, you may have a qualifying lemon law claim under California’s Song-Beverly Consumer Warranty Act. Owner reports include: “HEADLIGHTS WITH LOTS OF CONDENSATION. APPARENTLY GENESIS HAS BEEN HAVING ISSUES WITH THEIR HEADLIGHTS. THIS IS A SAFETY ISSUE ESPECIALLY AT NIGHT. HEADLIGHTS GOING OUT DURING THE DAY IS A MINOR CONCERN BUT CAUSING MORE ELECTRICAL ISSUE IN THE VEHICLE IS A MAJOR CONCERN, ALONG WITH HEADLIGHTS GOING OUT AT NIGHT. THERE SHOULD BE A SAFETY RECALL FOR GENESIS HEADLIGHTS.” (NHTSA Complaint #11699989)

Powertrain

Emerging PatternSong-Beverly Strength: Strong

Powertrain and transmission defects directly impair the vehicle’s core function and are generally considered substantial defects under California lemon law. Owners of the 2023 Genesis G70 have reported harsh shifting, shuddering, slipping, and transmission warning lights. 4 NHTSA complaints have been submitted for this defect category. Owner reports include: “There is a constant wheel bearing-type noise that is distractingly audible above ~40mph, and the whine is load and annoying at ~80mph, coming from the rear of the car. There is a constant droning and harmonic pulsating noise that cannot be attenuated with the car’s active noise suppression technology, either. It is an otherwise wonderful car, but this whining is going to become more of an issue now that summer is here and the windows will be down. The pitch of the whine increases in frequency as the road speed increases, and right/left steering movements or accelerate/de-accelerate activities don’t seem to affect the intensity of the rearend bearing noise. The ever-present noise (our mileage of just over 25k) has grown over the last ~5k miles to be rather unpleasant inside of the cabin, and our current scheduled maintenance visit did not produce a solution for the ever-present noise.” (NHTSA Complaint #11672795)

Power Train,Engine,Fuel/Propulsion System

Emerging PatternSong-Beverly Strength: Moderate

Engine and cooling problems are among the most serious defects under California’s Song-Beverly Act. Owners of the 2023 Genesis G70 have reported issues including stalling, overheating, loss of power, rough idling, excessive oil consumption, and check engine lights that return after dealer repairs. With 2 NHTSA complaints on record, this defect pattern is well-documented. Owner reports include: “While driving at highway speed, the vehicle experienced a sustained loss of motive power. Despite the accelerator pedal being fully depressed, the vehicle would not accelerate beyond approximately 62 mph. Based on the symptoms and prior service history, the malfunction appears related to the fuel/propulsion system, engine, or powertrain. The vehicle is currently parked and available for inspection upon request. This failure placed the safety of the occupants and other motorists at risk. The vehicle was unable to safely accelerate, merge, pass, or respond to traffic conditions. Hazard lights were activated, and the vehicle was forced to remain in the slow lane of the highway for an extended period to avoid being struck by faster-moving traffic. The problem was reproducible and occurred repeatedly during the same trip. Acceleration was tested multiple times, and each attempt resulted in the same loss of power with no response to throttle input. The condition persisted for the entire drive. The vehicle has not yet been inspected following this incident. However, the vehicle previously received a manufacturer warranty repair involving replacement of the high-pressure fuel pump, and the manufacturer has issued a warranty extension for this component. The loss of motive power occurred after that repair. No warning lamps, alerts, or messages were observed prior to or during the failure. There were no warning symptoms immediately preceding the loss of motive power. This loss of propulsion at highway speed created a serious and immediate safety hazard due to the inability to maintain normal traffic speed or maneuver safely.” (NHTSA Complaint #11716612)

