The dealer provided me with a written refusal, stating they “will not be able to perform inspection on Recall 25C43 due to instructions for mechanic not available.” This is unacceptable because under 49 U.S.C. § 30120(c)(1), a manufacturer must remedy a defect “without charge when the vehicle is presented for remedy.” Ford’s dealer communication of Aug 25, 2025 instructed dealers to inspect body seams and the BCM for water or corrosion, and replace the BCM if needed. By refusing inspection, the dealer has left me driving a car at risk of safety-critical lighting failure. I am requesting that NHTSA enforce compliance so Ford dealers provide at least the required inspection and interim remedy immediately, rather than forcing customers to wait until 2026.” (NHTSA Complaint #11685239)

Risk: A fuel leak in the presence of an ignition source such as hot engine or exhaust components, can increase the risk of a fire. In addition, a loss of fuel may result in an engine stall, increasing the risk of a crash.

Risk: A frozen or missing rearview camera image can reduce the driver’s view behind the vehicle, increasing the risk of a crash.

Remedy: The accessory protocol interface module (APIM) software will be updated by a dealer or through an over-the-air update, free of charge. California Lemon Law — Song-Beverly Act

California’s Song-Beverly Consumer Warranty Act (Cal. Civ. Code §§ 1790–1795.8) is one of the strongest lemon laws in the United States. It protects buyers and lessees of new and certified pre-owned vehicles that develop substantial defects the manufacturer cannot repair after a reasonable number of attempts.

Under Cal. Civ. Code § 1793.22, a lemon law presumption is triggered when any of the following apply to your 2024 Ford Mustang:
