Powertrain

High Claim VolumeSong-Beverly Strength: Very Strong

Powertrain and transmission defects directly impair the vehicle’s core function and are generally considered substantial defects under California lemon law. Owners of the 2022 Kia Sorento have reported harsh shifting, shuddering, slipping, and transmission warning lights. 50 NHTSA complaints have been submitted for this defect category. Owner reports include: “I am reporting a serious safety defect regarding my 2022 Kia Sorento Hybrid (Mileage: 91,661). The vehicle was diagnosed with an internal short in the EGR (Exhaust Gas Recirculation) Control Unit (Error codes P0404, P049D). Upon inspection, significant engine oil intrusion was found inside the EGR unit. The EGR system is designed to handle exhaust gases only; the presence of liquid engine oil indicates a critical failure in the powertrain system (likely the PCV system or turbocharger seals) which is forcing oil into the intake/exhaust tract. Safety Risk: This defect causes the EGR system to short-circuit, which can lead to unpredictable engine performance, reduced power, or sudden engine stalling while driving. Any sudden loss of power on a highway poses a severe risk of a rear-end collision. Furthermore, oil intrusion into electrical components increases the risk of thermal incidents or localized fires within the engine bay. Despite the vehicle being within the 10-year/100,000-mile Powertrain Warranty, the dealership (Suntrup Kia South) is refusing coverage, claiming the EGR is not a powertrain component, while ignoring the fact that a powertrain failure (oil bypass) is the root cause of the damage. I request NHTSA to investigate this “oil intrusion into EGR” issue as it appears to be a systemic defect in Kia’s hybrid powertrain that compromises vehicle safety.” (NHTSA Complaint #11710558)

Engine

High Claim VolumeSong-Beverly Strength: Strong

Engine and cooling problems are among the most serious defects under California’s Song-Beverly Act. Owners of the 2022 Kia Sorento have reported issues including stalling, overheating, loss of power, rough idling, excessive oil consumption, and check engine lights that return after dealer repairs. With 38 NHTSA complaints on record, this defect pattern is well-documented. Owner reports include: “Kia refuses to perform a U.S. safety recall due to my being active duty U.S. military stationed overseas. The affected vehicle is U.S.-spec and registered to a U.S. address. The recall (SC250) involves sudden loss of drive power and is a major safety defect. Kia has refused to authorize parts or repair overseas, putting me and my family at risk.” (NHTSA Complaint #11702757)

Other Systems

High Claim VolumeSong-Beverly Strength: Moderate

The 2022 Kia Sorento has generated 34 NHTSA complaints for this defect category. If your vehicle has experienced recurring issues in this area that the dealer has been unable to repair after multiple attempts, you may have a qualifying lemon law claim under California’s Song-Beverly Consumer Warranty Act. Owner reports include: “Vehicle purchased August 2022. July 13, 2023: Vehicle experienced sudden loss of acceleration while driving. The vehicle would not properly accelerate with traffic flow and another vehicle nearly struck me due to the unexpected loss of propulsion. Vehicle was towed to Kia dealership in Duluth, GA. I was told the issue was repaired and an electrical recall was completed. December 8, 2025: Acceleration failure reoccurred while driving. Vehicle drifted and would not accelerate. A vehicle behind me nearly collided with my car because I could not accelerate normally. After restarting the vehicle multiple times, I was able to reach home. December 11, 2025: Vehicle again failed to accelerate while stopped on an incline. The vehicle would not move forward properly and created a rollback hazard. A vehicle approached from behind and I was placed in a dangerous position due to inability to accelerate. Vehicle was towed by insurance. Dealership diagnostics reportedly cannot detect an issue. I have been instructed to operate the vehicle with a monitoring device installed to capture driving data. Repeated loss of acceleration and multiple near-collision events present a significant safety hazard and risk of serious accident. The issue remains unresolved.” (NHTSA Complaint #11717389)

Moderate Claim VolumeSong-Beverly Strength: Moderate

Engine and cooling problems are among the most serious defects under California’s Song-Beverly Act. Owners of the 2022 Kia Sorento have reported issues including stalling, overheating, loss of power, rough idling, excessive oil consumption, and check engine lights that return after dealer repairs. With 17 NHTSA complaints on record, this defect pattern is well-documented. Owner reports include: “The vehicle will sometimes, after shifting from park to drive, roll backwards if on an incline, even while gassing. If not an incline when this occurs, the vehicle will not move forwards. This typically lasts for a few seconds before the transmission engages. This happens intermittently; the first time it happened to my family member, it almost caused an accident. Kia has attempted to repair this defect three times but has been unsuccessful. During the last repair attempt, the Kia tech told me that they’ve seen multiple vehicles with this issue, and that it is “normal” for Kia.” (NHTSA Complaint #11684632)