Engine,Fuel/Propulsion System

Emerging PatternSong-Beverly Strength: Moderate

Engine and cooling problems are among the most serious defects under California’s Song-Beverly Act. Owners of the 2023 Genesis G70 have reported issues including stalling, overheating, loss of power, rough idling, excessive oil consumption, and check engine lights that return after dealer repairs. With 2 NHTSA complaints on record, this defect pattern is well-documented. Owner reports include: “The fuel delivery system, specifically the fuel pump and fuel rail pressure system, has malfunctioned and continues to trigger diagnostic trouble code P0191 (fuel rail pressure sensor range/performance), despite a prior recall-related software update performed by the dealer, and the vehicle and all affected components are available for inspection upon request. While driving on the highway, the vehicle suddenly began stalling, hesitating, and hard jerking before losing power and entering limp mode, limiting speed to under 50 mph and forcing me to immediately pull over, which created a serious safety risk to myself and other drivers due to the sudden inability to maintain highway speeds. The issue has been confirmed by an authorized dealer through repeated diagnostic scans showing the same fuel system fault codes, and the dealer has determined the fuel pump now requires replacement, indicating the recall update did not resolve the underlying failure. The vehicle has been inspected by the dealer on behalf of the manufacturer, and prior to the failure the check engine light illuminated and has remained on since, with symptoms escalating abruptly and occurring without warning, making this an ongoing and unpredictable safety issue.” (NHTSA Complaint #11716082)

Air bags deployed due to impact. Total loss.” (NHTSA Complaint #11713142)

California Lemon Law — Song-Beverly Act

California’s Song-Beverly Consumer Warranty Act (Cal. Civ. Code §§ 1790–1795.8) is one of the strongest lemon laws in the United States. It protects buyers and lessees of new and certified pre-owned vehicles that develop substantial defects the manufacturer cannot repair after a reasonable number of attempts.

Under Cal. Civ. Code § 1793.22, a lemon law presumption is triggered when any of the following apply to your 2023 Genesis G70:

  • 4+ repair attempts for the same non-safety defect without resolution
  • 2+ repair attempts for a defect likely to cause death or serious bodily injury
  • 30+ calendar days out of service for warranty repairs (cumulative, not consecutive)

Once the presumption is triggered, the burden shifts to Genesis to prove the vehicle is not a lemon. Under Cal. Civ. Code § 1794(d), Genesis must pay your attorney’s fees if you prevail — meaning qualified representation costs you nothing out of pocket.

What You Can Recover

If your 2023 Genesis G70 qualifies as a lemon under California law, Genesis may be legally required to:

  • Repurchase your vehicle — Full refund of your down payment, all monthly payments, registration fees, and incidental costs (towing, rentals), minus a mileage offset for miles driven before the first repair attempt
  • Replace your vehicle — Provide a new, comparable vehicle at no cost to you
  • Pay your attorney’s fees — Under § 1794(d), Genesis pays all legal fees if you prevail
  • Civil penalty up to 2x damages — If Genesis willfully violated the Act, courts may award double the actual damages

Steps to Protect Your 2023 Genesis G70 Claim

Step 1: Document every repair visit. Keep all repair orders, work orders, and dealer invoices. Each visit counts as a repair attempt, even if the dealer says nothing is wrong.

Step 2: Keep returning for repairs. You must give Genesis a reasonable opportunity to fix the defect. Visit different authorized Genesis dealers if needed and ask for written documentation of each visit.

Step 3: Contact a California lemon law attorney. Once you believe the threshold has been met — 4 attempts for non-safety defects, 2 for safety defects, or 30 days out of service — contact an attorney for a free case evaluation. Under § 1794(d), Genesis pays your fees if you win.

Step 4: Send a demand letter. Your attorney will send Genesis a formal demand letter. Most California lemon law cases resolve through negotiation without going to trial.

2023 Genesis G70 Lemon Law Questions

How many repair attempts qualify my 2023 Genesis G70 as a lemon?

Under Cal. Civ. Code § 1793.22, four or more repair attempts for the same non-safety defect, or two attempts for a safety-related defect, triggers the lemon law presumption. Additionally, 30 or more cumulative days out of service qualifies regardless of the number of repair attempts.

Does Genesis pay my attorney fees?

Yes. Under Cal. Civ. Code § 1794(d), Genesis is required to pay your reasonable attorney’s fees and court costs if you prevail in a lemon law claim. This means qualified lemon law representation is free to you if your case succeeds.

Can I file a lemon law claim without an active recall?

Yes. A recall is not required to file a lemon law claim. The Song-Beverly Act covers any substantial defect that impairs the use, value, or safety of the vehicle that the manufacturer cannot repair after a reasonable number of attempts. NHTSA complaints support the claim by establishing a pattern, but are not a prerequisite.

What is the time limit to file a lemon law claim for my 2023 Genesis G70?

California lemon law claims are generally subject to a four-year statute of limitations from the date you discovered or should have discovered the defect. However, you must still be within the manufacturer’s original warranty period when the defect first appears. Contact an attorney promptly to preserve your rights.