Moderate Claim VolumeSong-Beverly Strength: Moderate

The 2022 Kia Sorento has generated 15 NHTSA complaints for this defect category. If your vehicle has experienced recurring issues in this area that the dealer has been unable to repair after multiple attempts, you may have a qualifying lemon law claim under California’s Song-Beverly Consumer Warranty Act. Owner reports include: “My wife was driving down the highway (XXX) after dropping our daughter off at school. The closest car was approximately 10 cars ahead of her and there were no vehicles behind her. The outside temperature was about 48 degrees, the A/C was set to about 70 degrees. She was driving about 70mph. My wife described the sound to be what she thought was a shotgun blast above her head followed by wind noise like if the sunroof had opened. She looked in the rear-view mirror and observed glass flying behind the car, and what sounded like glass continuously falling on to the cloth for the retractable headliner. When she arrived home I took pictures of the sun roof and noticed that the glass appeared to be pushed upwards (away from the car) as if the glass had been over-pressurized and “popped”. By the looks of the glass it appeared as though something massive had been thrown from the inside of the car through the sun roof (although not possible as my wife is small and the retractable headliner was closed). My two youngest kids were in the car with my wife and if the headliner would have been retracted they 100%, without a doubt in my mind, would have been injured by the blow back of the glass “exploding”. For context I am an Aviation Electricians mate in the Navy and it looked the exact same as when we have had windows on our Aircraft fail and they have blown outwards. California Lemon Law — Song-Beverly Act

California’s Song-Beverly Consumer Warranty Act (Cal. Civ. Code §§ 1790–1795.8) is one of the strongest lemon laws in the United States. It protects buyers and lessees of new and certified pre-owned vehicles that develop substantial defects the manufacturer cannot repair after a reasonable number of attempts.

Under Cal. Civ. Code § 1793.22, a lemon law presumption is triggered when any of the following apply to your 2022 Kia Sorento:

  • 4+ repair attempts for the same non-safety defect without resolution
  • 2+ repair attempts for a defect likely to cause death or serious bodily injury
  • 30+ calendar days out of service for warranty repairs (cumulative, not consecutive)

Once the presumption is triggered, the burden shifts to Kia to prove the vehicle is not a lemon. Under Cal. Civ. Code § 1794(d), Kia must pay your attorney’s fees if you prevail — meaning qualified representation costs you nothing out of pocket.

What You Can Recover

If your 2022 Kia Sorento qualifies as a lemon under California law, Kia may be legally required to:

  • Repurchase your vehicle — Full refund of your down payment, all monthly payments, registration fees, and incidental costs (towing, rentals), minus a mileage offset for miles driven before the first repair attempt
  • Replace your vehicle — Provide a new, comparable vehicle at no cost to you
  • Pay your attorney’s fees — Under § 1794(d), Kia pays all legal fees if you prevail
  • Civil penalty up to 2x damages — If Kia willfully violated the Act, courts may award double the actual damages

Steps to Protect Your 2022 Kia Sorento Claim

Step 1: Document every repair visit. Keep all repair orders, work orders, and dealer invoices. Each visit counts as a repair attempt, even if the dealer says nothing is wrong.

Step 2: Keep returning for repairs. You must give Kia a reasonable opportunity to fix the defect. Visit different authorized Kia dealers if needed and ask for written documentation of each visit.

Step 3: Contact a California lemon law attorney. Once you believe the threshold has been met — 4 attempts for non-safety defects, 2 for safety defects, or 30 days out of service — contact an attorney for a free case evaluation. Under § 1794(d), Kia pays your fees if you win.

Step 4: Send a demand letter. Your attorney will send Kia a formal demand letter. Most California lemon law cases resolve through negotiation without going to trial.

2022 Kia Sorento Lemon Law Questions

How many repair attempts qualify my 2022 Kia Sorento as a lemon?

Under Cal. Civ. Code § 1793.22, four or more repair attempts for the same non-safety defect, or two attempts for a safety-related defect, triggers the lemon law presumption. Additionally, 30 or more cumulative days out of service qualifies regardless of the number of repair attempts.

Does Kia pay my attorney fees?

Yes. Under Cal. Civ. Code § 1794(d), Kia is required to pay your reasonable attorney’s fees and court costs if you prevail in a lemon law claim. This means qualified lemon law representation is free to you if your case succeeds.

Can I file a lemon law claim without an active recall?

Yes. A recall is not required to file a lemon law claim. The Song-Beverly Act covers any substantial defect that impairs the use, value, or safety of the vehicle that the manufacturer cannot repair after a reasonable number of attempts. NHTSA complaints support the claim by establishing a pattern, but are not a prerequisite.

What is the time limit to file a lemon law claim for my 2022 Kia Sorento?

California lemon law claims are generally subject to a four-year statute of limitations from the date you discovered or should have discovered the defect. However, you must still be within the manufacturer’s original warranty period when the defect first appears. Contact an attorney promptly to preserve your rights.
